Heartwood Nature Programs Waiver and Release from Liability

Participant's parent/guardian understands that Heartwood Nature Programs Foundation, (also known as Heartwood Nature Programs, and Heartwood), assumes no responsibility for injuries or illnesses that Participant may sustain a) as a result of Participant's physical condition, b) resulting from Participant's participation in the activity, c) as a result of another participant's or third person's actions, or d) as a result of participant's use of Heartwood facilities, field and/or equipment in connection with this activity. 

The Participant’s parent/guardian releases and agrees to hold harmless, defend and indemnify Heartwood Nature Programs Foundation and its directors, officers, employees, and agents from and against any and all claims for personal injury (including loss of life) and all other losses or damages (except those caused entirely by the gross negligence or intentional conduct of Heartwood Nature Programs Foundation) that the Participant may suffer as a result of his or her participation and/or enrollment in Heartwood Nature Programs Foundation activities. The Participant releases Heartwood Nature Programs from any claim whatsoever which arises or may arise in the future on account of any first aid treatment or other medical services that are conducted in connection with an emergency occurring while participating in Heartwood Nature Programs summer camps. The Participant’s parent/guardians permission to personnel of Heartwood to authorize any x-rays, tests, procedures, anesthetic, surgery, or treatment on behalf of, and to provide or arrange for any transportation of, my child as may be required in the event of an emergency. If I, or the emergency contacts designated previously, cannot be contacted, I hereby give permission to a licensed physician, or other qualified health care provider as may be appropriate, to administer such treatment to my child, the participant, as may be necessary under the circumstances, including the hospitalization of my child.

The Participant's parent/guardian understands that Heartwood Nature Programs summer camp programs may include various activities that may be hazardous, and the Participant’s parent/guardian expressly and specifically assumes the risk of injury or harm in these activities and releases Heartwood Nature Programs from all liability for injury, illness, death, or property damage resulting from these activities. Risks of participating/enrolling in Heartwood Nature Program classes/camps include, but are not limited to, injury (including loss of life) from exposure to wildlife, exposure to weather, the public, leashed/unleashed dogs, participating in strenuous physical activity such as hiking/walking/working/running/climbing on uneven terrain, climbing trees, participating in crafts using, but not limited to, knives and fire, exposure to trees and vegetation, attending programs in an outdoor location without immediate access to bathrooms, shelter, running water and transportation, and drowning in streams, creeks, lakes and other bodies of water. I hereby give permission to personnel of Heartwood to authorize any x-rays, tests, procedures, anesthetic, surgery, or treatment on behalf of, and to provide or arrange for any transportation of, my child as may be required in the event of an emergency. Heartwood Nature Programs Foundation does not discriminate on the basis of race, color, sex, handicap, religion, or national origin.

Heartwood Nature Programs Foundation reserves the right at its sole discretion to refuse an application or dismiss a child from programs. No refund will be made of fees if the child has attended any portion of the camp session. 

I understand that a schedule of events will be available to me and that all events are subject to change due to weather and/or scheduling conflicts without notice. 

I will notify the program director and/or my child's teacher if my child is exposed to any communicable disease during the three weeks prior to attending any program session or at any time during their program participation.

I give permission for Heartwood to search my child’s belongings with the child present when the health, well-being, or safety of the children or others requires it.

I understand and agree that Heartwood Nature Programs Foundation is not responsible for personal property that is lost, damaged, or stolen in connection with participation in Heartwood Nature Programs.

I understand that Heartwood is a very active program no matter what the location or the weather is. I recognize that my child is in the program to play and socialize outside, and will do so despite rainy weather or cold or hot temperatures.

Heartwood COVID-19 Liability Release Waiver:

In consideration of my participation in the foregoing, the undersigned acknowledge and agree to the following:

I am aware of the existence of the risk on my physical appearance and that of my minor child/children to the venue and my participation and that of my minor child/children to the activity of the Organization that may cause injury or illness such as, but not limited to Influenza, MRSA, or COVID-19 that may lead to paralysis or death.

Following the pronouncements above I hereby declare the following:

I am fully and personally responsible for my own safety and actions and that of my minor child/children's safety and actions while and during participation and I recognize that we may be in any case be at risk of contracting COVID-19.

With full knowledge of the risks involved, I hereby release, waive, discharge the Organization, its board, officers, independent contractors, affiliates, employees, representatives, successors, and assigns from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me or my minor child/children related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19.

I agree to indemnify, defend, and hold harmless the Organization from and against all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to all claims made by or against any of the released party due to injury, loss, or death from or related to COVID-19.
