    1. Introduction | 簡介

    In accordance with the school vision of Mighty Oaks International Nursery & Kindergarten Limited ("Mighty Oaks") to better the community, Mighty Oaks and House of Blessings Foundation Limited (HBF) offer a full scholarship to children in need so that they can attend a high-quality, private international playgroup, nursery and kindergarten that best meet their needs, regardless of their guardians' ability to pay or where they live. The mission of the scholarship scheme is to touch the lives of children and families through an academically-rigorous playgroup, nursery and kindergarten experience and make a positive difference in their future. It also empowers families with the information and training workshops they need to provide the best home environment for their children. Acorn Playgroup will be held at both Kennedy Town and Wong Chuk Hang Location.Certain classes at Acorn Playhouse will also be included. A limited number of scholarships are available each school year which are granted to 2 eligible candidates per year based on need and eligibility criteria as further described below. Scholarships are not granted on the basis of academic prowess or race.

    遵照本校希望對社區作出貢獻的願景，奧恩國際幼兒園暨幼稚園（以下簡稱“奧恩”）與歡樂之家基金有限公司（以下簡稱“歡樂之家”）提供獎學金計劃給予有需要的兒童，無論其監護人的經濟支付能力或居住地點，此計劃讓他們有機會參與我們為其量身打造的高品質的私立國際親子班、幼兒園及幼稚園的教育。其使命是讓符合此計劃的家庭及其子女透過本校提供的親子班、幼兒園及幼稚園體驗，對他們的未來產生正面的影響，家長透過奧恩親子天地的資訊和培訓工作坊提升自我，從而提供最好的家庭教育環境給子女們。奧恩親子班於堅尼地城及黃竹坑舉行。部分課程亦會於 Acorn Playhouse 舉行。 獎學金的名額有限，將每年發放予符合以下申請資格並合格的兩位候選人。授予的標準不建基於學業成績或種族或國籍背景。

    2. Grant Conditions | 獎學金條款

    Successful applicants and their parents or guardians are expected to join and participate in activities and community services organized by the Mighty Oaks Club, and attend student-related school activities as a requirement of the grant, as family involvement has been shown to have a positive impact on students’ performance. Successful applicants are required to maintain satisfactory school attendance, pass all subjects, not to display any immoral behaviour, and are expected to share the same values and life-long learning goals as Mighty Oaks International Nursery and Kindergarten even upon graduation. If chosen, other eligible siblings’ applications within a single household will be not be affected. Details of the grant requirements are set out in the attached terms and conditions.

    家庭的參與能積極影響學生的表現，獎學金獲批者和他們的父母/監護人需參與由“奧恩親子天地”舉辦的活動和社區服務，出席與學生相關的學校活動。並保持良好的出席率，通過所有科目評估，且沒有做出任何不道德的行為，本校預期申請人畢業後繼續遵守本校的有做出任何不道德的行為，本校預期申請人畢業後繼續遵守本校的讀資格的子女之獎學金申請將不受影響。獎學金申請要求的詳情載於所附的條款和條件。

    3. Eligibility and Grant Criteria | 申請資格與標準

    In order to be eligible for a scholarship, the following criteria
    must be met:

    • 3.1 The Applicant must be a Hong Kong resident;
    • 3.2 The Applicant will be at an appropriate age at the intended time of enrolment at Mighty Oaks, being 6 months - 36 months for a playgroup applicant, 2-3 years old for a pre-nursery applicant, or 2 years 8 months or older for a kindergarten applicant;
    • 3.3 The Applicant (including a parent or guardian on Applicant's behalf) is not concurrently in receipt of any other scholarship(s) except for prizes or awards;
    • 3.4 The Applicant will be attending only Mighty Oaks and will not be attending other kindergarten programs.
    • 3.5 The Applicant's household has a combined monthly income before government interventions at or below the income limit under the Work Family Allowance scheme. (https://www.wfsfaa.gov.hk/wfao/en/assets.htm)
    • 3.6 The Applicant's guardian's mission and vision align with the mission and vision of Mighty Oaks;
    • 3.7 The Applicant's guardian(s) display a commitment to the Applicant's future and providing a healthy home life for Applicant.

    The grant of Scholarships will also be based on the above criteria and the information provided within the application.

    Grant criteria may be changed by Mighty Oaks and HBF if deemed appropriate from time to time.

    獎學金申請者必須滿足下列條件：

    • 3.1 申請人必須是香港居民；
    • 3.2申請人入學時需符合“奧恩”預期的年齡：親子遊戲班為6個月-36個月，幼兒園為2-3歲，幼稚園為2歲8個月或以上；
    • 3.3 申請人（包括代表申請人的父母或監護人）不能同時接收除了獎品或獎項的任何其他獎學金；
    • 3.4 申請人必須只就讀奧恩幼稚園，不能同時就讀其他幼稚園的上/下午班。
    • 3.5 在政府介入之前，申請人家庭的月總收入等於或低於“ 在職家庭津貼辦事處”的入息及資產限額。最新資料，請到:https://www.wfsfaa.gov.hk/wfao/tc/assets.htm 

     

    • 3.6    申請人的監護人必須認同奧恩的使命和願景；

    • 3.7    申請人的監護人需對申請人的未來作出承諾，並為申請人提供一個健康快樂的家庭環境。

    獎學金的獎勵將以上述標準和申請程序內提供的資料為評審根據。奧恩及歡樂之家保留改變或微調申請資格與標準的權利。

    4. Proof of Eligibility | 符合申請資格之證明

    In order to validate the combined household income, guardians must provide copies of their most recently filed income tax return, salary receipt and such other information as Mighty Oaks and HBF may reasonably require.

    Eligibility is determined by confirmation of information provided and by submitting all information by the deadline.

    為證實申請者之家庭合併收入條件符合申請資格，申請者的監護人須提供其最近提交所得報稅表、薪金收據及其他相關所需文件或奧恩/歡樂之家可能合理要求的資料。

    符合申請資格將在我方正式收到申請人於截止日期前提交的所有資料後正式確認。

    5. Application and Selection Procedure | 申請及遴選程序

    • Completed application forms for playgroup with supporting documents should be submitted to HBF when the child is 4 months or older. Seperately,  submit the school application forms to Mighty Oaks before application deadlines. 
    • HBF shall conduct preliminary screening and interview shortlisted candidates on the basis of the Selection Criteria. 
    • Mighty Oaks shall forward their nominations to HBF.
    • HBF's Committee will conduct a further interview and shortlist candidates on the basis of the Selection Criteria.
    • A home visit by Mighty Oaks and/or HBF will be arranged for the final candidates to further shortlisting on the basis of Selection Criteria.
    • 2 beneficiaries will be selected from the shortlisted eligible applicants by a random drawing.
    • Mighty Oaks International Nursery and Kindergarten shall notify guardians of the outcome of their application.
    • 5.1 時，當申請人的年齡 4 個月或以上時，應向歡樂之家遞交填妥的親子遊戲班申請文件及相關輔助材料。 另外，請在申請截止日期前向 Mighty Oaks 提交學校申請表。
    • 5.2 歡樂之家將初步篩選入圍名單，並依據選擇標準面試入圍人選。
    • 5.3 奧恩將向歡樂之家提交第一輪面試後的入圍人選。
    • 5.4 歡樂之家的委員會將按選擇標準進行下一步的面試，選出第二輪入圍人選。
    • 5.5 奧恩和/或歡樂之家將安排家庭探訪，並依據選擇標準選出合資格的人選。
    • 5.6 所有符合資格的人選將透過隨機抽取選出最終的兩名人選。
    • 5.7 奧恩將會通知申請人的監護人其申請結果。

    6. Process of Scholarship | 獎學金發放方式

    2 scholarships will be offered each academic year. The scholarships will commence on the first month of the academic year (subject to change according to Mighty Oaks' updated school calendar) to end of the academic year (unless there is a termination in accordance with the terms). Each scholarship will have a total value equivalent to:

    每學年將有兩個獎學金名額。獎學金於每學年入學第一個月開始發 放（根據奧恩最終版的行事曆而調整）直至學年終結（除非違反有關 條款而導致獎學金的終止）。每一個獎學金的總值相等於：

    6.1 Full school fees applicable for half-day school (subject to change according to Mighty Oaks’ curriculum), as determined in each academic year by Mighty Oaks.

    6.2 Expenses including without limitation camps and afterschool program organised by school body, books, registration, transportation (if any), snacks, uniforms, testing and other miscellaneous fees like outings. Once the scholarship is granted, the beneficiaries of the scholarship will send all invoices or receipts to HBF, then HBF shall directly reimburse both school fees and expenses to Mighty Oaks  (subject to approval).


    6.1 學生在奧恩每學年的半日制全額學費（根據奧恩每學年的課程安排而調整）。


    6.2 開支包括但不限於學校的假日營/下午營、書本費、註冊費、交通費（如適用）、校服、檢查及其他雜費，例如學校戶外參觀及旅行等。獲批者會發送任何學費單和收據直接交予歡樂之家, 然後歡樂之家將把獎學金獲批者的學費及其他開支直接交予奧恩（須經批准）。

    7. Renewal | 獎學金續領

    7.1   The scholarship is renewed annually subject to continuing satisfaction of the eligibility criteria and grant conditions, as well as the applicant’s character development, etc.
    7.1   獎學金續領將依據每學年成功申請者的表現，評估申請人是否仍符合獎學金申請資格與標準，如申請人的條件及品格發展等 均符合，便可續領。

    Aside from disclosure to Related Parties as described above, the Personal Data will not be disclosed by Mighty Oaks or HBF to any other party in a form that would identify you unless disclosure is necessary by law. This includes, without limitation to, the Ordinance, legal obligations or requirements required by any competent court of law, a court order or a request from law enforcement agency or regulatory authorities, institutions or organizations (whether within or outside Hong Kong).

  • 2. Direct Marketing Consent | 推廣用途資料使用許可

  • SCHOLARSHIP TERMS AND CONDITIONS 獎學金條款及條件

  • 1. INTERPRETATION | 釋義

    1.1     In this Agreement, unless the contrary intention appears:

    a.     "Applicant" means the applicant whose details are provided in the Application Form.

    b.     "Application Form" means the application form in part B, provided with these Terms and Conditions and the Information Schedule, and completed by the Guardian on behalf of the Applicant.

    c.      "Eligibility Criteria" means the eligibility and grant criteria specified in section 3 of the Information Schedule.

    d.     "Guardian" means the signatory or signatories of the declaration contained within the Application Form, being parent(s) or guardian(s) of the Applicant, and whose details are also provided in the Application Form.

    e.     "HBF" means House of Blessings Foundation Limited.

    f.      "Information Schedule" means the information schedule in part B, prvided with these Terms and Conditions and the Application Form.

    g.     "Mighty Oaks" means Mighty Oaks International Nursery & Kindergarten Limited.

    h.     "Party" means each of Guardian, HBF and Mighty Oaks, together being the "Parties".

    i.       "Scholarship" means a scholarship offered by HBF and Mighty Oaks under the terms of this Agreement.

    j.       "School" includes playgroup, nursery and kindergarten at Mighty Oaks International Nursery and Kindergarten and Acorn Playhouse.

     

    1.2     In this Agreement, unless the contrary intention appears:

    a.     words importing the singular will include the plural (and vice versa);

    b.     headings are for convenience only and shall not affect interpretation;

    c.      a reference to any document, agreement or statute is a reference to such document, agreement or statute as amended extended re-enacted or replaced from time to time;

    d.     Clauses 3 and 4 of this Agreement will take effect only if the Applicant is offered a Scholarship.

    1.1    在本協議中，除非表明相反之意向：

    a.   “申請人”是指於申請表中提供個人資料的申請者；

    b.   “申請表”是指在B部分提供的、獎學金計劃中的條款/條件及申請流程，並由申請人之監護人代為簽署的申請表；

    c.    “申請資格與標準”是指在申請流程之第四章節中詳述的申請資格和獎學金遴選標準；

    d.    “監護人”是指於申請表及申請表內聲明為父母或申請人的監護人之簽署，而其詳細資料也已在申請表內提供；

    e.   “歡樂之家”是指歡樂之家基金有限公司；

    f.    “申請流程”是指在B部分的申請流程、相關條款/條件以及申請表；

    g.   “奧恩”是指 Mighty Oaks International Nursery & Kindergarten Limited;

    h.   “締約方”是指每個申請人之監護人，歡樂之家和奧恩，互為“雙方”;

    i.     “獎學金”指歡樂之家及奧恩提供，並符合本協議中的條款及條件之獎學金 ;

    j.     “學校”包括奧恩親子遊戲班(堅尼地城/黃竹坑），幼兒園及幼稚園。

     

    1.2    在本協議中，除非表明相反之意向：

    a.      詞語的單數包括複數（反之亦然）；

    b.      標題僅為方便檢索而設，不應影響細則之詮釋；

    c.      凡引述任何法規或法定條文，均包括據此制定的任何法令、法規或其他附屬法例，同時除文義另有要求外，應解釋為有關當時生效的任何修訂版或重訂版；

    d.     本協議第三與第四章節僅在申請人獲批獎學金情況下生效。

    2. ELIGIBILITY CRITERIA | 申請資格標準

    2.1     Scholarship shall be granted to applicants only where the Eligibility Criteria are satisfied.

    2.1 只有在符合申請資格與標​準時，申請人才能被授予獎學金。 

    3. GRANT CONDITIONS | 獎學金獲批條件

    3.1     Guardian forfeits eligibility and will forfeit a Scholarship on behalf of Applicant if:

    a.     Any of the Eligibility Criteria are no longer satisfied at any time during the period of the Scholarship;

    b.     Applicant does not meet satisfactory School attendance requirements as determined by Mighty Oaks;

    c.      Applicant fails any subjects at School;

    d.     Applicant displays any immoral behaviour including but not limited to violent conduct;

    e.     Applicant is withdrawn or dismissed from School.

     

    3.2     On grant of Scholarship, Guardian shall complete Mighty Oaks relevant enrolment forms, waiver and release of liability form and agree to comply with Mighty Oaks policies and additional terms and conditions as provided from time to time.

    3.3     Guardian agrees to notify Mighty Oaks and HBF within 30 days if any of the Eligibility Criteria are no longer satisfied, such notice to be provided in accordance with clause 8.1. This includes changes to financial circumstances.

    3.4     In consideration of Applicant's receipt of a Scholarship, Guardian shall:

    a.     Attend and procure the family attend, where relevant 80% of activities organised by the Mighty Oaks Club, including but not limited to seminars, training workshops, and community service outreach opportunities;

    b.     Attend and procure the family attend, where relevant 50% of student related events at school including but not limited to Christmas performances, school outings, parent volunteers;

    c.   If you child has been diagnosed/suspected as “Special Needs”,
    then it is mandatory to attend all assessments, activities and
    training deemed necessary by the School;

    d. Meet with and procure that Applicant shall meet with HBF representatives on request to assess Applicant's progress.

    e. Be spokepersons for the school and uphold the same
    believes we have at Mighty Oaks.

    The required attendance percentage under clauses 3.4(a)3.4(b) may be reviewed with special request from the family. However, changes can only be made by Mighty Oak’s discretion.

    3.5     Guardian agrees that Mighty Oaks may provide information about Applicant's progress at School to HBF, including but not limited to Applicant's school assessment reports.

    3.1    如下列情況發生，申請人（監護人為代表）將喪失領取獎學金的資格：

    a.     在接受獎學金的期間，不再符合申請資格與標準；

    b.     申請人不符合奧恩規定的上學出席率要求；

    c.      申請人在學校的任何科目評估為不及格；

    d.     申請人表現出不道德的行為，包括但不限於暴力行為；

    e.     申請人被撤回或開除學籍。

    3.2     接受獎學金時，申請人（或監護人代表）應填寫奧恩入學登記表及免除責任同意書，並同意遵守奧恩的政策及附加條款/條件（將不定時提供）。

    3.3    如果申請人已不符合任何申請資格與標準，監護人同意在30天內通知奧恩及歡樂之家，通知將以第8.1條款中內容為根據。此變動包括申請人（或監護人代表）的財務狀況。

    3.4    為讓申請人獲批獎學金資格，監護人代表須：

    a.     出席奧恩親子天地舉辦的活動，包括但不限於工作坊、培訓班和社區​服務，並達到百分之八十的出席率；

    b.     出席奧恩學校活動，包括但不限聖誕表演，學校戶外參觀及旅行，家長義工，並達到百分之五十的出席率；

    c.      如果您的孩子被診斷/懷疑診斷為”特殊需要”，那麼必須參加
    所有奧恩認為必要的評估，活動和訓練;

    d. 出席與歡樂之家代表之會議，以評估申請人的進展。

    e. 成為學校的代言人並堅守我們在奥恩的信念

    如因申請人家庭有特殊要求，可申請出席率之重新審查。奧恩擁有最終決定權。

    3.5     監護人同意奧恩可能會提供有關申請人在學校的情況給歡樂之家，包括但不限於申請人的科目評估表。

    4. CONDITIONS OF RENEWAL | 獎學金續領條件

    4.1     The Scholarship applies for the duration of an academic year as determined by Mighty Oaks. The Scholarship will be renewed annually for the duration of the Applicant's enrolment at School, subject to:

    a.     Continuing satisfaction of the Eligibility Criteria;

    b.     Satisfaction of the grant conditions in clause 3.2-3.5, and no forfeit under clause 3.1; and

    c.      The Applicant's satisfactory progress and character development as assessed by Mighty Oaks and HBF.

    4.1    獎學金以整學年為期限，並由奧恩最終確定。若符合以下條件，申請人在入學期間，獎學金將可在每年得到延續：

    a.     持續符合申請資格與標準；

    b.      持續達到獲批獎學金的第3.2-3.5項條款，並不觸犯第3.1項；且

    c.     申請人的進展及品格發展通過奧恩及歡樂之家的評估。

    5. CONFIDENTIALITY | 保密條款

    5.1     Guardian undertakes that it shall not at any time, disclose to any third party any confidential information of Mighty Oaks or HBF, including without limitation the content of this Agreement, information relating to the scholarship selection process, and any disputes arising out of the subject matter of this Agreement.          

    5.1     監護人承諾，不得在任何時間洩露奧恩及歡樂之家的保密資料給任何第三方，包括但不限於本協議的內容，有關獎學金的評選過程信息、任何可能因本協議所引起或與之相關的爭議。 

    6. TAXATION | 稅務

    6.1 Guardian acknowledges and agrees that it is solely responsible for any personal tax liability that may arise as a result of the grant of the Scholarship, and indemnifies Mighty Oaks and HBF against any such personal tax liability.

    6.1 監護人確認並同意承擔全部與獎學金可能產生的任何個人應繳稅額，並豁免奧恩與歡樂之家對此的所有相關責任。 

    7. TERMINATION | 獎學金終止

    7.1     If clauses 3.2-3.5 of these Terms and Conditions are not satisfied, there is a forfeit under clause 3.1, the Scholarship is not renewed under clause 4, or the Guardian breaches this Agreement, either of Mighty Oaks or HBF may terminate the Scholarship on one month notice, and full fees may apply for the period following termination on a pro-rata basis.

    7.2     Clauses 5, 6 and 8.5 survive the expiration or termination of this Agreement.

    7.3     Guardian understands and agrees that the Scholarship granted may be withdrawn or terminated at any time in the sole discretion of the committee of HBF.

    7.1     如果未能達到第3.2-3.5項條款，或者根據第3.1項條款喪失資格，或者未能達到第4項條款獎學金續領條件，或者監護人違約，奧恩或歡樂之家任何一方將以一個月前通知終止獎學金，獎學金終止後監護人可能須按比例全額支付學校費用。

    7.2   第5, 6,及8.5項條款在協議終止後仍然有效。

    7.3   監護人瞭解並同意歡樂之家的委員會保留在任何時間取消或終止獎學金的權利。

    8. GENERAL | 一般注意事項

    8.2   Any failure by a Party to enforce any term of this Agreement or any forbearance, delay or indulgence granted by a Party to any other will not be construed as a waiver of that party’s rights under this Agreement. A waiver by a Party will not prejudice that Party’s rights in respect of any subsequent breach of this Agreement.


    8.3   No Party shall be in breach of this Agreement nor liable for delay in performing, or failure to perform, any of its obligations under this Agreement if such delay or failure results from events, circumstances or causes beyond its reasonable control. In such circumstances the affected Party shall be entitled to a reasonable extension of the time for performing such obligations.

    8.4   This Agreement is governed by the law applicable in Hong Kong Special Administrative Region.

    8.5   The Parties will try to resolve any disputes that may arise from or in relation to the subject matter of this Agreement through good faith discussion in the first instance. If the dispute cannot be resolved through such discussions within 30 days following the first written request from a Party for consultations, then any Party may submit the dispute to arbitration in Hong Kong, which shall be final and binding on the Parties. If the dispute cannot be resolved through arbitration, the Parties submit to the exclusive jurisdiction of the courts of Hong Kong.


    8.6   Mighty Oaks and HBF reserve the right to make reasonable amendments to this Agreement at any time and will advise
    Guardian if this occurs, as and when required.

    8.7 In the event of discrepancies between the English version and Chinese translation version, the English version shall prevail.

    8.2 任何一方對於此協議的不履行，或者任何一方許可對於此協議的不行 使、延誤、或豁免，不得視為對方於協議條件下權力的放棄及豁免。
     
    8.3 如果造成協議條件的不履行、延誤是由於人為無法控制的事件及因 素，任何一方將不被視為違反此協議或為延遲、未行使協議負責任。 在此情形下，被影響一方將得以延長期限來行使協議責任。


    8.4 此協議為香港特別行政區法律所約束。
      
    8.5 如果協議行使過程中或者對於協議事項有爭議發生，雙方應先就該爭 議作出合理討論。如果爭議無法於第一次討論後的三十天內附上的書 面請求下解決，任何一方可在香港呈交爭議仲裁，此仲裁結果將為最 終決定並對雙方具有約束力。
     
    8.6 奧恩及歡樂之家保留對於此協議的修訂權力，並將於修改條約或者要求條約更改時通知監護人。

    8.7 如英文版本及中文翻譯版本有異，應以英文版本為準。
