  • TERMS AND CONDITIONS OVERVIEW:

    Central Coast Hypnobirth ABN: 94 491 242 800 Terms and Conditions - Central Coast Hypnobirth Exhibition 1. Definitions: Authorities: Commonwealth of Australia, State Governments, statutory and local authorities, Exhibition Venue lessor/operator. Contract: Agreement outlined in clause 2.3.Contract Fee: Total Space Cost in Vendor Application (incl. GST).Deposit: Portion of Contract Fee listed as Deposit in Vendor Application. Force Majeure: Events beyond Organiser's control, like natural disasters. Insurance Fee: Fee for public risk/product liability insurance by Organiser. Withdrawal Fee: Fee outlined in clause 15 for Exhibitor withdrawal.2. Application for Space: Application via Vendor Application; acceptance by signing, written notification, or invoice. Vendor Application is a binding contract upon acceptance, subject to terms.3. Space Allocation: Exhibitor granted a license for Space use, not a tenancy. Organiser reserves right to alter floor plan; adjusts Contract Fee if Space size reduces.4. Exhibits: Exhibits must align with Exhibition profile and products specified in Vendor Application. Exhibitor responsible for stocking and staffing their Space throughout the Exhibition.5. Retail Sales: Permitted during public Exhibition or at Organiser's discretion.6. Conduct and Canvassing: Exhibitors must act responsibly; no nuisance to others. Canvassing or distributing promotional material only from the Exhibitor's stand.7. Subletting: No sub-licensing or assignment without written permission from Organiser.8. Compliance with Regulations: Exhibitor must comply with fire, safety, health, and other laws, Rules & Regulations, and Organiser's policies. Group stand participants must comply individually.9. Stand Limits: No extension beyond allotted dimensions; maximum height of 2.5 meters without Organiser's permission.10. Insurance: Exhibitor must hold Public and Property Liability Policy with a minimum $10 Million coverage. General property and employer's liability insurance required for Bump-in to Bump-out period.11. Terms of Payment: Deposit payable by specified date; balance by Due Date in Vendor Application. Early Bird rates if payments by due dates; surcharges may apply for credit card payments.12. Termination by Organiser: Termination for breach of essential terms; immediate if Exhibition started, else 3 business days' notice. Termination for non-payment allows re-letting of Space with damages as Withdrawal Fee. Termination for bringing disrepute, adverse publicity, insolvency, or Force Majeure event.13. Withdrawal of Exhibitor: Exhibitor forfeits Deposit upon withdrawal. Withdrawal Fee of $550 applicable; reasonable pre-estimate of Organiser's loss. Withdrawal notice must be in writing.14. Exclusion of Liability: Organiser not liable for visitor numbers, outcomes, or information accuracy. No liability for restrictions, location issues, service failures, changes by Authorities, or Force Majeure. Exhibitor releases Organiser from liability for loss or damage.15. GST: Amounts exclusive of GST; recipient pays GST for taxable supply.16. Acknowledgment: Exhibitor acknowledges agreement through signature, electronic acceptance, payment, or participation.17. Severability: Unenforceable provisions severed; rest of Agreement remains in force.18. Governing Laws: NSW laws apply; disputes heard in NSW.19. Privacy: Exhibitor contact details may be shared with approved service providers for direct marketing. Organiser complies with privacy laws; Exhibitor agrees to obtain consent for direct marketing.
