      This document sets the limited warranty against Fetra metal post systems manufactured by WENTFORTH ASSOCIATES LTD. (COMPANY REGISTRATION NUMBER 09877671) (referred to in this Policy as ‘the Company’, ‘we’, ‘us’, or ‘our’). A person who has purchased a Fetra metal post system will be referred to in this document as ‘you’ or ‘your’.

      1          PRODUCTS COVERED BY THIS WARRANTY

      The following Fetra metal post systems manufactured by us (Approved Models) are covered by this warranty:

      •  Fetra Intermediate Posts

      2          WHAT THE WARRANTY COVERS

      This warranty applies to any Approved Models for forty (40) years from the date you purchase an Approved Model and covers parts required to remedy any defects in an Approved Model.

      The warranty only applies to mechanical failure of the Approved Models due to corrosion. The term ‘mechanical failure’ refers to failure under normal conditions and does not include distortion or breakage due to other forces or any external factors.

                  The warranty specifically excludes the following:

      •           Any use for which the metal post systems are not designed

      •           Mechanical damage

      •           Plastic parts, such as post caps and insulators

      •           Dismantled/re-erected components

      •           Surface corrosion

      •           Marine environments

      •           Extreme forces

      •           Components that have been cut/drilled/notched etc., effected by the customer in the course of installation of the Approved Products (and does not include any cuts or notches effected in the course of manufacturing of the Approved Products)

       

      3          HOW TO MAKE A CLAIM UNDER THIS WARRANTY

      3.1       MAKING A CLAIM

      If, within forty (40) years of the purchase date, you believe that an Approved Model you purchased is faulty, please contact us by sending an email to info@fetrafence.com with the following information and documents:

      •        proof of purchase

      •        date of installation

      •        full details of the fault along with photographs

      •        list of failed products and quantities.

      If required, the Approved Models may need to be collected by or returned to us to enable use undertake further inspection and ascertain the validity of the claim. If we determine, in our absolute discretion:

      (a)        that the claim is validated and covered by this warranty, we will provide you either with a replacement or with refund as per the below sliding scale:

      Sliding scale for refunds:

      •        Up to 10 years – 100%

      •        11 to 20 years – 75%

      •        21 to 30 years – 50%

      •        31 to 40 years – 25%

      (b)        that the relevant Approved Model is not faulty, or is faulty due to lack of maintenance, fair wear and tear, misuse, failure to use in accordance with the manufacturer’s instructions, or failure to take reasonable care, we will refuse your warranty claim.

      3.2       EXPENSES

      The Company’s liability will be limited only to replacement of refund (as per clause 3.1(a) above) of the Approved Product and the Company. The Company may cover or reimburse you for shipment of the Approved Products, depending on the Company’s policy regarding the shipment costs, as may be in force at the time of such warranty being claimed. 

      4          NO OTHER WARRANTIES

      To the maximum extent permitted by applicable law, all express or implied representations and warranties not expressly stated in this warranty document, or in written terms and conditions issued by us, are excluded.

      5          CONSUMER LAW DISCLAIMER

      Our products come with guarantees that cannot be excluded under the UK Consumer Law. This warranty is in addition to your rights under the UK Consumer Law.

      6          LIABILITY

      To the maximum extent permitted by law, we exclude any liability that may arise as a result of you pursuing a warranty claim in accordance with this warranty document.

      7          JURISDICTION

      This warranty document is governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this warranty document or its subject matter or formation.
