The Cleo Bailey Experiment Waiver & Release Form

The Undersigned has requested access to and/or is offering volunteer services at the premises located at 1003 E. Whitner St. Anderson, SC 29624 owned and operated by The EPSO HOUSE, LLC (the “SITE”) The Undersigned agrees and represents that he/she is aware that there are ongoing construction activities at the Site. The Undersigned further agrees and acknowledges that construction sites are inherently a dangerous environment, and that despite any precautions for safety which may be taken, there is still the possibility of serious accident, bodily injury, or damage to personal property which may occur during the course of work at the Site. In Consideration of being granted access to the Site, the Undersigned and/or their legal guardian has agreed to execute this Waiver of Liability and Release, and to be bound to there terms hereof.

WHEREFORE, the Undersigned for themselves, and their representatives, heirs, and assigns acknowledge and agree:

1. The Undersigned acknowledges that he/she fully understands that construction and other activities at the Site are dangerous and involve risk of serious injury, death and/or property damages.

2. To the fullest extent permitted by law, the Undersigned RELEASES, WAIVES and DISCHARGES and COVENANTS NOT TO SUE OR OTHERWISE MAKE A CLAIM FOR DAMAGES, the EPSO House, LLC, it’s owners, employees, affiliates, invitees, agents, or assigns.

3. The Undersigned ASSUMES FULL RESPONSIBLIITY FOR, AND RISK OF INJURY TO HIS/HER PERSON or damage to his/her property, whether caused by the negligence of the Releasees or otherwise, occurring during or as a result of the Undersigned’s presence at the Site.

4. To the fullest extent permitted by law, the Undersigned shall indemnify defend and hold harmless the EPSO House, LLC, it’s owners, employees, affiliates, invitees, agents, or assigns for any damages which may occur at the Site.

5. The Undersigned acknowledges that he/she has sole responsibility to evaluate carefully the risks inherent in accessing the Site and that he/she has fully considered those risks, including without limitation, dangers posed by willful or negligent conduct of himself/herself and/or by others.

6. The Undersigned acknowledges and voluntarily assumes full responsibility for, and full risk of, property damages or loss, or bodily mental or personal injury, including death relating to his/her presence at the Site.

7. Should any part of this waiver be deemed to be unenforceable, the remainder of this agreement shall be deemed to be in full force and effect as though the unenforceable provision was not including.

8. The undersigned agrees that this agreement shall be subject to and interpreted by the law of the State of South Carolina, and hereby agrees to be subject to the jurisdiction of a court of competent jurisdiction located at the same locale as the Site.
