Adoption Contract

In consideration of the promises and statements to follow herein, Yoga Animals Rescue Foundation (Rescuer) and the undersigned (Adopter), having read and in full agreement & understanding, do willingly enter into this Contract with the intent to be fully, legally bound by all Terms & Agreements within this Contract and hereby consent and agree to the following:
I, the Adopter, hereby understands, promises, and agrees, whereupon signing this agreement OR receiving the animal, to indemnify, forever release, discharge and hold harmless Rescuer from any and all actions, causes of action, suits, debts, duties, claims and demands resulting from any action or omission arising out of any cause whatsoever and without limitation and particularly as related to the donation for or adoption of:

The Adopter hereby acknowledges the following provisions as defined:
FEE:

The NON-refundable donation is not a sale price, but rather requested to defer or reimburse Rescuer for any medical treatment or alternative care, transportation, nutritional or supplemental costs and any other expenses incurred by the Rescuer for the pet in order to consider the pet available for adoption. NO refunds in whole or part for any reason!

TRANSFER OF OWNERSHIP:

The pet shall NOT be sold, given to, or adopted to anyone not reflected on this contract, nor shall there be any transfer of ownership to any firm, corporation, or organization of other homeless animals, such as another rescue facility, research facility OR SHELTER. Any animal adopted from Rescuer must be returned to Rescuer if for ANY reason the Adopter can no longer keep it. If I, Adopter, Violate this agreement , I agree to pay YARF any and all costs associated with redeeming or securing the animal back into the Rescue including any resulting court costs and attorney fees.

HEALTH PROGRAM:

The pet, if adopted as a puppy/kitty shall complete the booster series of 3 boosters along with a Rabies. Adopter agrees to ensure completion of series. All pets must have booster shots and Rabies vaccines as recommended by their vet. Renewal of the Rabies vaccine is required by law and therefore by the terms of this contract, unless contraindicated for health reasons. Adopter agrees to obtain immediate vet care for the animal should it become sick or injured and takes full financial responsibility for such care as of the time this contract is signed and pet is in your possession.

IMPORTANT NOTICE - GUARANTEES:

Rescuer makes NO explicit or implicit guarantees in reference to the age, nature, health and/or temperament of the pet. The pet is adopted "as is" and the Adopter assumes all responsibility for treatment of any and all existing conditions, or any other conditions of physical or temperament changes that may occur. Rescuer will provide the pet with the above required vaccines before adoption if the age and current health of the pet permits. While the Rescuer makes every effort to place for adoption healthy animals, rescued animals - especially puppies and kittens get sick very easily & quickly, so Rescuer cannot guarantee the health of any animal beyond what is currently observable by the Rescuer and yourself as Adopter at the time of adoption, therefore Rescuer shall not be held responsible for any medical expenses which may be incurred after animal is in the possession of Adopter. I, as Adopter, understand and agree that YARF will not reimburse me for any expenses, including veterinary costs, even if the animal immediately becomes ill for any reason. I, as Adopter, also agree that YARF is in no way responsible for any damage which this animal may do to any person, other animal or property and no attempt will be made to hold YARF responsible. It is hereby expressly excluded any implied warranties of merchantability or fitness for any particular purpose, including and without limitation, any warranties regarding health or temperament, including whether the pet is housebroken/litter trained.

ADOPTER ACKNOWLEDGES and further promises, covenants and agrees:

That whereupon receiving the animal, the undersigned Adopter hereby agrees to be lawfully bound to the following

TERMS:
- The pet will not be allowed off leash except within adequate fencing and even then only with100% recall of the pet to the adopter.
- The pet will not live outside, in a garage, doghouse, or any type of outbuilding and while outside will not be chained to a doghouse, any object or outbuilding.
- The pet is (or will soon be) microchipped for identification and will wear a collar or harness with an ID tag reflecting the Adopter's contact information. Adopter agrees to obtain the proper municipal license required under local law.
- The pet is NOT to be left unsupervised with children or other animals at any time, ever.
- The pet is to have food, water, and shelter at all times. That includes protection from both hot and cold weather which could endanger the health of the animal.
- The Adopter shall refrain from any type of abuse of the animal and from otherwise treating the pet in a mean, cruel or physically rough manner.
  Pet will never be left alone in a car. Nor ride in the back of a truck without proper enclosure.
- If for some reason I, Adopter, no longer wants the pet or am unable to care for the pet, the pet will be returned to YARF as soon as arrangement for such return can be made.
- If Rescuer determines the pet is at risk with the Adopter, the pet may be seized from Adopter and Adopter agrees, by signing this contract, to waive all rights to the pet or to court action, thus returning the pet to the care and possession of the Rescue and Adopter will be responsible for any and all costs associated with such seizure.

All donations received are final and NON-refundable. However, in the event that Adopter fails to complete all adoption criteria, the pet is not picked up or the pet is returned, and by written request from Adopter, the Rescue may provide a statement of donation which may be considered for tax purposes.

Colorado state law requires all animals be spay/neutered before they leave the organization, unless medically contraindicated.

If any Agreement or Term is broken

If any Agreement or Term is broken or ALL adoption criteria is not fulfilled by me, Adopter, including but not limited to; paying the adoption donation, completing the adoption application & agreement, and keeping any medical appointments. Failure to pick up the pet from spay/neuter appointment OR if for ANY other reason I, Adopter, fail to fully and timely comply with the terms of this Agreement, I will voluntarily and immediately return ownership, custody, possession and control of the animal to YARF, and that if I fail to do so, YARF will be able to enforce specific performance of this contract in addition to any other legal remedy available to YARF

Adopter agrees that a breach by Adopter of this Agreement would damage YARF in a way that could not be adequately compensated by monetary damages. The parties therefore agree that the breach or threatened breach by Adopter of this Agreement may appropriately be restrained by an injunctive order for Adopter to return pet to YARF, granted by a court of appropriate jurisdiction. Adopter further agrees that the actual damages that might be sustained by YARF by reason of breach by Adopter of this Agreement are uncertain and would be difficult of ascertainment, and that, in addition to the injunctive relief agreed to above, the sum of $1,000 would be reasonable compensation for such monetary damages and attorney's fees. Adopter hereby promises to pay and YARF hereby agrees to accept, such sum as liquidated damages, and not as a penalty, in the event of such a breach.

CONFIDENTIALITY

This is a confidential agreement between the Adopter and the Rescuer.

RIGHT OF OWNERSHIP

The pet adopted from the Rescuer is the "sole property" of the rescue, and has been surrendered as such by private owners or animal facilities that have signed a statement agreeing that the above mentioned animal is not owned property of any other person, firm or organization. Rescuer shall not be held liable, charged, or chargeable for any misrepresentations unknown to this Rescuer.
