RULES & REGULATIONS
Earth Day Jam is an Earth Day celebration and fundraiser for Happy Roots. The event will take place Saturday, April 12th, 2025 (11:00AM-10:00PM).
Each vendor shall comply with the following Rules & Regulations, in addition to complying with any and all statutes and ordinances of Bell Tower Green Park, City of Salisbury, and the State of North Carolina.
Happy Roots and Earth Day Jam staff shall have the right to interpret the following Rules & Regulations as in its discretion it might deem appropriate and to enforce compliance with such Rules & Regulations. Any violation of these Rules & Regulations or of any statute or ordinance shall result in immediate forfeiture of all rights and participation in the festival and the forfeiture of any monies deposited to secure participation in the festival.
1. Cancellation and Refunds: As stated on the application, no refunds will be made for vendor cancellation or for violation of the Rules & Regulations. The event is rain or shine.
2. Hours of Daily Operation: Saturday, April 12th, 2025 (11:00AM-10:00PM).
3. Vendor Categories: The following are descriptions of the booth categories available at the festival…
A. Nonprofit/Educational/Informational: For use of distributing information. Any non-profit vendors wanting to distribute edible samples (salsas, jams, dips, etc.) must obtain a food permit from the Rowan County Environmental Health Department.
B. Commercial: For use of selling or displaying products or services. Any items to be sold must be listed on the application. Commercial booths are NOT permitted to sell food and/or drinks, except for pre-packaged mixes that are not consumed at time of purchase. Any commercial vendors wanting to distribute edible samples (salsa, jams, dips, etc.) must obtain a food permit from the Rowan County Environment Health Department.
C. Food: To be used for selling food and/or drink items. Happy Roots reserves for itself the exclusive sale of alcoholic beverages. THE VENDOR IS RESPONSIBLE FOR OBTAINING AND PURCHASING A TEMPORARY FOOD PERMIT FROM THE ROWAN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT PRIOR TO THE FESTIVAL. NO STYROFOAM or single use plastic bottles allowed. Vendors selling or sampling food or beverages are required to use recyclable or biodegradable/compostable serviceware.
4) Definition of Booth Space: Booth spaces measure 10’x10’ in the designated area, and will be assigned by Happy Roots staff. Happy Roots reserves the right to remove a booth from the festival area should the booth be constructed in an unsafe manner, or if the booth goes against the Rules & Regulations.
5) Vendor Set-Up & Take Down:
A) Check-in: The festival grounds will be open for load-in by 8:00am Saturday, April 12th, 2025; check in will be at W. Innes Street. More details with a map will be released upon approval.
B) TENTS/TABLES/CHAIRS/POWER: All vendors are responsible for providing their own tents, tables, and chairs. Each vendor space will be 10ft x 10f. Please contact Happy Roots to request larger spaces. We are unable to provide power access to all vendors. PLEASE MAKE SURE YOU HAVE SANDBAGS OR WEIGHTED TIE-DOWNS FOR YOUR TENT.
C) Vendors MUST BE COMPLETELY set up, as well as cars removed, from vending area by 10:00 am Saturday, April 12th, 2025 and must be completely removed from the property by 12:00 am that night.
D) Security will only be provided to preserve order during festival hours. Happy Roots is not responsible for damage to any person during the show or for any damaged, lost, or stolen items. It is recommended that your booth be staffed and in operation for the entire scheduled hours of the festival.
E) Vehicle Parking: No vehicles will be allowed in the festival area during event hours. Vendor load in will be from 8:00AM-10:00AM Saturday morning. Load out will be permitted beginning at 9PM Saturday night. Vendors loading out earlier will not be able pull vehicles up to their booth. Vehicles are not allowed to park in front of barricades or in front of gates. In case of emergency, we need the accesses to be clear. Failure to comply with this rule will result in your booth removal and your vehicle will be towed.
6) Food Vendors: No open fires are permitted at any time. It is the responsibility of each food vendor to obtain permit from the Rowan County Health Department, remove all food wastes, used cooking oil and/or grease from the festival premises. No Styrofoam will be permitted at this event. No single use plastic or non-recyclable plastic will be permitted.
7) Sales Tax: It is the responsibility of all vendors to pay their own sales tax to the State of North Carolina.
8) Prohibited items: No merchandise shall be sold, used or given away that are obscene, dangerous, or unlawful. Prohibited items include, but are not limited to, the following: alcoholic beverages, guns, fake guns, explosive devices, fireworks, etc.
9) Sound restrictions: Please be considerate of the bands, artists and other performers scheduled as part of the festival, as well as your fellow exhibitors and festival attendees.
HAPPY ROOTS RESERVES THE RIGHT TO ACCEPT OR REJECT ANY APPLICATION. VIOLATION OF ANY OF THE ABOVE RULES & REGULATIONS COULD RESULT IN IMMEDIATE EVICTION FROM YOUR OCCUPIED BOOTH SPACE. NO REFUNDS WILL BE GIVEN TO ANY EVICTED VENDORS.
