  • STAFF TERMS & CONDITIONS (How we’d like it to work)

    Here, we aim to set out the terms on which we operate. There are some words that we use that have specific meanings and these definitions are set out below.

     

    THE PROCESS/APPLICATION PROCESS

     

    •¥• Apply using our application form or contact us by email or phone. In applying to Nest, you agree to allow us to share the data you provide with our clients and on social media.

    •¥• If your application is successful, we will ask you to submit a short video clip which we may send to our potential clients. In agreeing to our terms you are allowing Nest to share photographs, testimonials, profile, profile photo on advertising, social media platforms and website.

    •¥• We will provide you with details of potential work including dates, times, payment, location, type of business and any extra info we think is helpful to you. In the event you agree to a match, we ask you to hold dates while we confirm the details with the clients.

    •¥• Once confirmed we will let you know the arrangements. You will then enter a contract with the client for the performance of the Job in return for payment as agreed.

    •¥• We’ll deal with the client on your behalf, unless we ask you otherwise.

    •¥• Show Up.

    •¥• Please arrive 15 minutes before the notified time so you can find where you will be working and collect passes.

    •¥• Perform to the best of your ability! You are high quality people. Do well and you are likely to be offered repeat work.

    •¥• Go Home!

    •¥• You usually get paid weekly or fortnightly directly by the business you have worked for. You will not be on any sort of PAYE with Nest Agency and all payments happen directly through the business you have worked with.

     

    It’s that simple, but there are a just a few rules…

    1. No representation or other pre-contractual statement will have any legal effect unless (and solely to the extent that) it is repeated in these terms.

    2. No waiver of these terms will be valid unless agreed between us in writing.

    3. Neither party will have any liability for its failure to perform its obligations under these terms if and to the extent that this failure is caused by a reason beyond its reasonable control.

    4. Article 10 of Directive 2000/31/EC (European Commission) will not apply to these terms.

    5. For the avoidance of doubt, these terms are the terms of a contract whereby we provide you with access to our Service in return for a fee paid by the Client. Nothing in these terms will create any relationship of partnership, agency or employment between us. Upon accepting a job you will be entering into a contract with the Client as an independent contractor, not our employee or an employee of the Client. As an independent contractor you are responsible for your legal liabilities to the Client.

    6. You will indemnify us in respect of any tax, national insurance social security and any other similar liability which arises as a result of your employment. We are an agency finding you work and not employing you. It is your responsibility to organise your own taxes.

    7. By agreeing and signing up to Nest Agency you are agreeing to declare any criminal convictions.

    8. We do not accept peple who do not have a right to work in the U.K. By agreeding and signing up to Nest Agency you are agreeing you have a right to work in the United KIngdom and have the correct paper work to prove this.

    9. Unless otherwise agreed in advance, you are responsible for your own costs and expenses in performing work.

    10. If you are contacted by the client regarding future work, please notify Nest. If you accept work directly through the Client, we have the rights to terminate your contract and not offer future work.

    11. Breaks are taken with agreement of the client and at your discretion.

    12. Phones are not to be used when you are at a shift and are only to be used at the Managers discretion. If not done so we have the right to terminate your contract with Nest Agency.

    13. Flexibility is key, we are dealing with small businesses and pop ups. Their requirements change at the last minute. Please be flexible.

    14. Prior to any shift you are responsible in letting us know if you have any sort of allergies. 

    15. Incidents leading to staff injuries that may occur during the staffs shift are not Nest Agencies responsibility.

    14. Cancellation Policy-We ask for full commitment when confirming a shift. If you are to cancel a shift there will be a £15 cancellation fee.

     

    DEFINITIONS

    Staff means any person who uses our Service as a temporary staff member, applying to perform and performing Jobs for Clients as may be agreed;

    Client means any person who uses our Service as a client, contacting us to find temporary staff for Jobs. Job(s) means a job, in whole or in part, notified to us by a Client, with a view to it being performed by our Staff in return for payment;

    Service means services provided by us in matching Staff to Jobs and liaising between Staff and Clients in return for our fee. By signing up to Nest Agency and applying via our website, Facebook, Instagram, WhatsApp, phone call and interviewing with Nest Agency you agree to all of the above.
