  • PLEASE READ CAREFULLY! THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS!

    This Release and Waiver of Liability (the "Release") executed on this day by this volunteer, in favor of the Capital Region Habitat for Humanity affiliate (CRHFH), a nonprofit corporation, its officers, employees, and agents. The Volunteer desires to work as a volunteer for the CRHFH and engage in the activities related to being a volunteer (the "Activities"). The Volunteer understands that the Activities include constructing and rehabilitating residential buildings. The Volunteer hereby freely, voluntarily, and without duress executes this Release under the following terms:

    Release and Waiver. Volunteer does hereby release and forever discharge and hold harmless the CRHFH and its successors and assigns any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Volunteer's activities with CRHFH. 

    Volunteer understands that this Release discharges the CRHFH from any liability or claim that the Volunteer may have against the CRHFH with respect to any bodily injury, personal injury, illness, death or property damage that may result from Volunteer's Activities with the CRHFH, whether caused by the negligence of the CRHFH or its officers, directors, employees, agents or otherwise. Volunteer also understands that the CRHFH does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness.

    Medical Treatment. Volunteer does hereby release and forever discharge the CRHFH from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in conection with the volunteer's activities with CRHFH

    Assumption of the Risk. The Volunteer understands that Activities include work that may be hazardous to the volunteer, including, but not limited to, construction, loading and unloading. Volunteer hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases the CRHFH from all liability for injury, illness, death, or property damage resulting

  • Insurance. Volunteer hereby represents and warrants that Volunteer is covered by a health insurance policy. Volunteer acknowledges and agrees that (a) Volunteer is responsible for any co-pays or deductibles under such policy, (b) such policy is primary in the event Volunteer is injured in connection with the Activities and (c) subrogation rights against the CRHFH or its insurers are hereby waived. The CRHFH may carry Volunteer Accident Insurance. Volunteer Accident Insurance pays after the Volunteer's insurance pays. The Volunteer understands that the CRHFH is not obligated hereunder to carry or maintain health, medical, or disability insurance coverage for any Volunteer.

    Photographic Release. Volunteer does hereby grant and convey unto the CRHFH all right, title, and interest in any and all photographic images and video or audio recordings made by the CRHFH during the Volunteer's Activities with the CRHFH, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.

    Other. Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of New Hampshire, and that this Release shall be governed by and interpreted in accordance with the law of the State of New Hampshire. Volunteer agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provision of this Release which shall continue to be enforceable.

    Safety Policy

    It is the policy of the CRHFH to provide as safe a work place as possible realizing that a construction site has many inherent safety hazards.

    Safety Rules are for everyone's protection: Please be attentive to the safety instructions given by the Project Leader at the start of the workday.

     

    Age Restrictions for Minors

    The CRHFH has a minimum age limit of 16 for all Volunteers. Youths ages 16 and 17 must have an adult chaperone age 21 or older as well as have a parent or legal guardian's authorization to participate in the form of signature of this waiver. Adult supervision for all youth groups and individuals working with the CRHFH must maintain a ratio of one (1) adult for every four (4) youths. It is further the policy of the CRHFH that, while youths ages 16 and 17 may be allowed to participate in general construction work, activities using power tools, excavation, demolition or working on rooftops is not permitted by anyone under the age of 18.
