Consultation: Photographer and Client have the option to have a free pre-wedding consultation (either in person meeting, phone call or via messenger/text/email) to finalize the shooting times, locations and Clients request list for specific photographs. Photographer requests Client to create a detailed schedule with all events taking place during the photography shooting time to ensure those events are photographed. If events do not take place for any reason, or the events take place outside the photography shooting time, Photographer will not be held liable for those photographs.
Party Cooperation: Photographer and Client agree to cheerfully cooperate and communicate for the best possible results within the definition of this assignment. Photographer is not responsible if key individuals fail to appear, fail to cooperate during photography shooting time, or failure to capture images due to details not revealed to Photographer. Client is responsible for, or has someone designated, to identify people of whom specific photographs are desired. Photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people and gathering people for group photographs.
Cooperation of Guests and Service Providers: Coordination with other service providers is necessary to complete all the photography as scheduled. Client should share the photography schedule with other service providers to make sure that there are no conflicts with times. Client is responsible for the conduct of their guests. Photographer will not tolerate verbally or physically abusive behavior, nor will Photographer share its time or compete with guest photographers for the attention of the subjects. Unchecked guest conduct that interferes with photography will seriously affect the quality of the photographs taken and increase the number of photos that must be recreated. If Client is unable to control the conduct of their guests or if the conduct or any other guests damages any of the equipment of Photographer, it will result in early or immediate departure of Photographer. Client will be invoiced for replacement fees for damaged equipment which varies by equipment value. Client understands that in such an event, no refund will be given.
Guest Photography: Client understands that the scheduled photography time is for the express use of Photographer to capture the wedding portraits. Because of time constraints and the need for subjects to give full attention to the professional photographer, guest photography cannot be permitted during the scheduled photography time until after Photographer has received the images needed. Guests are welcomed and encouraged to take photos at any other time throughout the event. Photographer is not responsible for damaged photographs due to guest photography, it is Clients responsibility to move and communicate with guest so they do not interfere with the scheduled photography time.
House Rules: Photographer is limited by the guidelines of the venue official or site management. Client agrees to accept the technical result of their imposition on the photographer. Negotiation with the officials and management for moderation of guidelines is Clients responsibility; Photographer will only offer technical suggestions/recommendations.
Privacy and Publicity Release: Client is responsible for any damages or fees resulting from a failure to obtain any privacy or publicity releases that are required by any vendor, venue or professional service.
Reschedule/Cancelation: If wedding date is rescheduled or canceled for any reason, including acts of God, fire and extreme weather or mass pandemics, the retainer will not be refunded. The retainer may be used towards a future event within one year of the original wedding date with both original members of the signed contract. If needing to reschedule more than one time, a new retainer fee will be required to reserve/book the new inquired date. It is also upon photographer’s availability and discretion. The non refundable retainer fee that was paid is not transferable to another client/client event/wedding. If wedding is cancelled, retainer fee paid is not transferable to another session. Client agrees to honor the prices listed for future event at the time of rescheduling. If client pays more than the deposit amount and cancels within 3 months of the scheduled event, Client shall be required to pay the full balance due. This covers the time spent meeting, any sessions, prep work as well as the loss of income.
Sickness/Emergency: If the scheduled photographer is unable to attend contracted event due to a sickness or emergency, another photographer with the same qualifications will be sent in replacement of the original scheduled photographer. The team at Photo Focus Photography has a long list of talented and qualified local photographers to work with.
Shooting time: The photography schedule is designed to accomplish the goals and wishes of Client in a manor enjoyed by all parties. Punctuality by all parties is essential. Shooting commences at the scheduled start time agreed by Client and Photographer. Should client request additional photography coverage or travel, it will be charged at the current rate of $350.00 per hour for coverage. Additional photography coverage will be invoiced and must be paid in full before Photographer releases any digitals, prints or products to Client.
Photographer Meals and Breaks: Client will be responsible for providing up to 1 meal for photographer(s) who work 8 or more hours.
Weather: If it is not possible for a session to take place during scheduled times due to weather, Photographer is not responsible for the lack of desired photographs. If in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of photos, Photographer may elect to use an alternate location or wait for weather to permit portrait shooting.
Fees: Wedding fee’s include any Pre-Wedding consultation meetings with Photographer, Wedding Photography Coverage, post processing images, shipping of digitals or products and photographers travel to and from location/s. If there are any costs or fees associated with the location/s Client has chosen, Client will be responsible for those fees. Photographer will not guarantee or arrange payment on any location (Parking, admission, permit etc.) The fees in this agreement are based on Photographer’s Standard Price List. The price list is adjusted periodically and is subject to change.
Payment: All major debit/credit cards are accepted as well as cash or personal checks. All personal checks or money orders should be made out to Photo Focus Photography. Returned or bad check fee is $50.00. Any debit/credit card payments will be charged a processing fee of 4% of any and every transaction made. The remaining balance is due no later than 10 days prior to your event date. Payments can be made early with no pre-payment penalties.
Post Processing: Photographer edits all images as necessary averaging 50 photos per hour booked. All images given to Client will be edited to the artistic taste of Photographer. Post processing only includes standard editing that naturally flatters subjects/photos; Blemishes, contrast, saturation, highlights and cropping are some examples of standard editing. If Client wishes extensive editing such as color selection, background change, face swap, removal of any person/thing, braces or any specific kind of edit, Photographer should be notified.
Creative License: Images are edited as the Photographers discretion, and delivered prints, digitals or products may not include all images shot. Photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within Photographers artistic standards. Wedding and event coverage can typically expect to see average of 50 photos per hour that the client has booked.
Print/Product: Client is aware that color dyes and inks in prints and products may fade or discolor over time due to the inherent qualities of dyes and inks. Client releases Photographer from any liability for claims whatsoever based upon the fading or discoloration due to the inherent qualities. Client is responsible for contacting photographer within 6 months of recievig their final gallery to order any print/products such as albums etc.
Damage: Photographer is not responsible for the damage of photos after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all photos upon receipt.
Right to Withdrawal: Photographers’ discovery of new information, changes, or other factors tending to circumvent its policies could result in its withdrawal. Non-cooperation; changes in locations, facilities or times available; missed appointments; bad or returned checks or late payments are examples of contributing factors. Should Photographer initiate the withdrawal, none of the fees and retainer already collected will be returned.
Injury Liability: Photographer is not responsible for any injuries inflicted upon any participating parties. Client will be responsible for their guests and for themselves and releases Photographer from any claims against their person or their business.
Limit of Liability: Photographer takes the utmost care with respect to the exposure, retouching and transportation of digital captured, prints, and products. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed beyond the Photographer’s control, Photographers liability is limited to the refund of all payments received. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that the Photographer is injured or becomes too ill to attend the wedding, Photographer will make every effort to secure a replacement photographer. If the situation should occur and suitable replacement is not found, responsibility and liability Is limited to the return of all payments received.
Limitation of Liability: The liability of either party to the other for any damages is limited to the amount of Photographers total fees under this agreement. The state of Wisconsin will govern this agreement and any disputes arising from it may be handled exclusively in the courts of Wisconsin. The prevailing party in any dispute will be entitled to recover reasonable costs and attorney fees.

We understand the difficulty and stress of planning a wedding during a global pandemic. We are here to help in any way that we can! If you have to reschedule your wedding date due to Covid, we will work with you to send over a list of available dates to reschedule your special day so that your retainer fee can transfer to your new date. If you select a date that we dont have available, the paid retainer fee is non-refundable. If you choose to cancel your wedding entirely, your retainer fee is non-refundable.
