    1. General
    1.1 These Terms and Conditions, together with the Enrolment Form to which they are attached, must be completed in full.
    2. Definitions
    In these Terms and Conditions: 2.1 “We”, “Us” or “Our” refers to Dance Mouse, its employees and agents. 2.2 “You” or “Your” refers to the Dancer’s parent/guardian or the person responsible for payment and who has accepted these Terms and Conditions. 2.3 “Dancer” refers to the student listed on the Enrolment Form. 2.4 “Consumer Protection Act” refers to the Consumer Protection Act, 68 of 2008.
    3. Duration
    3.1 This agreement commences upon submission of the Enrolment Form and remains valid for the year indicated, whether the Dancer attends classes or not. 3.2 Annual fees (34 lessons) are divided into 10 equal instalments (February–November). Monthly instalments are not calculated per lessons danced in that month. 3.3 Enrolment is valid for the current year only. Re-enrolment is required annually.
    4. Payment
    4.1 An annual, non-refundable enrolment fee is payable. 4.2 All enrolment and monthly fees will be confirmed in writing prior to enrolment and are available on the DMC Joburg website. 4.3 The enrolment fee must be paid in advance by all students. 4.4 Upon payment of the enrolment fee, the Dancer’s water bottle will be ordered and issued once all fees for that month are paid in full. 4.5 Fees are subject to an annual increase of 10%. 4.6 Monthly fees are payable in advance via EFT by no later than the 7th of each month. 4.7 Proof of payment must be sent via email or WhatsApp/SMS. Failure to do so will be regarded as non-payment. 4.8 Where cash payments are accepted, an envelope will be provided to the Dancer.
    5. Our Obligations
    5.1 Dance training may include: Ballet Basics, Modern Basics, Body Conditioning, Pilates Technique, Proprioception Skills Programme, and Silk Training. 5.2 Dance genres introduced may include: Modern, Freestyle, Hip Hop, Rock ’n Roll, Latin American Basics, Break Dancing Basics, Tap, and Cheerleading.
    5.3 We aim to teach Dancers how to protect, strengthen, and stretch their bodies while developing body awareness. 5.4 We strive to provide a supportive environment that encourages enjoyment, expression, development, and injury prevention. 5.5 Instructors receive ongoing training, and the syllabus is reviewed and updated every second year. 5.6 Parents will be informed of assessments and fun days. 5.7 Communication will be via email and WhatsApp. It is your responsibility to keep your contact details updated.
    6. Services
    6.1 Dance Mouse is not responsible for third-party orders (e.g. DVDs or photographs) made at performances. 6.2 Incorrect names on certificates will not be changed after the deadline. 6.3 Dancers who miss more than five (5) lessons may be excluded from festivals.
    7. Costs and Legal Fees
    7.1 Should payment default occur and a debt collector be appointed, you will be liable for all legally recoverable fees, including tracing fees and collection commission (maximum 10% as prescribed by law). 7.2 Should an attorney be appointed, you will be liable for legal costs on an attorney and own-client scale, including tracing fees and collection commission (subject to statutory limits). 7.3 Payments received will be allocated first to costs, then interest, and lastly to the outstanding capital amount.
    8. Jurisdiction
    8.1 You consent to the jurisdiction of the Magistrate’s Court, without limiting either party’s right to approach the High Court where applicable.
    9. Breach
    9.1 Failure to pay fees before the start of the month may result in classes being withheld until the account is settled. 9.2 You acknowledge full responsibility for your account, independent of any medical aid. 9.3 Accounts outstanding for more than 30 days will be handed over for legal collection. 9.4 You will be liable for all collection and legal fees incurred.
    10. Injury and Indemnity
    10.1 Dance involves physical exertion and carries inherent risks. 10.2 Injuries may occur and may range from minor to serious. 10.3 You acknowledge awareness of potential dance-related injuries, including but not limited to strains, fractures, heat-related illness, unconsciousness, and spinal injuries. 10.4 This list is not exhaustive.
    10.5 You indemnify Dance Mouse against all claims for injury, loss, or death, except where caused by gross negligence as defined by the Consumer Protection Act.
    11. Termination
    11.1 Dance Mouse may terminate this agreement with seven (7) days’ written notice. Fees will be reimbursed pro rata for the remainder of the month. 11.2 Parents wishing to cancel must give 30 days’ written notice and complete the official cancellation link. 11.3 Failure to give sufficient notice will result in a 20% penalty fee on the outstanding amount.
    12. Notice
    12.1 Accounts placed on notice and later reactivated will continue as normal, provided all fees are up to date.
    13. Assessments (Showcase)
    13.1 Assessments are held annually in November. Dancers will receive a report card, medal, and certificate. 13.2 An additional assessment fee applies and is payable in instalments with monthly fees. This fee is subject to annual increases. 13.3 Public School Terms: Term 1: Jan–Mar | Term 2: Apr–Jun | Term 3: Jul–Sep | Term 4: Oct–Dec (8–9 lessons per term/block) 13.4 Private School Terms: Term 1: Jan–Apr | Term 2: May–Aug | Term 3: Sep–Dec (11–12 lessons per term/block)
    14. Attendance
    14.1 Fees are not reduced or refunded for public holidays or school holidays. 14.2 Fees are not refundable for learner absences after enrolment submission. 14.3 If an instructor is unavailable, reasonable notice will be given and the class will be rescheduled.
    15. General
    15.1 The address provided on the enrolment form shall serve as your domicilium citandi et executandi. 15.2 This agreement is governed by the laws of South Africa. 15.3 No amendment to this agreement shall be valid unless in writing and signed by both part
