1) Foster Home understands and agrees that equines placed in their care for
fostering are the sole property of the organization, foster care is provided voluntarily because foster home wants to help rescued horses, foster care is temporary until a permanent home can be secured.
2) Foster Home understands that the Organization may, at its discretion, remove any equine fostered from their property and care at any time. Foster Home gives the Organization the express permission to enter the property where the Foster Home is keeping the fostered horse(s) at any time to remove the equine.
3) Foster Home understands and agrees that if they require or desire to cease
fostering an equine for the Organization, notice must be given in writing to an officer of the organization thirty (30) days prior to the date the equine must leave.
4) Foster Home understands that questions or concerns should be presented to the
organization prior to signing this agreement.
5) Foster Home agrees to provide hay, grain, water and sanitary, safe living
conditions to the equines in their foster care. Hay must be appropriate for
horses.Free of any mold. A horse should eat one to two percent of their body weight in roughage every day. Grain will be recommended based on the equine. ie: mare and foal for growing horses, senior for aged horses, low starch for minis. We do not find sweet feed as a acceptable grain.
6) Foster Home agrees to schedule and be present for farrier and veterinary care for fostered horse
7) Foster Home agrees to comply in 24 or 48 hours - with requests from the
Organization for information about any equines owned by the Organization and in
their foster care.
8) Foster Home agrees to allow potential adopters of any equine(s) owned by the
Organization, access to said equine(s) for purposes of pre-adoption visits. We
recommend having potential adopters sign a liability waiver.
9) Foster Home understands and agrees that any equine owned by the Organization and in their foster care may not be sold, given away, leased out, sent to slaughter, removed from their personal supervision, or moved from the above designated address without the express written permission of the Organization
Foster Home understands and agrees that any equine owned by the Organization
and in their foster care may not be sent to slaughter under any circumstances.
10) In the event of an emergency, Foster Home understands that they may move
any equine(s) owned by the Organization and in their foster care to a safe place.
Foster Home also agrees to give the Organization written notice (in person,
by telephone call or email) of the new location of the equine(s) within twenty-four
(24) hours of moving them. Foster Home understands and agrees that the
Organization may, at its discretion, remove the equine from the emergency location
and must be granted authority to do so by the emergency location’s property owner.
11) Foster Home agrees that should it become necessary to euthanize any equine
owned by the Organization, the Foster Home will immediately notify the Organization in writing and will provide the Organization at that time with a veterinary statement as to the cause for such euthanization and the scheduled date for the euthanization.
The Foster Home understands and agrees that the ultimate decision concerning
euthanization remains with the Organization, and the Organization may disagree
with that decision and remove the fostered horse before the euthanization occurs.
12) Foster Home agrees that an authorized representative of the Organization may
enter the property where any fostered equine(s) reside, with or without notice, and
remove any fostered horse(s) without cause.
13) Foster Home understands that any equine related activity involving horses is
inherently dangerous and agrees to assume all liability and hold the organization,
their officers, agents and volunteers harmless for any injuries or damages. Foster
home understands that once they receive a foster horse for foster care, that horse is legally in their care, custody and control and to be treated kindly and
responsibly.
14) The foster home will receive 20% off the adoption fee. If you decided to adopt
the foster equine it is agreed upon that the foster home will pay 70% of the adoption fee.
Governing Law
This Contract agreement shall be governed by and construed in accordance with the laws of the the state of Maine. Any and all disputes arising out of this
Lease shall be adjudicated in the State of Maind. In the event of any action or proceeding to declare or enforce the terms of this Contract, the Plaintiff
shall be entitled to recover reasonable attorney’s fees and other costs from the
Defendant in addition to any relief that may also be granted.
Entire Agreement
This Contract constitutes the entire agreement between the parties and shall not be
amended except by written agreement of the parties.
Enforceability
In the event one or more parts of this Contract are found to be unenforceable or
illegal, the other portions shall be deemed in full force and effect.
