The following are the job duties and responsibilities for being a senior representative with Jeffrey J. O’Connell Photography.
It is the client’s understanding that once they sign this contract, they cannot have their senior photographs taken by any other photographer for Senior photos (excluding sports and school). In the event that this happens, they will be terminated as a senior representative for Jeffrey J. O’Connell Photography.It is the client’s understanding that if, for any reason, Jeffrey J. O’Connell Photography does not think the client is representing the studio appropriately, Jeffrey J. O’Connell Photography has the right to forgo agreement at any time. In this circumstance, client would not receive any additional services, products or payments. It is the clients understanding that in this event they will receive an email notifying them that they are no longer a senior representative for Jeffrey J. O’Connell Photography.
The parties agree to cheerfully cooperate and communicate for the best possible result within the definition of this assignment.
I hereby give to Jeffrey J. O'Connell Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:
I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
The photographs produced by Jeffrey J. O’Connell Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without Jeffrey J. O’Connell Photography’s explicit written permission. It is a breach of this agreement to not only reproduce the images, but to display them on social networking sites and apps (Facebook.com, Instagram.com, etc.). If displayed on social networking sites, photos must say, “Photos by Jeffrey J. O’Connell Photography,” somewhere visible on the photo or on the information tab below each single photo. Upon image distribution, limited copyright ownership of the resulting images will be transferred to the CLIENT under the following conditions:
Requests for photographic images to be used by Jeffrey J. O’Connell Photography may be requested at a future time. CLIENT grants Jeffrey J. O’Connell Photography permission to display selected images resulting from this assignment as an example of Jeffrey J. O’Connell Photography’s work and for entrance into photographic competitions or any print or online publication and release all claims to profits that may arise from use of images.
Jeffrey J. O’Connell Photography takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Jeffrey J. O’Connell Photography’s control, Jeffrey J. O’Connell Photography liability is limited to the return of all payments received for the session package you will be given the opportunity to reschedule for the next available date.
It is standard that your photos be edited, and provided to you in our agreed upon timeline. In the event that the CLIENT requests more extensive editing: Editing can be provided for a fee of $30/hr with minimum of 1 hour to be paid prior to any additional editing being completed.
In the event of weather conditions out of our control:Due to photography equipment and lighting conditions, it is the photographer’s discretion if weather conditions are such that the session must be cancelled. If such an event occurs, you will be given the opportunity to reschedule for the next available date. If CLIENT pursues the session, regardless of the photographer’s advice, and the images are not up to Jeffrey J. O’Connell Photography’s standards, the CLIENT will be responsible for all charges related to scheduling an additional shoot.
The CLIENT is responsible for bringing any props that they would like in their photos. In the event that the CLIENT has forgot a prop for the session and wants photos with that prop, the CLIENT will be charged for an additional session at the photographer’s hourly rate to reschedule or shoot additional photos.
If the CLIENT wishes to include locations outside of a 30 miles radius inside North America from Woodhaven, MI (48183) to the package, there will be a fee starting at $50 depending on location. Jeffrey J. O’Connell Photography will be notified 14 days in advance of all the locations, directions, and addresses. Note that the additional travel time incurred will be included in the total session time.
If the CLIENT chooses a location which charges admission, an access fee, a parking fee, or a photography fee, the CLIENT will be responsible to cover those fees associated with shooting at those locations. The CLIENT will also be responsible for organizing the access and any permits related to doing so.
In the event of cancellation, the retainer amount is non-refundable. It shall be liquidated damages to Jeffrey J. O’Connell Photography in the event of a breach of contract by CLIENT. The CLIENT shall also be responsible for payment of any Jeffrey J. O’Connell Photography material charges incurred up to time of cancellation. If CLIENT needs to reschedule for any reason, CLIENT must do so within 7 (seven) calendar days and any retainer or paid fees will be transferred to the rescheduled session. Any request for reschedule after 7 (seven) calendar days will require a half the normal retainer fee for rescheduling up to 14 (fourteen) calendar days. If past the 14 (fourteen) days, the original retainer will be forfeited.
After six (6) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.
Any image not selected during the ordering session will be purged anytime thereafter.
Editing doesn't start until payment is in full. Editing and image to my print labs takes approximately 3 (three) to 4 (four) weeks, but may take longer. In the event that image delivery is outside of this time, the CLIENT can contact via email for a status update.
The retainer paid and this contract signed below allows the Senior to participate in the JJOPCREW activities. The Retainer paid is for the Senior's individual Session with Jeffrey J. O'Connell. The Client will pay the Photographer the total fee specified in the invoice they receive during their ordering session. Please refer to the Product Guide.
