Informed Consent and Acknowledgement
As Parent and/or Guardian of the named camper, I hereby give my approval for my child’s participation in any and all activities prepared by Rocky Mountain College during the selected camp. In exchange for the acceptance of said child’s candidacy by Rocky Mountain College, I assume all risk and hazards incidental to the conduct of the activities, and release, absolve and hold harmless Rocky Mountain College and all its respective officers, agents, and representatives from any and all liability for injuries to said child arising out of traveling to, participating in, or returning from selected camp sessions.
In case of injury to said child, I hereby waive all claims against Rocky Mountain College including all coaches and affiliates, all participants, sponsoring agencies, advertisers, and, if applicable, owners and lessors of premises used to conduct the event. There is a risk of being injured that is inherent in all sports activities including those during the selected camp(s). Some of these injuries include but are not limited to, the risk of fractures, paralysis, or death.
Medical Release and Authorization
As Parent and/or Guardian of the named camper, I hereby authorize the diagnosis and treatment by a qualified and licensed medical professional, of the minor child, in the event of a medical emergency, which in the opinion of the attending medical professional, requires immediate attention to prevent further endangerment of the minor’s life, physical disfigurement, physical impairment, or other undue pain, suffering or discomfort, if delayed.
Permission is hereby granted to the attending physician to proceed with any medical or minor surgical treatment, and/or x-ray examinations for the named camper. In the event of an emergency arising out of serious illness, the need for major surgery, or significant accidental injury, I understand that every attempt will be made by the attending physician to contact me in the most expeditious way possible. This authorization is granted only after a reasonable effort has been made to reach me.
Permission is also granted to Rocky Mountain College and its affiliates including Directors, Coaches, and Employees to provide the needed emergency treatment prior to the child’s admission to the medical facility.
Release authorized on the dates and/or duration of the registered camp.
This release is authorized and executed of my own free will, with the sole purpose of authorizing medical treatment under emergency circumstances, for the protection of life and limb of the named minor child, in my absence.
COVID Release and Authorization
This Release and Waiver of Liability (the “Release”) executed on this day of submission of this form by (the “Participant”) in favor of Rocky Mountain College, a nonprofit institution, and its Camps/Conferences Program, their leadership, staff, and Participants (collectively, “Program”).
The Participant desires to allow the named camper to participate in and attend events and activities related to being a participant in-person. The Participant understands that the Camps/Conferences may put the named camper at risk of contracting the novel coronavirus (COVID-19). The Participant also acknowledges that any decision of Participant to allow the named camper to return to campus or other in-person portions of the Camps/Conferences are entirely the choice of Participant.
The Participant hereby freely, voluntarily, and without duress executes this Release/Waiver of Liability and Statement of Assumption of Risk under the following terms:
RELEASE AND WAIVER
The Participant does hereby release and forever discharge and hold harmless the Program and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from the named camper’s Camps/Conferences with the Program with regard to the risk of infection from COVID-19, including the potential to infect others not associated with the Program.
The Participant understands that this Release discharges the Program from any liability or claim that the named camper may have against the Program with respect to any symptoms and/or positive identification of COVID-19 that may result from the named camper’s Camps/Conferences with the Program, whether caused by the acts of the Program or its employees, guests, Participants, or otherwise. The Participant also understands that the Program does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to, medical, health, or disability insurance in the event of illness.
MEDICAL TREATMENT
The Participant does hereby release and forever discharge the Program from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the named camper’s Camps/Conferences with the Program.
ASSUMPTION OF THE RISK
The Participant understands that the Camps/Conferences includes activities that may result in COVID-19 infection or harm to the named camper, including, but not limited to, close contact with other individuals, lack of social distancing recommendations, and lack of others personal hygiene and cleanliness. Participant assumes such risk of the Camps/Conferences in full consideration of the same. Participant further represents and warrants the named camper will abide by all social distancing, hygienic, or other recommended measures of the Program, Federal, State, and local governments so as to contribute and lead by example to establish the safest possible learning environment for the Program. If at any time, Participant believes the Program is not taking appropriate measures in response to the COVID-19 outbreak, Participant will immediately inform the Office of Auxiliary Services, and the named camper will not attend in-person Camps/Conferences unless he/she is willing to assume any associated risk with regard to the same.
The Participant hereby expressly and specifically assumes the risk of illness or harm in the Camps/Conferences and releases the Program from all liability of illness, death, or impact on health resulting from the Camps/Conferences.
INSURANCE
The Participant understands that, except as otherwise agreed to by the Program in writing, the Program does not carry or maintain health, medical, or disability insurance coverage for any named camper(s). Each named camper is expected to obtain his or her own medical or health insurance coverage.
I HAVE CAREFULLY REVIEWED THIS RELEASE AND WAIVER OF LIABILITY AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY, THAT I AM WAIVING MY RIGHT TO BRING A LEGAL ACTION AGAINST ROCKY MOUNTAIN COLLEGE AND ITS CAMPS/CONFERENCES PROGRAM FORWARD, AND THAT THIS IS A CONTRACT BETWEEN MYSELF AND ROCKY MOUNTAIN COLLEGE AND ITS CAMPS/CONFERENCES PROGRAM FORWARD WHICH I AM SIGNING VOLUNTARILY. I FURTHER ACKNOWLEDGE I HAVE CAREFULLY CONSIDERED THE RISK IN RETURNING TO IN-PERSON CAMPS/CONFERENCES AND ASSUME SUCH RISK OF MY OWN VOLITION, HAVING BEEN PROVIDED THE OPPORTUNITY TO DENY THE SAME.
