  • At Through the Woods Forest & Nature School we support participants in becoming confident, capable people who have a sound sense of their skills and interests, and the ability to take age-appropriate responsibility for their own safety. Adult anxieties about children can lead adults to overprotect them. This makes it harder for children to learn the consequences of their actions and makes learning less engaging. Furthermore, educators, public health professionals, and child development experts are concerned that children today spend less time playing and learning outdoors, with damaging results for them and society. For this reason, unstructured outdoor play and learning are central to this program/experience.

    Through the Woods Forest & Nature School takes reasonable steps to manage and balance risks, while at the same time allowing participants to play freely. Program participants acknowledge its inherent risks of harm and personal injury. While minor injuries like bruises, bumps and scrapes are not uncommon, serious injuries are rare, and life-changing injuries and fatalities are unlikely in the extreme. Still, as with almost any activity, indoors or outdoors, it is impossible to guarantee that they will not happen. You are required to accept this as a condition of your child or youths’ participation.  

    Through the Woods Forest & Nature School facilitators are trained and experienced, and their role is to support participants in learning and playing, while keeping the risks to an acceptable level. This can include but is not limited to:

    • Injuries from executing strenuous and demanding physical activities
    • Injuries resulting from the use of tools, including fire activities
    • Injuries resulting from the presence of harmful plants, natural loose parts, wild animals, and insects
    • Changing and inclement weather, including cold, rain, storms, high winds, and lightning
    • The possibility that your child may not heed safety instructions or directions given to the group or delivered individually
    • Injuries arising from the actions of other participants

    In unstructured, outdoor play, children freely choose which experiences and form of play they are comfortable engaging in. Your child or youth is under no obligation to participate in all experiences and may choose not to participate at any time during the session.

  • Through the Woods Forest & Nature School, a division of 2175225 Alberta Ltd. (the “Company”), is a forest and nature school program that uses a child-led learning approach which takes place in a natural environment, providing the opportunity for participants to explore, play and learn in the outdoors, and in all weathers (the "Activity"). The individual named above (referred to as “I” or “me” or “Participant”) desires to participate in the Activity operated by the Company. As lawful consideration for being permitted by the Company to engage in the Activity and the intangible value that I will gain by participating in the Activity, I agree to all the terms and conditions set forth in this agreement (the "Agreement").

    1.     I am aware and understand that the Activity is a potentially dangerous activity and involves the risk of serious injury, disability, death, or property damage. I am also aware of the contagious nature of bacterial and viral diseases and the risk that I may be exposed to or contract infectious diseases by engaging in the Activity, which may result in serious illness, personal injury, disability, death, or property damage. I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH KNOWLEDGE OF THE DANGERS INVOLVED. I HEREBY AGREE TO ACCEPT AND ASSUME ALL RISKS OF INJURY, ILLNESS, DISABILITY, DEATH, OR PROPERTY DAMAGE ARISING FROM MY ENGAGING IN THE ACTIVITY, WHETHER CAUSED BY THE NEGLIGENCE OF THE COMPANY OR OTHERWISE.

    2.      I hereby expressly waive and release any and all claims which I have or may in future have, against the Company, and its employees, agents, representatives, affiliates, shareholders, successors, and assigns (collectively, "Releasees"), on account of injury, illness, disability, death, or property damage arising out of or attributable to my participation in the Activity, whether arising out of the negligence of the Company or any other Releasee or otherwise, including without limitation, breach of contract, or breach of any statutory or other duty of care. I covenant not to make or bring any such claim against the Company or any other Releasee, and forever release and discharge the Company and all other Releasees from liability under such claims.

    3.      I confirm that I am in good health, in proper physical condition, and do not have any medical or other conditions that would impair my ability to participate in the Activity. If at any time I believe conditions to be unsafe, that I am no longer in proper physical condition to participate in the Activity I will immediately discontinue further participation in the Activity.

    4.      I shall defend, indemnify, and hold harmless the Company and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable legal fees, fees, and the costs of enforcing any right to indemnification under this Agreement, and the cost of pursuing any insurance providers, arising out or resulting from any claim of a third party related to my participation in the Activity.

    5.      I understand and acknowledge that during my participation in the Activity, I might be photographed, or video recorded. I acknowledge that these images may be used in promotional materials, news releases, social media posts, and other forms of publication. I further understand that all such images will remain the exclusive property of the Company. By initialling below, I hereby give my consent for such use of my likeness, without notice to me.  Leave blank if you do not consent to image release.

  • 6.      Regardless of any consent or lack of consent provided for image release, I acknowledge and agree that any creations produced by the Participant in the course of the Activity, whether alone or with others, may be used, reproduced, displayed, performed, adapted, modified, distributed, and promoted in any manner or medium whatsoever, anywhere in the world, by the Company without further consent, notice or compensation to the Participant.

    7.      This Agreement constitutes the sole and entire agreement of the Company and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. This Agreement is binding on and shall inure to the benefit of the Company and me and our respective successors and assigns. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein.

    8.      I acknowledge that the Company has provided some details on potential risks and acknowledge that they are not responsible for outlining all possible risks. I hereby acknowledge that participation in the Activity has risks and participation in the Activity shall be at my own risk and it is my responsibility to determine the risks involved with the Activity.

    9.      The Participant is required to arrive with all necessary and sufficient equipment required for the Activities, as may be detailed by the Company from time to time. The Participant shall also adhere to and follow all instructions and guidelines set out by the Company's facilitators. Failure to comply with these requirements may result in the Participant being dismissed from the Activity, with no refund provided. The Company shall have sole discretion to determine whether the Participant has complied with these requirements.

    BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS (ON MY BEHALF AND ON BEHALF OF MY HEIRS, EXECUTORS, ADMINISTRATORS, AND NEXT-OF-KIN), INCLUDING THE RIGHT TO SUE THE COMPANY AND THE RELEASEES. 

    I am the parent or legal guardian of the minor named above. I have the legal right to consent and, by signing below, I hereby do consent to the terms and conditions of this Release of Liability and Terms of Participation on behalf of myself and the Participant and confirm the information provided within the Agreement to be accurate.
