Applicant agrees to maintain flags to mark outer limits of the area to be treated. Flags must be in place April 28th until October 31st. Failure to do this could result in the area being bladed to which you expressly waive any claim against the County or Advanced for any damage resulting therefrom. If the area is not marked, drivers will either center on your house or use their best judgment for location.
Advanced will use a walk behind roller device to layout property. If your flags are set longer than the footage paid for, your dust control will not reach both flags. If your flags are set shorter than the footage paid for, your dust control will extend past your flags.
The county reserves the right to blade the treated area to maintain public safety. Your road will be bladed after October 1st.
Disclaimer of warranties: There are no representations or warranties given by Advanced as to the dust control chemical used or Advanced's application of it beyond the terms in this document. Advanced disclaims any implied warranty for the product used and Advanced's application of it including warranties of fitness and merchantability, to which you agree. Advanced does not warrant the performance of the product due to factors such as weather, surface preparation, gravel materials, heavy traffic patterns and maintenance of the roadway.
Customer acknowledges that in doing the application that Advanced is not an agent of the County and the County is in now way liable for damage caused by the actions or omissions of Advanced or the chemical Advanced applies.
The Terms herein cannot be amended except by a signed writing of Advanced Situation Mitigations amending of these terms.
