AVMA CARES: VET FOR A DAY
ASSUMPTION OF RISKS, RELEASE OF LIABILITY, AND WAIVER OF ALL CLAIMS
PLEASE READ CAREFULLY: By signing this document, you will waive your right to sue.
This Assumption of Risks, Release of Liability and Waiver of All Claims (the "Release") executed by the signee below (the "Volunteer") is in favor of the American Veterinary Medical Association (“AVMA”) (1931 N. Meacham Rd, Schaumburg, IL 60173) and It Takes a Village Foundation (102 Starlight Drive, Bonaire, GA 31005). The Volunteer desires to serve as a volunteer for AVMA and engage in the activities related to being a volunteer for AVMA Cares: Vet for a Day on Monday, June 24 (the "Activities"). The Volunteer understands and acknowledges that the Activities include, but are not limited to, working with feral and domesticated animals, including animals with an unknown vaccination history, exposure to needles and other sharp medical equipment, and certain chemicals used for medical or cleaning purposes while performing volunteer duties. Volunteer understands and acknowledges that the Activities are hazardous and dangerous, including but not limited to the risk of animal bites, scratches, zoonotic diseases (diseases transmitted from animals to humans) or other contagions, allergic reactions, or other serious and potentially life-threatening injuries and conditions. The Volunteer understands that no compensation will be provided in return for participation in the Activities. The Volunteer hereby freely, voluntarily, and without duress executes this Release under the following terms:
1. Release of Claims and Waiver of Liability
To the fullest extent allowed by applicable law, Volunteer, on his or her own behalf and on behalf of his/her beneficiaries, heirs, executors, and anyone else claiming by or through Volunteer, does hereby release and forever discharge and hold harmless AVMA and It Takes a Village Foundation, and their respective officers, directors, employees, contractors, vendors, sponsors, and other agents (“Releasees”) from any and all liability, expenses, claims, and demands including but not limited to, liability arising from the negligence or fault of the Releases, or any of them, for death, disability, personal injury, illness, property damage, property theft, or actions or omissions of any kind that arise or may hereafter arise as a result from the Volunteer's participation in the Activities.
VOLUNTEER UNDERSTANDS THAT THIS RELEASE DISCHARGES AVMA AND IT TAKES A VILLAGE FOUNDATION FROM ANY LIABILITY OR CLAIM THAT THE VOLUNTEER OR VOLUNTEER’S BENEFICIARIES, HEIRS, EXECUTORS, AND OTHERS CLAIMING BY OR THROUGH VOLUNTEER, MAY HAVE AGAINST AVMA AND IT TAKES A VILLAGE FOUNDATION WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE THAT MAY RESULT FROM VOLUNTEER'S PARTICIPATION IN THE ACTIVITIES, WHETHER CAUSED BY THE NEGLIGENCE OF AVMA, IT TAKES A VILLAGE FOUNDATION OR ANYONE ELSE. VOLUNTEER ALSO UNDERSTANDS THAT AVMA AND IT TAKES A VILLAGE FOUNDATION DO NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL ASSISTANCE OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, WORKMANS COMP OR DISABILITY INSURANCE IN THE EVENT OF INJURY OR ILLNESS OR ANY OTHER LOSS.
Volunteer should be vaccinated for rabies and titer checked within the last two years or consulted with a personal physician/medical professional to understand and accept any risk of not being vaccinated. Volunteer is expected and encouraged to obtain his or her own medical or health insurance coverage.
2. Photographic Release
The AVMA and/or It Takes a Village Foundation may have photographers and videographers taking photos or videos of the Activities (“Recordings”), some of which may include Volunteer. Volunteer hereby authorizes the making of any Recordings that include Volunteer, and agrees that AVMA and/or It Takes a Village Foundation, may use the Recordings in the future for any purpose, including without limitation, commercial, marketing, publicity, promotions, advertising, educational or other purposes, without further notice or compensation of any kind.
3. Other
Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the the State of Texas and any other applicable law, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Texas. Volunteer also agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
4. Review by Attorney
Volunteer acknowledges and understands that this Release is a legally binding instrument. Volunteer further acknowledges that they have the right to have this Release reviewed by an attorney before signing below. By signing this Release, Volunteer acknowledges reading this Release and fully understanding the meaning of this Release and all implications.
