Last Updated: August 11, 2024 Welcome to Apex RN Prep, LLC (“Apex RN Prep,” “we,” “us,” or “our”). By accessing or using our Online Live NCLEX RN Preparation Course (the “Course”), you agree to abide by the following Terms of Service (the “Terms”). Please read these Terms carefully before enrolling in or participating in the Course. 1. Course Description Apex RN Prep offers an Online Live NCLEX RN Preparation Course designed to prepare students for the NCLEX RN examination. The Course is conducted via Microsoft Teams and includes live sessions, recorded content, and other educational resources. 2. Enrollment and Payment Enrollment: Enrollment in the Course is subject to availability. To enroll, you must complete the registration process on our website. Payment: Payment for the Course is processed through Stripe on our website. By providing payment information, you authorize Stripe to charge the specified amount for the Course. Full payment is required prior to accessing the Course. 3. Course Schedule Schedule: The Course is offered Monday through Friday, with each session lasting 2 hours per day. Cancellation and Make-Up Classes: In the event of an urgent situation that results in a cancelled class, the Course will be extended to make up for the missed days. This means additional sessions will be scheduled to ensure that the total number of instructional hours is met. Federal Holidays: There will be no classes held on Federal holidays. Any missed classes due to Federal holidays will not be rescheduled. 4. No Refund Policy All fees paid for the Course are non-refundable. Once your payment is processed, you are responsible for the full amount, regardless of whether you attend the Course or not. 5. Recordings and Consent Recording: The Course sessions are recorded for educational purposes. By enrolling in the Course, you consent to being recorded during live sessions. These recordings may be used for future educational content, including but not limited to promotional and marketing materials. Consent: Your participation in the Course indicates your consent to being recorded and your understanding that these recordings may be used for educational, promotional, and marketing purposes. This includes, but is not limited to, use on our website, social media platforms, and other marketing channels. Recording Prohibition: By enrolling in the APEX RN Prep NCLEX-RN preparation course, students agree not to record, reproduce, or distribute any portion of the course material, including but not limited to lectures, webinars, presentations, or any other content provided during the course, in any form, including audio, video, or screen captures. Recording of any kind is strictly prohibited, regardless of the method or device used. Any student found to be making recordings will be in violation of these terms and will be subject to immediate legal action, including but not limited to the termination of access to the course, financial penalties, and potential legal consequences. APEX RN Prep reserves the right to pursue all available legal remedies to protect its intellectual property and course content. Non-Consent: Students who successfully pass the NCLEX-RN exam after completing the APEX RN Prep Course, without having enrolled in any subsequent NCLEX-related courses prior to passing the NCLEX-RN Exam, agree to not grant consent to any other NCLEX-RN preparation institute to use their name, image, likeness, or video in any form of promotional material, including but not limited to advertisements, testimonials, social media posts, or marketing campaigns. Any unauthorized use of such materials by other entities is strictly prohibited and will be subject to legal action. 6. Payment for Access Payment covers access to the course. Apex RN Prep makes no guarantee that participation in the Course will result in passing the NCLEX RN examination. Success on the NCLEX RN exam is dependent on various factors, including individual effort, study habits, and examination conditions. 7. Use of Microsoft Teams The Course is conducted via Microsoft Teams. It is your responsibility to ensure you have a compatible device and internet connection to participate in the Course. We are not liable for any technical issues or interruptions related to Microsoft Teams. 8. Intellectual Property All content provided as part of the Course, including but not limited to recordings, materials, and resources, is the intellectual property of Apex RN Prep or its licensors. You may not reproduce, distribute, or otherwise use such content without explicit written permission from Apex RN Prep. 9. Code of Conduct Participants are expected to conduct themselves in a professional and respectful manner during the Course. Harassment, discrimination, or disruptive behavior will not be tolerated and may result in removal from the Course without refund. 10. Limitation of Liability Apex RN Prep, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your participation in the Course. Our total liability to you for any claims arising out of your participation in the Course shall be limited to the amount you paid for the Course. In no case shall Apex RN Prep, LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. 11. Modifications Apex RN Prep reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting to our website. Your continued use of the Course following any such changes constitutes your acceptance of the new Terms. 12. Governing Law These Terms are governed by and construed in accordance with the laws of the state of Florida, without regard to its conflict of laws principles. 13.
