There will be 2 distances to participate in:

1. Port Albert Yacht Club to Robertson's Beach, return. This is approximately 7km return trip.
2. Port Albert Yacht Club to Robertson's Beach, with transport back to start location provided. (Approximately 3.5km).

Thank you for your interest in participating in Paddle the Port, 2024. Before you proceed we strongly recommend you to go through the following terms and conditions:

In this section, words like ‘holder’, ‘bearer’, and ‘purchaser’ will refer to you - the person who will buy the tickets to Paddle the Port, 2024.On the other hand, ‘our’, ‘us’,‘we’, ‘issuer’, ‘provider’ and similar terms will indicate the organisers of Paddle the Port, 2024.

By opting to purchase, allocate or possess tickets to Paddle the Port, 2024, you automatically agree to our terms of use. If you have problems with any of the clauses listed below or do not agree with the risk allocations mentioned here, please do not purchase tickets for Paddle the Port, 2024.

Please note that Port Albert Paddlers and Port Albert Yacht Club Inc reserves the right to make changes, revisions, and amendments and will communicate any changes to you via email and text.

The price of each entry to Paddle the Port, 2024 is $10. This figure is non-negotiable and will be payable in cash on the day of the event. The entry fee provides you insurance through the Port Albert Yacht Club Inc, whilst participating in the event and some delicious food and refreshments following the event.

The ticket you purchase represents a revocable license for you to access Paddle the Port, 2024 on Sunday April 7th, 2024, when the event is scheduled to be hosted. The license includes the revocable right to attending the Paddle the Port, 2024. 

This license can be revoked at any time by the issuer at its sole discretion, without any prior notifications or compensation options. If the license is revoked, you will not be granted entry at the venue.

If Paddle the Port, 2024 is cancelled in its entirety due to any unforeseen circumstances, Port Albert Paddlers inconjunction with the Port Albert Yacht Club Inc, has the sole and absolute right to:

1.    Reschedule the event.

Please note that the decision of the issuer in such cases will be deemed final and binding.

If Paddle the Port, 2024, is cancelled due to any factors or causes not in the control of the issuer will postpone the event, or provide a comparable ‘make good’ option. These factors will be inclusive of, but not limited to, inclement weather, natural disasters, federal/state announcements, strikes, delays in production, and the like. 

Once again, the decision of Port Albert Paddlers and the Port Albert Yacht Club Inc, will be considered final.

Paddle the Port, 2024 is a ‘rain or shine’ event. Any person participating in Paddle the Port, 2024, under the age of 18 must be supervised at all times during the event by an attendee over the age of 18. Port Albert Paddlers and the Port Albert Yacht Club Inc,  do not take any responsibility for any attendees, regardless of age.

By registering for Paddle the Port, 2024 tickets and presenting the same at the venue, you give your consent to Port Albert Paddlers and the Port Albert Yacht Club Inc, to collect certain information about yourself (name, age, address, etc.) for verification and storage.

You hereby agree to forego all types of surcharge claims - full or in part - and all claims & entitlements related to it.

Port Albert Paddlers and the Port Albert Yacht Club Inc, do not take any responsibility to personal/financial damages caused to you at the venue, or for any items lost/stolen/misplaced at the venue. Financial reimbursement claims on these counts will not be entertained.

Port Albert Paddlers and the Port Albert Yacht Club Inc, follow a common ‘zero-tolerance policy’ towards unauthorised drug usage or carrying at the venue, AND towards any type of behaviour/actions that can be interpreted as lewd or obscene. If you are found in possession of prohibited items at Paddle the Port, 2024 and/or if you indulge in any objectionable action, your participation in the event will be terminated immediately. Your event ticket(s) will become void from that point on.

Participant Waiver and Event Rules

The Paddle the Port, 2024, event team commits to providing you with a well-organised, fun and safe event.

Event: Paddle the Port, 2024 – Sunday April 7th 2024.

Event Organiser: Port Albert Paddlers inconjunction with the Port Albert Yacht Club Incorportated.

Here’s your part:

1. I understand and agree that my involvement in the Paddle the Port, 2024 is a potentially dangerous activity and I participate in the event at my own risk.

2. I will supply and wear a Personal Flotation Device (PFD) for the duration of the event.

2. I acknowledge the event involves physical exertion and accept that I am solely responsible for my own level of fitness and personal ability to participate in the event.

3. I represent and warrant that I am physically fit and that I have no medical condition that would prevent my full participation in the event.

4. I agree to consult with my medical practitioner prior to the event if I am in any doubt as to my fitness to participate in the event.

5. If required Port Albert Paddlers and the Port Albert Yacht Club Inc, will arrange medical or hospital treatment (including ambulance transportation) for me/us.I/we authorise such actions being taken by Port Albert Paddlers and the Port Albert Yacht Club Inc, where my further consent cannot be obtained and agree to meet all costs associated with such action.

6. I understand and agree that Port Albert Paddlers and the Port Albert Yacht Club Inc, will not be liable for any personal injury or death, property damage or any loss, damage, cost or expense that I may suffer or incur by participating in the event, to the extent permitted by law.

7. I agree to indemnify Port Albert Paddlers and the Port Albert Yacht Club Inc, from any claim, cost, demand, liability or damage incurred by Paddle the Port, 2024, arising out of or in connection with my participation in the event, to the extent permitted by law.

8. I agree to assume full responsibility for any risks, injuries or damages (known or unknown), property damage or loss of any kind, which I may incur as a result of participating in the event, to the extent permitted by law.

9. I agree for Port Albert Paddlers and the Port Albert Yacht Club Inc, to use my name, image and performance in the event, to promote the event (and any future versions of the Event) in any form of media, throughout the world, in perpetuity. I waive any right to royalties or compensation in relation to any such use.

10. I agree to follow the instructions provided by Port Albert Paddlers and the Port Albert Yacht Club Inc, and its authorised personnel at the event and at any other day when acting as part of the event.

11. I understand that the event is weather-dependent and Sunday April 7th been allocated as the event day and it is for Port Albert Paddlers and the Port Albert Yacht Club Inc, to decide if conditions are safe to run the event.

12. If the conditions for the event on the allocated date are not safe (temperature above 35 degree Celsius, winds above 12knots and/or thunderstorm), Port Albert Paddlers and the Port Albert Yacht Club Inc, reserves the right to cancel the event and/or modify the course/route of the event.

13. I agree that Port Albert Paddlers and the Port Albert Yacht Club Inc, has the right to withdraw my participation in the event if it is deemed reasonable and necessary in the circumstances.

14. If for any reason(s) the event has to be cancelled or postponed you will not be entitled to a refund of the entry fee or claim for any loss whatsoever.

15.Failure to comply with these event Terms will result in you being ineligible to take part in the event and your withdrawal from the event.

16. Port Albert Paddlers and the Port Albert Yacht Club Inc, reserves the right to amend these event Rules from time to time.

17. Any participant withdrawn from the event will not be entitled to a refund of the entry fee.

Port Albert Yacht Club Terms:

Terms: 1. In this membership declaration the term: "Club" means and includes the Port Albert Yacht Club Incorporated, its directors, officers, members, servants or agents. "Claim" means and includes any action, suit, proceeding, claim, demand, damage, cost or expense however arising including but not limited to negligence but does not include a claim in respect of any action, suit etc. made by any person entitled to compensation under a relevant Club insurance policy or under any right expressly conferred by the Club constitution or regulation. "Club Activities" means performing or participating in any capacity in any authorized or recognized Club event or activity.

2.The Club Constitution is a contract between me/us and the Club. I/we will be bound by it and any rules, by-Laws, regulations or policies made under it. I/we also agree to abide by the rules and policies of Australian Sailing (copies of which are available from Sailing Australia), and be subject to the jurisdiction of Australian Sailing in relation to the application and enforcement of such rules and policies.

3. Warning: Club Activities can be inherently dangerous. I/we acknowledge that I/we are exposed to certain risks during Club Activities including, but not limited to physical exertion and injury, bodily contact, falls, equipment failure and unpredictable weather conditions. I/we acknowledge that accidents can and often do happen which may result in me/us being injured or even killed, or my property being damaged. I/we have voluntarily read and understand this warning and accept and assume the inherent risks involved in participating in Club activities.

4.WARNING UNDER THE FAIR TRADING ACT1999 Under the provisions of the Fair-Trading Act 1999 several conditions are implied into contracts for the supply of certain goods and services. These conditions mean that the supplier named on this form is required to ensure that the recreational services it supplies to you are rendered with due care and skill; and as fit for the purpose for which they are commonly bought as it is reasonable to expect in the circumstances and reasonably fit for any particular purpose or might reasonably be expected to achieve any result you have made known to the supplier. Under section 32N of the Fair-Trading Act 1999, the supplier is entitled to ask you to agree that these
conditions do not apply to you. If you sign this form, you will be agreeing that your rights to sue the supplier under the Fair-Trading Act 1999 if you are killed or injured because the services were not rendered with due care and skill, or they were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in this form. NOTE: The change to your rights, as set out in this
form, does not apply if your death or injury is due to gross negligence on the supplier's part. "Gross negligence" is defined in the Fair Trading (Recreational Services) Regulations 2004. For the purpose of this Clause 4, "the Supplier" shall mean and include the Club.

5.Exclusion of Implied Terms: I/we acknowledge that where I/we are a consumer of recreational services, as defined by any relevant law, certain terms and rights usually implied into a contract for the supply of goods or services may be excluded. I/we acknowledge that these implied terms and rights and any liability of the Club flowing from them, are expressly excluded to the extent possible by law, by this membership declaration. To the extent of any liability arising, the liability of the Club will, at its discretion, be limited to the resupply of the services or payment of the cost of having the services supplied again.

6.Release and Indemnity: In consideration of the Club accepting my/our application for membership I/we, to the full extent permitted by law:-(a)release and will release the Club from all claims that I/we may have or may have had but for this release arising from any connection with my/our membership and/or participation in any Club Activity; and (b)indemnify and will keep indemnified the Club in respect of any Claim by any person arising as a result of any connection with my/our membership and/or participation in any Club Activity.

7. Fitness to Participate: I/we declare that I/we are medically and physically fit and able to participate in any Club activity. I/we will immediately notify the Club in writing of any change to my fitness and ability to participate. I/we understand and accept that the Club will continue to rely upon this declaration as evidence of my/our fitness to participate.

8.Consent to Medical Treatment: If required the Club will arrange medical or hospital treatment (including ambulance transportation) for me/us. I/we authorise such actions being taken by the Club where my further consent cannot be obtained and agree to meet all costs associated with such action.

9.Privacy: I/we understand that the information I/we have provided is necessary for the objects and operation of the Club. I/we acknowledge and agree that the information may be disclosed by my Club to Australian Sailing and will only be used for the objects of the Club, Australian Sailing and to provide me/us with membership services. I/we understand that I/we will be able to access my
information through the Club upon request. If the information requested on this application is not provided my application for membership may be rejected.

10.Severance: If any provision of this membership declaration is invalid or unenforceable in any jurisdiction, the phrase or clause is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable. If the phrase or clause cannot be so read down it will be severed to the extent of the invalidity or unenforceability. Such severance does not affect the remaining provisions of this membership declaration or affect the validity or enforceability of it in any other jurisdiction.

11. I/we agree to be bound by the policies of Australian Sailing as they are published from time to time on their website.

12. I/we acknowledge that it is my/our responsibility entirely to ensure my/our boat complies with the safety prescriptions of Australian Sailing and that any such safety equipment required under the safety category declared in this application is at all times in proper working order. I/we have read, understand, acknowledge and agree to the above declaration including the warning, exclusion of implied terms, release and indemnity. I/we warrant that all information provided is true and correct. I/we acknowledge that this membership declaration, once signed, cannot be amended. If I/we do amend it my/our application will be null and void.

Where the applicant is under 18 years of age this form must also be signed by the applicant's parent or legal guardian:

I am the parent or legal guardian of the applicant. I authorise and consent to the applicant undertaking the Club activities. In consideration of the applicant's membership of the Club being accepted, I expressly agree to accept in my capacity as parent or guardian, the terms set out in this membership declaration, including the provision by me of a release and indemnity in the terms set out above. In addition, I agree to be bound by and comply with the Club constitution and any by-laws, regulations or policies made under it.
