Hunting Restrictions

I acknowledge that this application is for the non-exclusive privilege to hunt on Culver Brook Preserve East (the Property) owned by the Greater Culver Lake Watershed Conservation Foundation (GCLWCF), and is for the current hunting season only. If granted, permission to hunt shall be personal to me and may not be transferred, and will be limited to the Property and hunting seasons as indicated on the permit.

Rules and Regulations (General)

I acknowledge that if this non-exclusive privilege to hunt is granted it shall terminate automatically, without notice from the Greater Culver Lale Watershed Conservation Foundation, if I fail to abide by any of the following rules and regulations while on the property:
- Stay within property boundaries
- Be considerate of other visitors and adjoining property owners
- Keep pets leashed and clean up after them
- Do not remove or destroy plants or artifacts
- Do not litter, carry out what I carry in
- Remove any temporary stands or structures at the end of hunting season
- Comply with all applicable local, state, and federal laws and regulations, including all laws and regulations of the NJDEP and the New Jersey State Department of Health

Prohibited Activities

I agree to refrain from the following prohibited activities:
- Use of any type of motorized vehicle
- Use of radios or alcohol and/or illegal substances
- Camping, BBQs, or fires
- Trapping
- Dumping/littering
- Smoking
- Building of permanent hunting stands or structures of any kind
I agree that I will not take any action that will result in, or fail to take any action that will allow, the impairment or diminution of the Property.

Indemnity and Hold Harmless Clause

I acknowledge that GCLWCF assumes no responsibility or liability for my safety in the exercise of the privilege to hunt. I understand that I assume all such responsibility and liability. In consideration of the non-exclusive privilege granted, I hereby agree to release from liability, indemnify, defend and hold GCLWCF, its officers, directors, agents, employees harmless from and against any and all claims, damages, costs, expenses, fines, penalties, assessments, citations, and the like, of any kind whatsoever, public or private, including, but not limited to injury (including death) or damage to person or property, including but not limited to physical, emotional, or financial harm, arising from or out of negligence or willful action taken indirectly by me or by any activity performed or undertaken by me on any part of the Property.

Representation

I agree that if permission is granted to hunt on the Property, it shall not be interpreted as conferring upon me an exclusive right to use the Property. Other uses of the Property, including, but not limited to, wildlife watching, hiking, and other passive pursuits by the public may occur during hunting season and have equal right to use of the Property. I agree and understand that I have no right to interfere with other such uses or users of the Property. A permit to hunt does not in any way constitute that I am the agent, employee or legal representative of GCLWCF for any purpose whatsoever, and shall not be construed as creating a partnership or agency relationship between GCLWCF and myself.
