Release of Liability :
I am aware that ballet, floor barre, conditioning and the stretching exercises place unusual stress on the body and carry with them the risk of physical injury. Participants recognize and willingly assume such risks. Further, by engaging in any class or program at Rakova Ballet School, participants represent that they do not have any illness, disability or impairment that will endanger them or others in connection with the participant`s engagement in the dance programs, classes, activities and performances offered by Rakova Ballet School. Participants represent that they are in good physical condition and do not suffer from any illness, disability or impairment that would prevent or limit participation in any program, class or activity.
In consideration for Rakova Ballet School`s accepting participants for its programs, classes, activities and performances, all participants release, discharge, indemnify and hold harmless Rakova Ballet School and its owner, employees, teachers and associated personnel from and against any and all claims by or on behalf of the participant as a result of the participant`s engagement in such programs, classes, activities and performances. All participants waive the right to bring any claim or suit and voluntarily release and discharge Rakova Ballet School, its owner, employees, independent contractors and agents from any and all claims, demands, causes of action, liability, damages, costs or expenses arising out of or relating to a participant `s engagement in Rakova Ballet School`s programs, classes, activities and performances.
I likewise release from liability Rakova Ballet School, LLC, the director, instructors and/or employees for any damage or loss of property incurred during my participation in the activities of Rakova Ballet School. I also understand and accept that good training involves touching and adjustment of the participant's body by the instructor in order to provide proper corrections.
Release of Publicity :
I hereby authorize the Rakova Ballet School, LLC to record the participant’s picture and voice on photographs, films, and tapes, to edit these recordings at its discretion, and to incorporate these recordings into movie and sound films on tapes, radio or television programs and/or in print media. I also give my permission for Rakova Ballet School to use and license others to use these materials in any manner or media whatsoever. Rakova Ballet School is permitted to use these materials for publicity, advertising and sales promotion and to use the student’s name, likeness and voice and biographic or other information in connections with them. I acknowledge that no promises of compensation were made by Rakova Ballet School for such use.
Risk of Participation :
The Undersigned recognizes and understands that while Released Parties have undertaken reasonable steps to lessen the risk of transmission of communicable diseases, including but not limited to, COVID-19, in connection with participation in the activities, the Released Parties are not responsible in any manner for any risks related to communicable diseases in connection with Participant's participation in the activities. Specifically, the Undersigned understands that COVID-19 is a highly contagious and dangerous disease, and that contact with the virus that causes COVID-19 may result in significant personal injury or death. The Undersigned is fully aware that participation in the activities carries with it certain inherent risks related to transmission of communicable diseases ("Inherent Risks") that cannot be eliminated regardless of the care taken to avoid such risks. Inherent Risks may include, but are not limited to, (1) the risk of coming into close contact with individuals or objects that may be carrying a communicable disease; (2) the risk of transmitting or contracting a communicable disease, directly or indirectly, to or from other individuals; and (3) injuries and complications ranging in severity from minor to catastrophic, including death, resulting directly or indirectly from communicable diseases or the treatment thereof. Further, the Undersigned understands that the risks of all communicable diseases are not fully understood, and that contact with, or transmission of, a communicable disease may result in risks to the Participant including but not limited to loss, personal injury, sickness, death, damage, and expense, the exact nature of which are not currently ascertainable, and all of which are to be considered Inherent Risks. The Undersigned hereby voluntarily accepts and assumes all risk of loss, personal injury, sickness, death, damage, and expense for the Participant arising from such Inherent Risks.
