• I understand that offers of employment for certain job classifications are conditioned on passing a physical exam. If I receive an offer for one of those job classifications, I agree and consent to a physical examination by a physician chosen by the Company (at its expense) prior to beginning my employment.

• I understand and agree that the physical exam will include testing for the presence of illegal drugs, narcotics and controlled dangerous substances according to the Company’s Substance Abuse and Testing Policy, and that in the event of a confirmed positive result of same, my conditional offer of employment will be withdrawn, I will be denied employment and the hiring process will end.

• As a condition of employment and subject to applicable law, I agree to furnish information requested by the Company to verify my work history and information provided during the hiring process including, but not limited to, records of my past employment, education, driving, credit and felony and serious misdemeanor convictions.

• I understand that certain positions require the regular operation of motor vehicles requiring possession of a driver’s license, and/or heavy equipment which requires a specialized driver’s license. For such positions my employment is conditioned on possessing a state driver’s license of the required classification which is valid at the time of hire or assignment and continuously thereafter. Candidates who do not possess a driver license of the required classification which is valid in the state must be able to demonstrate their capacity to meet the transportation needs of the job at the time of interview.

• I understand that all job offers are conditioned on my timely providing legal proof of authorization to work in the U.S. in compliance with applicable law.

I further certify that I, the undersigned applicant, have personally completed this application. I further understand that any omission, misrepresentation or misstatement of material fact by me during the hiring process, or on this application or any document used to secure employment, shall be grounds for rejection of this application or for immediate dismissal if I am employed, regardless of the time elapsed before discovery. If hired, I agree to become familiar and comply with all Company policies and rules.

Background Check: I hereby authorize the Company to thoroughly investigate my references, work record, education, and other matters related to my suitability for employment and further authorize the references I have listed to disclose to the Company any and all letters, reports and other information related to my work records and this hiring decision, without giving me prior notice of such disclosure. In addition, I hereby release the Company, its employees and agents, my former employers and all other persons or entities providing information, from any and all claims, demands or liabilities arising out of or in any way related to such an investigation or disclosure of information.

ARBITRATION, JURY WAIVER: I understand and agree that as a condition of employment and for my application to be considered, the Company and I must agree to waive trial by jury and instead submit to a neutral, private arbitrator all legal disputes between us whenever and however arising, including in relation to the hiring process, and as provided in the Company’s Dispute Resolution Program (“Program”). I acknowledge that a copy of the Program is available for my review before signing below and that I may request a copy of the Program for my records. I show my agreement to the foregoing, the Program and final and binding arbitration by signing below and submitting my application.

“At Will" Employment: I agree that my employment at the Company is “at will” which means that either I or the Company can terminate the employment relationship at any time, with or without prior notice and for any reason not prohibited by applicable law. I also understand that all employment is continued on an “at will” basis, and that if I am employed, only a duly authorized Officer or the President of the Company has the authority to alter the “at will” relationship, provided the alteration is specific, in writing and signed.
