SUMMARY OF CONTRACTOR RULES
Construction on Harbor Island is subject to a number of rules as stated in the HIOA Covenants and Architectural Rules and RegulationsACC Rules and Regulations as well as State and County regulations. Due to the high density of existing homes, small lots with defined footprints, tight turning and limited parking, absolute effort should be made to prevent disturbance to neighboring properties, rookeries and wildlife. Failure to do so may result in fines and work stoppage. A $4,500 performance bond is required from both the contractor and owner. As stated, this list is a summary of contractor rules. The owner and contractor are still required to abide by all of the Harbor Island Owner’s Association Architectural Control Committee rules.
1. Construction must commence within twelve (12) months of ACC approval. Once a
Beaufort County building permit has been issued all construction, painting and landscaping must be completed within twelve (12) months from the permit date.
2. Approval by the ACC indicates approval by HIOA and the ACC only. It is the responsibility of the owner or contractor to obtain the necessary permits, approvals, inspections, etc. from the appropriate agency, including but not limited to, the State of South Carolina, Beaufort County, Coastal Council, DHEC and others, and to comply with the regulations of any controlling agency
3. Any cutting, trimming or removal of plants, shrubs or trees along the canals and lagoons must have the prior approval of the ACC; and any such cutting, trimming or removal must be accomplished under the supervision of a representative of the ACC.
4. Drainage for each individual lot is intended to be directed to the front of the lot and/or the rear of the lot. Any side lot orientation of drainage must be directed to the front and/or rear of the lot by down spouts or other directional means. No run-off from an individual lot may be directed across or onto an adjacent lot.
5. A Port-A-John or its equivalent must be provided at each building site for the use of construction crews and personnel. This item must be a minimum of 15 feet off of the road. It needs to be placed away from occupied residences to the greatest extent it can be, and preferably near the rear of the lot. This should not be placed in HIOA's 15-foot roadside easement.
6. Silt fencing must be installed around the lot until construction is completed. One
side may be left open for material delivery, preferably on the driveway side. The
fencing must be maintained on a daily basis.
7. Provision must be made for installation and maintenance of crusher-run or its equivalent beginning at the roadway, for the full with of the driveway, as shown on the plans and extending into the lot for a minimum of twelve (12) feet to protect road edges from damage by construction traffic.
8. During construction, the owner shall require the contractors to maintain the lot and surrounding areas in a reasonably clean and uncluttered condition and to the extent possible, all excess construction material, trash and debris will be kept within refuse containers or transported off premises on a daily basis. Dumpsters must be covered at the end of each work day or if windy conditions prevail and should not contain food waste. The Port-a- John, dumpster and building material should be placed on the building site and not on adjacent property unless authorized in writing.

11. Parking may be restricted in or around a jobsite. Every attempt should be made to have vehicles parked on the job site lot or other parking areas provided for auto parking.
It is the expectation of the ACC that every aspect of the new construction is the responsibility of the general contractor, from site preparation to landscaping. Additionally, once a building plan is approved, the exterior shall be built as submitted. This includes color selections, driveway size and placement and landscaping. Any requested changes should be re-submitted to the ACC for approval.
