There are three (3) or less Protected Trees to be removed in a 365 day period. However, if even one Protected Tree proposed to be removed is 12" in diameter or more at DPM, a tree removal permit must be obtained.The removal or clearing is on property subject to an approved woodland management program pursuant to the Farmland Assessment Act of 1964, Editor's Note: See N.J.S.A. 54:4-23.1 et seq. or on property used as a garden center or tree nursery, or any trees located in commercial orchards.Clearing of Protected Trees is required in connection with construction of a new dwelling, the construction or reconstruction of an approved septic system, or the construction or reconstruction of an approved driveway and the trees are located within the critical footprint area; if not in the critical footprint area, application for a permit must be filed.The removal or clearing is on property located within the air safety zone established pursuant to the New Jersey Air Safety and Zoning Act of 1983; Editor's Note: See N.J.S.A. 6:1-80 et seq.A Protected Tree is in such condition to pose imminent danger to public health, safety, and welfare or to existing structures; provided however, that: A licensed tree expert will flag all such trees, provide proof of site conditions with color photos and submit certification that explains the emergency situation.A Protected Tree is diseased, dead or dying as a result of natural causes, such as storms; provided however, that: The person desiring the removal is the owner of the property on which the Protected Tree is located and a licensed tree expert will flag all such trees, provide proof of site conditions with color photos and submit certification that explains the emergency situation.The Protected Tree is growing on property actively operated as a farm under the state's Right to Farm Act, Editor's Note: See N.J.S.A. 4:1C-1 et seq. which is removed to create fields for crops and pastures, or to construct a farm building.The Protected Trees to be removed are in accordance with a subdivision or site plan finally approved by the Township Planning Board or the Zoning Board of Adjustment or, if on Township- owned property, is pursuant to a site development plan submitted to the Township Planning Board for comment.The Protected Tree is in a public road right-of-way or sight easement and is required to be removed for safety
SECTION 3: Submission Requirements
Copy of survey or tax map marking the location and diameter of all trees to be removed and distance from driveways, property lines, and structures.If more than four (4) trees are to be removed, a Tree Removal and Replacement Plan on a survey drawing must be supplied. (See Section 96-6 for a description of the plan and Section 96-7 G for tree replacement requirements)For dead, diseased, damaged, nonviable, hazardous trees, a licensed tree expert shall flag all such trees, provide proof of these conditions with color photos, and submit certification that explains the existing condition qualifying the trees for exemption from obtaining a tree removal permit.
SECTION 4: Fees for removal of Protected Trees
a) 1-10 trees: $250.00 per tree

b) 11-20 trees: $350.00 per tree

c) 21 or greater trees: $500.00 per tree No fees required for removal of Exempt Trees.

d) Administrative Fee: $25.00 per live tree
**Exempt trees have been designated, and their removal does not incur any fees. However, if protected trees are also being removed alongside exempt trees, the total number of trees being removed will be calculated, with fees applicable only to the protected tree category**

*** Whenever a Protected Tree or Trees are being cut down or removed from a lot, a Tree Removal Application must be filed but a permit must be obtained only if four(4) or more Protected Trees are being removed.
