Waiver of Liability & Assumption of Risk
Expressions Dance & Movement, LLC ("EDMC") requires a Waiver of Liability and Assumption of Risk to be on file for every currently enrolled dancer for the 2023-2024 Season running from August 7, 2023 - June 22, 2024.
This Waiver affects dancers currently enrolled for participation in dance and/or acro classes, rehearsals, practices and/or performances (“the Activities”) offered by EDMC at:
9225 Carlton Hills Blvd. STE 28, 23,1 Santee, CA 92071 (Studios A, B, C, D, E) AND/OR
9470 Cuyamaca Street STE 140, Santee, CA 92071 (Cuyamaca Studio) AND/OR
Other venues/premises from time to time,
and/or use of the property, facilities, and services of EDMC.
RISK FACTORS:
I understand and acknowledge that participation in dance classes, rehearsals, practices, and/or performances involve some inherent risks such as, but not limited to, personal injury, property damage, loss, illness, or death. Furthermore, participation in these activities includes
possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19.
ASSUMPTION OF THE RISKS AND RELEASE:
I recognize that there are certain inherent risks associated with the above-described activities and I assume full responsibility for personal injury, property damage, loss, illness, or death to myself and my family members, and further release and discharge EDMC for injury, loss or
damage arising out of my or my family’s use of or presence in the facilities of EDMC, whether caused by the actions of myself or my family, EDMC, or third parties.
DAMAGES DUE TO NEGLIGENCE:
I agree to pay for all damages to the facilities of EDMC caused by any negligent, reckless, or willful actions by me or my family.
MEDICAL AUTHORIZATION:
In the event of an injury to the above-named minor, while participating in the Activities provided or sponsored by EDMC, I give permission to EDMC, its employees, representatives and/or agents of EDMC to arrange for all necessary medical treatment for which I shall be
financially responsible. This temporary authority will begin on the date this form is submitted and will remain in effect for the duration of active enrollment with EDMC or June 22, 2024, whichever occurs first.
EDMC shall have the following powers:
1) The power to seek appropriate medical treatment or
attention on behalf of myself or my child as may be required by the circumstances, including without limitation, that of a licensed medical physician and/or a hospital.
2) The power to authorize medical treatment or medical procedures in an emergency situation.
3) The power to make appropriate decisions regarding clothing, bodily nourishment, and shelter.
