These 2022 Rules and Contract shall be entered into by Perfectionista, LLC, a Maryland limited liability company (the “Owner” or “On-Site Manager”) and _______________________ (the “Renter” or “Contract Holder”).
The rules that follow are written with the idea that Blooms Alley (the “Facility” or “Facilities”) will be available for rentals. The Facility will be available for rentals on a first come, first serve basis. .
Facilities Available for Rental (Use of restrooms is included in all rentals)
• Blooms Alley Garden rear of Blooms Alley
approx. 12ft x 37ft space includes use of café common area and 2 restrooms in rear.
Facilities Excluded from Rental:
• Retail location, studios, offices spaces and kitchen are excluded from rental
RULES OF USE
The Facilities will not be available for rental on the following days/dates:
Easter Weekend
Thanksgiving Weekend
Christmas Eve/Christmas Day (including the weekend closest to Christmas)
New Year’s Eve/New Year’s Day
Rentals that fall on all other Major Holidays will be charged the Weekend rate
There will be a six hour time limit on all events. All events must conclude by 10:00 PM. Renters must have all events cleaned up and building/premises vacated by 12:00 AM. If additional time is
required for set up and or clean up, the renter will be charged an additional hour rental fee
All reservations must be made with the On-Site Manager at least two weeks prior to the event. All reservations made after this date will be subject to a $25.00 handling fee. Reservations will be accepted on a first come, first serve basis.
A Security Deposit will be charged for all events and is due at the time of the rental reservation. No event will be scheduled on the facility calendar until a Security Deposit is paid AND a Rental Contract is accepted. Event dates MAY NOT be reserved or placed on the calendar as tentative.
If the Facilities are left in their original condition at the end of the rental, the Security Deposit will be refunded. If the Facilities are not left in their original condition, the cost of restoration will be deducted from the security deposit. Any amount for damages that exceeds the original deposit will be due within 5 days of the inspection.
• If the costs for all damages are not paid by Renter within the stipulated time, legal action to recover these costs will be initiated.
Security Deposits – $250
Rental fees are due 2 weeks prior to the event. Failure to make appropriate payment could result in cancellation of your rental reservation.
All other cancellations/rescheduling that occur within 5 days of the event will be charged a $25.00 handling fee. Events cancelled / rescheduled within 24 hours of the event will be charged a $250 fee.
All monies for Security Deposits, Rentals, and Reimbursements for damages are to be made payable to Perfectionista LLC.
• Payments may be paid by money order, cash, credit or via online Blooms Alley invoice
9. Pets are not allowed in the facility.
10. Yes, ticketed events are allowed with event insurance. Alcohol permitted with liquor license.
Renters who rent the Facility must be personally in attendance during the reserved hours.
The Renter agrees to assume full responsibility for any loss or any damage to the building, furniture, furnishings and equipment and for the proper conduct of guests while they are on the premises whether inside or outside of the building. The function will be terminated if the Renter is not in attendance during the reserved hours.
Furniture and Furnishings may not be moved or removed without prior permission by the On-Site Manager. If permission is granted, all furniture / furnishings MUST BE RETURNED TO THEIR ORIGINAL POSITIONS. Failure to do so will result in a $250.00 cleanup fee.
No smoking permitted in all inside areas of the Facility and surrounding areas.
Renters who allow their guests to smoke outside must provide an adequate means of discarding cigarette butts. Failure to do so will result in a $250.00 cleanup fee.
No music is permitted outside the Facility after 11:00 p.m. All music must be played at lowered volume after 10:00 p.m.
Hourly fees are charged per room/space, per hour, unless renter is using the entire Facility.
Cleaning is the responsibility of the Renter. This includes, but is not limited to, wiping down and putting away all tables / chairs, sweeping / vacuuming all floors and carpets, promptly cleaning up any food / beverage spills to avoid staining, general cleanup, discarding/removing all food items, and removal of all trash by the Renter.
Special Considerations / Restrictions
Mylar balloons, glitter and confetti are strictly prohibited in all areas. Decorations of any kind are to be placed using 3m removable adhesive tape.
Failure to properly clean up after an event will result in a $250.00 cleanup fee.
Note: If you should find your rental area to be in an unsatisfactory condition, you MUST NOTIFY THE IMMEDIATELY to report the conditions. Failure to report unsatisfactory conditions constitutes your agreement to properly clean the area at the conclusion of your event and may render you liable for restoration fees.
Open flames are prohibited in the Facility at all times including votive candles.
Protective table linens must be used on any of the Facility tables or furnishings before serving foodand/or beverages.
Weekends constitute Friday from 5:00 pm through Sunday 11:59 pm.
Daytime fees are for normal business hours of 9:00 am to 5:00 pm.
Rentals that fall on major Holidays will be charged WEEKEND rates. These rentals will be approved depending on the avalibility of staff. (see exclusions)
Washington County Fire Code allows _65_______guests in the Facility.
The Owner can provide approximately _____ 50 chairs, ___5__ rectanglar banquet tables 3 feet by 8 feet. We do not provide table cloths or utensils.
This Contract is for the use of the Facility. In the event that the Owner fails to fulfill its obligations under this Rental Contract, the Owner’s liability for damages is limited to the amount of the fees paid by the Renter for rental of the Facility. If more than one individual constitutes the Contract Holder, the singular context will be construed to be plural wherever necessary and the covenants of the Contract Holder will be the joint and several obligation of any of its users thereof.
CONTRACT HOLDER(S):
I hereby acknowledge that I have read and agree to the terms and conditions of this Contract. I agree to be bound to the requirements and terms and conditions established by this Contract. If there is damage to the Facility in excess of the security deposit, I will pay the additional charges; any such charges are collectible in the same manner as an assessment against my lot. Further, I agree that should I fail to pay the excess charges and the Owner must file suit in Washington County, MD to enforce this Agreement, I will pay the Owner's attorney’s fees and costs.
I hereby indemnify and hold the Owner, its members, officers, employees, guests and agents harmless from any and all liabilities, suits, judgments, costs and expenses, including attorney’s fees, arising from the performance of this Contract or any act, omission or negligence.
