Please note: Tents, tent weights, tables, chairs, and display items are not provided by Great Parks of Hamilton County and are the sole responsibility of the exhibitor unless prior arrangements have been made with the Event Organizers.
Great Parks Exhibitor Agreement
I. Exhibitor Requirements
1. Hours of Operation:
a. It is mandatory that Exhibitors are fully operational during the event hours listed. Late arrivals and early departures will not be permitted.
b. Exhibitors are expected to arrive at the event no later than one hour prior to opening and to be completely set up and ready for guests no later than 15 minutes prior to opening.
2. Assigned Space:
a. Exhibitor’s use of the assigned space at this event is non-transferable. Exhibitor may not share the space with another Exhibitor without the consent of Great Parks.
b. Exhibitor’s booth must have an attractive, professional, and maintained appearance.
c. All tents and displays must fit within Exhibitor’s designated space. Displays may not encroach onto public walkways or into another Exhibitor’s space.
d. All tents must be weighted with a minimum of 100 lbs. to secure against wind gusts. All standing displays must be secured against the wind.
3. Cancellation Policy:
a. Exhibitor must notify Great Parks of cancellation no later than 48 hours prior to the start of the event.
b. Exhibitors who fail to notify Great Parks of a cancellation prior to the event (“No-Show”) may be excluded from participation in future Great Parks events.
4. Electricity: There will be no electricity available at this event, unless stated otherwise by the Director of Events or Events Coordinator.
5. Weather Policy: The scheduled event will operate rain or shine. Great Parks will make the determination to cancel the event if the weather is deemed unsafe. There will be no refunds issued.
5. Merchandise: Only the sale of merchandise listed on the Exhibitor application is permitted at this event. Great Parks reserves the right to ask the Exhibitor to remove any merchandise that is not listed on the application or is deemed inappropriate for sale.
6. Sale of Beverages: The sale of beverages (soda, water, juice, coffee, tea, cider, cocoa, alcohol) is not permitted during this event as Great Parks will be selling these items onsite.
7. Trash: All trash must be removed from booth space prior to departure from the event. Trash receptacles are placed throughout the event area for use. Exhibitor is responsible for removing excessive trash that does not fit in these receptacles. Failure to comply will result in a trash removal fee billed to the Exhibitor at a cost of $100.00.
8. Media Release: By signing this agreement, I hereby give consent to all photographs, audio recordings, and video recordings taken of me and my staff. I understand that any such photographs, audio, and video recordings become the property of Great Parks and may be used by the organization for promotional purposes in broadcast and media formats now existing or created in the future.
9. Advertising
a. Great Parks will advertise the event through a variety of platforms, including, but not limited to print and social media platforms.
b. Exhibitors are encouraged to promote this event through his/her own social media platforms.
10. Music: No amplified music is permitted within the Exhibitor space. Amplified music is defined as any music that can be heard more than 10 ft. from its source.
11. Courtesy: Exhibitor must be courteous to customers and other Exhibitors at the event. Derogatory language and inappropriate behavior will not be tolerated.
12. Smoking: Smoking, including the use of e-cigarettes or vape pens, is not permitted within the event space.
II. Terms & Conditions
A. Anti-Discrimination
The Exhibitor agrees that it will not discriminate against any person on the basis of race, color, religion, national origin, sex, disability, military status, sexual orientation, gender identification, or other protected characteristic under Title VII in hiring persons to perform the services under this agreement.
The Exhibitor further agrees that it will not exclude any person from participating in, or deny anyone any benefits of Great Parks’ facilities, or otherwise subject any person to discrimination based on the above-listed protected characteristics while on Great Parks’ property or while performing services for Great Parks.
B. Safety of Persons and Property
The Exhibitor shall be responsible for initiating, maintaining, and supervising all safety precautions and programs in connection with the performance of this agreement. The selected Exhibitor assumes all risk of loss or damage to Exhibitor’s property. Great Parks is not responsible for any property that is lost, stolen, or damages. With respect to all Work performed, the Exhibitor shall:
1. Comply with the requirements of the Occupational Safety and Health Act of 1970 (Public Law 91-596) and the requirements of Title 29 of the Code of Federal Regulations, Paragraph 1518, as published in the "Federal Register" Vol. 36. N.75 Saturday, April 17, 1971, and as amended from time to time.
2. Exercise every precaution at all times for the prevention of accidents and the protection of persons (including employees) and property.
3. Maintain at its office and in delivery vehicles all articles necessary for giving first aid to the injured and shall make standing arrangements for the immediate removal to a hospital or doctor's care of persons (including employees) who may be injured at the delivery site.
4. Comply with and give notices required by applicable laws, statutes, ordinances, codes, rules and regulations, and lawful orders of public authorities bearing on the safety of persons or property or their protection from damage, injury, or loss.
5. When the use of storage of explosives or other hazardous material or equipment or unusual methods is necessary for the execution of the Work, the Exhibitor shall exercise the utmost care and carry on such activities under the supervision of properly qualified personnel.
6. Promptly remedy damage and loss (other than damage or loss insured under property insurance required by the contract) to property caused in whole or in part by the Exhibitor or anyone directly or indirectly employed by any of them or by anyone for whose acts they may be liable and for which the Exhibitor is, except damage or loss attributable to acts or omissions of the Great Parks or anyone directly or indirectly employed by them, or anyone for whose actions may be liable, and not attributable to the fault or negligence of the Exhibitor. The foregoing obligations of the Exhibitor are in addition to the Exhibitor's obligations for Indemnification.
7. Designate a responsible member of the Exhibitor's organization at the site whose duty shall be the prevention of accidents.
C. Liability Insurance Requirements
Exhibitor shall obtain and maintain insurance coverage as indicated below and shall list Great Parks as an additional insurance on such policies, using the following address:

Insurance coverage shall not be less than the following:
1. Comprehensive General Liability (including Completed Operations, Blanket Contractual, Independent Contractors, and Personal Injury):
a. Bodily Injury $1,000,000 Each Occurrence; $2,000,000 Aggregate
b. Property Damage $1,000,000 Each Occurrence; $1,000,000 Aggregate
2. Automobile Liability (including Owner, Non-owned and Hired):
a. Bodily Injury $1,000,000 Each Occurrence; $1,000,000 Aggregate
b. Property Damage $250,000 Each Occurrence; $250,000 Aggregate
D. Indemnification
To the fullest extent permitted by law, the Exhibitor shall indemnify and hold harmless, Great Parks, Great Parks’ consultants, agents, vendors and employees of any of them from and against claims, damages, losses and expenses, including but not limited to attorneys’ fees, arising out of or resulting from performance of this agreement, provided that such claim, damage, loss or expense is attributable to bodily injury, sickness, disease or death, or to injury to or destruction of tangible property, but only to the extent caused by the negligent, intentional, reckless acts or omissions of the Supplier, anyone directly or indirectly employed by them or anyone for whose acts they may be liable. Such obligation shall not be construed to negate, abridge, or reduce other rights or obligations of indemnity which would otherwise exist as to a party or person described in this section.
In any and all claims against the Exhibitor or Great Parks, the indemnification obligations under this section shall not be limited in any way by any limitation on the amount or type of damage compensation or benefits payable under workers’ compensation acts, disability benefits or other employee benefit acts. As between Great Parks and Exhibitor, Exhibitor expressly waives its immunities under Ohio Revised Code Chapter 4123 or any similar worker compensation statutory immunity for purposes of conforming the indemnity obligations of Supplier.
