TERMS & CONDITIONS OF SERVICE: DACS Client Terms and Conditions for Digital Asset Attestation Service Description: The DACS Attestation Service meticulously authenticates the ownership and authenticity of digital assets, culminating in issuing a digital certificate. This process verifies control over the assets without disclosing detailed blockchain information, leveraging cryptographic techniques to enhance transactional integrity. It aims to facilitate trust in digital transactions, ensuring compliance and safeguarding against fraud, thereby addressing the complexities and challenges associated with digital asset verification. Customer Obligations: Customers are required to provide accurate and complete information to facilitate the attestation process effectively. This includes submitting view-only wallet addresses, essential for verifying digital asset authenticity and ownership. By agreeing to these terms, clients acknowledge their responsibility to ensure that all information provided is current and truthful, which is critical for the integrity and success of the attestation service. Fees, Payment Terms, and Additional Costs: Upon completing the preliminary information-gathering phase, clients will receive a detailed quote for the attestation service. This quote will encompass all associated fees for the service provision. Payment must be made in full in advance before the issuance of the attestation certificate. Clients are responsible for any additional costs arising during the service provision, which will be communicated and agreed upon before incurring such costs. This ensures transparency and mutual agreement on service terms. Data Security and Confidentiality: We are committed to the highest data security and confidentiality standards. At no point do we request private keys, seeds, or passwords from our clients, ensuring that we never can move or control client cryptocurrencies. All information related to the attestation certificate is stored with utmost security, safeguarding your data throughout the attestation process. This commitment underscores our dedication to protecting your information while providing a trustworthy and secure service. Regulatory Compliance and Jurisdictional Laws: We acknowledge the evolving nature of cryptocurrency regulations and are committed to complying with jurisdictional laws in Australia or the financial jurisdiction in which the customer resides. Our service is designed with flexibility to adapt to regulatory changes, ensuring that our attestation processes remain compliant with current legal standards. This commitment to legal compliance reinforces our dedication to providing a responsible and secure attestation service for digital assets. Limitation of Liability: DACS limits its liability in instances of data breaches or failures to verify assets resulting from inaccuracies in the information provided by the customer. We emphasise that, as DACS does not request, hold, or store private keys, seeds, or passwords, our system, even in the unlikely event of a breach, cannot grant access to or control over customer digital assets. Customers are responsible for ensuring the accuracy and completeness of all information provided to DACS to facilitate the attestation process effectively. Termination and Cancellation: Once the client has commissioned the attestation service, DACS is committed to completing the service and providing the final attestation report to the client, as well as copying it to the accountant, auditor, or other nominated party as originally instructed. This ensures that all relevant parties receive the necessary documentation for compliance and oversight responsibilities. Dispute Resolution: For disputes arising from the attestation service, parties will first attempt to resolve issues through good faith negotiation. Failing resolution, disputes will proceed to mediation in Victoria, Australia, under the Australian Disputes Centre's Mediation Rules. If unresolved, arbitration in Victoria follows under the Australian Centre for International Commercial Arbitration's Rules. Notably, any damages awarded shall not exceed the fee paid by the client for the service, ensuring a fair and equitable resolution process. Amendments to Terms and Conditions: We reserve the right to amend or update these Terms and Conditions at any time to reflect changes in our service, legal or regulatory requirements, or any other developments. Any such amendments will be effective upon posting the revised Terms and Conditions on our website or notifying clients directly. Continued use of our service after any such changes constitutes acceptance of the new Terms and Conditions. We encourage clients to review the Terms regularly to stay informed of our practices. Governing Law: These Terms and Conditions and any dispute or claim arising out of or in connection with them are governed by and construed following the laws of Victoria, Australia. By accepting these terms, clients agree that the courts of Victoria will have exclusive jurisdiction to resolve any disputes or legal matters related to the services provided.
