Welcome to the Foodees Food and Culture Festival
Thank you for joining us as a vendor at our vibrant event in Shelby, NC. This document outlines our mutual obligations and expectations to guarantee a successful, enjoyable experience for vendors, participants, and attendees alike.
Event Overview
The Foodees Food and Culture Festival, hosted at Cleveland County Fairgrounds, is a dynamic celebration of diverse cuisines, artisan crafts, and rich cultural expressions designed to unify and delight our community. We aim to provide a memorable platform for both new and established vendors to connect with a wide audience in an atmosphere of celebration and discovery.
Vendor Participation
Upon your selection, we will allocate a specific area tailored to accommodate your setup needs, ensuring you have the necessary space to engage effectively with festivalgoers. Please be prepared to supply any required utilities, including power and water, as well as all equipment necessary for your operation.
ALL food prices must be transparent and posted with visibility to customers. Any vendor caught “price gouging” or changing prices from one customer to the next will be asked to leave. No warnings or refunds will be given.
ALL vendors must submit a full list of items or merchandise to be sold at each event. Once your menu or products have been approved, you are not permitted to sell any additional items. This helps eliminate over saturation of the same items at events. Any vendor caught selling “unapproved” items will be asked to leave the event.
NO vendor is permitted to sell alcohol at an event without prior approval from Foodees.
ANY vendor that violates any of these agreements for any reason will be asked to leave and result in termination for ALL future Foodees events. Refunds will not be issued.
Any vendor preparing food on site agrees to provide an additional 10x10 tent, tables and chairs for patrons to sit and eat at the food station. All vendors preparing food will be required to provide their own waste recepticle. This will be for food waste, and all food waste will be disposed of in mass waste dumpsters by the vendor. Food waste, bulk food packaging, and any other vendor related waste items that Foodees staff disposes of will result in loss of deposit and/or a $100.00 fee.
Financial Commitment
Your participation fee secures your designated spot at the festival and contributes to the event's operational costs. This fee varies based on the nature and size of your vendor space and is payable upon acceptance of this agreement. Please note, this fee is non-refundable except in the case of a full event cancellation by Foodees, LLC.
Rescheduling vs. Cancellation
The festival is designed to proceed regardless of weather conditions. Should a reschedule be necessary, this action does not constitute a cancellation. Refunds are only provided if the entire event is canceled by Foodees, LLC, ensuring equity and clarity in our refund policy.
Licensing and Permits
All vendors must comply with health and safety standards, holding appropriate licenses and permits for their operations. All vendors participating regularly in Foodees events should obtain a retail license by the state of participation. This means obtaining a retail license for each state that Foodees events are held in NC, SC, GA, TN & AL.
Timing and Scheduling
Timely setup is essential for a seamless event start. Failure to meet the designated load-in schedule will result in the loss of your space and forfeiture of your fee. Any vendor that is late for any reason, unless it’s a true emergency, will be asked to leave and will not be allowed to participate in the event. This policy underscores the importance of coordination and punctuality in facilitating a well-organized event opening.
Operational Compliance
Maintaining the highest standards of operation is crucial. This includes ensuring cleanliness, observing safety protocols, and adhering to all regulatory requirements. Vendors will be subject to inspections each morning by Foodees staff to verify compliance with these standards, in addition to any city, state, or federal inspections. All vendors should clean and organize their space before leaving the event site each day. No food, condiments or trash should be left out overnight.
Cleanup and Environmental Responsibility
Vendors are expected to leave their area in the same condition as found upon arrival. This entails:
A $100 deposit will be collected from each food truck and tented food vendor upon arrival of event.
All food waste and trash should be placed in the designated dumpster on site. All cardboard should be broken down and placed in the designated dumpster on site.
No vendors should leave bags of trash anywhere on the event grounds, this includes vendor area or by Foodees trash cans in center of event.
All trash is to be discarded only in designated dumpsters.
A Foodees staff member will check your area Sunday night and must sign off for you to leave event.
Deposit will be returned if your area is cleaned. If you leave the event early you will forfeit your deposit.
If your area is not left the way you found it, this will result in loss of $100 deposit and removal from participation in future events.
Acknowledgment and Agreement
By signing below, the undersigned vendor hereby acknowledges and agrees to the following terms as a condition for participating in the Foodees Food and Culture Festival:
Deposit: Vendor agrees to a deposit of $100.00, collected upon arrival of event. This deposit is intended to ensure compliance with the cleanup and environmental responsibility requirements set forth in the festival guidelines. It is refundable post-event, provided the Vendor has adhered to all specified cleanup standards and no damage has been caused to the festival premises by the Vendor's operations.
Daily Inspections: Vendor acknowledges that Foodees, LLC will conduct daily inspections of all food trucks and tented food vendors to ensure the cleanliness and safety of the food preparation, storage, and serving areas. These inspections are designed to verify compliance with local health and safety regulations and to uphold the festival’s ambitious standards for food safety and vendor operations.
Cleanliness and Safety Compliance: Vendor commits to maintaining the highest standards of cleanliness and safety within their food truck or tented area throughout the duration of the festival. This includes, but is not limited to, proper waste disposal, adherence to food safety practices, and ensuring all equipment and serving areas are kept clean and in good working order.
Regulatory Compliance: Vendor agrees to comply with all applicable federal, state, and local laws, ordinances, and regulations related to food preparation, handling, and sales. This includes obtaining and displaying any necessary permits or licenses required for operation within the jurisdiction of the festival location.
Indemnification: Vendor agrees to indemnify and hold harmless Foodees, LLC, its directors, officers, employees, volunteers, and agents from any claims, damages, losses, liability, or expenses, including attorney's fees, arising out of or in connection with the Vendor's participation in the festival, including but not limited to, any violation of health and safety standards or any injury or damage caused by the Vendor's operations.
Agreement to Terms: By signing this agreement, Vendor confirms they have read, understood, and agreed to all terms and conditions outlined in this and all other sections of the Vendor contract for the Foodees Food and Culture Festival. The vendor acknowledges that failure to comply with these terms may result in removal from the festival and forfeiture of the deposit without refund.
VENDOR FEES:
In addition to the vendor fee, an invoice will include North Carolina state tax, and a 4% processing fee.

10X10: $150.00
Trailor (10x20): $300.00
Additional 10X10 Space: $100.00
TENTED FOOD VENDORS:
10X10: $200.00
Additional 10X10 Space: $100.00
FOOD TRUCKS, FOOD TRAILER, and RESTAURANT:
10X20: $300.00
10X30: $350.00
10X40: $400.00
If additional space is required, each 10 foot space will be charged as a tented food vendor space.
