I and the in behalf of the minors listed below recognize that participating in the bungy attraction may be a dangerous and hazardous activity that could result in serious bodily injury, property damage, or in extreme cases, death. I and the in behalf of the minors listed below accept that I, and the minors listed below, who I am legally authorized to provide consent for agree that I and the in behalf of the minors listed below are participating at my or our own risk

I agree to the following rules below and agree that if I am signing this agreement for myself and/or for the listed  minors below, that i am ultimately responsible to follow the rules and/or as an authorized guardian of the listed minors below abide by the rules below:

I agree that myself or represented minors agree to participate at my own risk and agree to to observe and obey all posted rules and warnings, and further agree to follow any written, signs, oral instructions or directions given by the staff of Cesar Barbin LLC. I agree that I will not engage in any horseplay or body contact with other participants while riding the bungy. I agree not to tamper with any harnesses, safety devices or other equipment. I agree that Cesar Barbin LLC does not allowany flippin action while jumping because of the danger of serious injuries that may result in permanent nerve, muscle and bone injuries.  I understand that I cannot wear loose jewelry or loose shoes while riding the bungy and Cesar Barbin LLC will not be responsible for any broken, lost or damaged items as a result of participation in bungy jumping. I understand that Cesar Barbin LLC reserves the right, in its sole discretion, to refuse to allow me adn/or my minors to participate in the bungy trampoline attraction or to terminate my participation for any cause or reason.

I specifically authorize and consent to Releases providing and/or arranging for medical care or treatment or emergency medical services or rescue efforts in the event of an emergency or in the event of an injury or medical condition that develops or occurs during participation in the Cesar Barbin LLC's bungy trampoline attraction or during my presence in or upon the premises of the bungy trampoline area.

I agree to indemnify, defend, and hold harmless against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my use of, participation in bungy jumping activity or presence upon the facilities of Cesar Barbin LLC located in La Plaza Mall Mcallen Texas

RELEASE AND WAIVER OF LIABILITY 

This agreement constitutes an express and contractual assumption of all risks and dangers associated with the bungy attraction provided by Cesar Barbin LLC, which include, but are not limited to, the risk of permanent disability, paralysis, trips, falls, broken bones, muscle pulls and strains, lacerations, abrasions, torn ligaments and tendons, head injuries, injuries caused by adverse weather conditions and imperfect conditions, collisions with other participants, spectators and/or officials, and injuries caused by equipment failure, equipment misuse or operator error.

In consideration of the bungy trampoline activity that Cesar Barbin LLC has agreed to provide to me and/or participants listed below, I assume the full risk and responsibility for personal injury, accident, death, or property damage to myself and/and or to minors listed below and I do on behalf of the listed minors and myself and my heirs, administrators, executors, successors, and assigns, fully release and forever discharge Cesar Barbin LLC and their present employees, former employees, affiliates, parent or subsidiary entities, related entities, successors, assigns, heirs, agents, directors, board members, officers, representatives, operators, owners, and all persons acting by, under or in concert with any of them (collectively, "Releases") from any and all actions, suits, damages, judgments, executions, claims, or demands arising from any accident, death, personal injury, or property damage related to, resulting from, or in any way connected with my use of or presence on the facilities of the bungy trampoline services provided by Cesar Barbin LLC or my participation in the Bungy trampoline Attraction by Cesar Barbin LLC. I and the in behalf of the minors listed below affirm that participation in the bungy trampoline attraction is optional and that I am participating in the bungy attraction voluntarily.

Any legal or equitable claim that may arise from participation in the above shall be resolved under Texas law. I affirm that I have the authority to enter into the Release and Waiver of Liability for all individuals for whom I am purchasing tickets to the Cesar Barbin LLC Bungy Jump attraction (both minors and adults), and to bind those individuals to this Release and Waiver of Liability.

I agree to indemnify, defend, and hold harmless against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise the use of or presence upon the facilities of Cesar Barbin LLC by any individual for whom I have purchased a ticket. I affirm that all bungy participants weigh between 20- 220 lbs. and participants do not have any known medical, physical conditions, or disabilities which may interfere with safe participation in the Vertical Reality bungy attraction. If I am aware of a medical, physical condition or disability which may interfere with safe participation in the bungy attraction and I am aware of a reasonable accommodation which may accommodate me or other participants, I agree to bring the same to the attention of Cesar Barbin LLC for consideration.

Note: Individuals or minors with health concerns, certain physical disabilities, neck or shoulder problems, are pregnant, have heart trouble, seizure disorder, or problems with balance, are recommended to not participate in this activity.

I affirm that I am not under the influence of, or impaired by any drug or alcohol.

I agree that photos or videos taken of me by Vertical Reality may be used for promotional.

I affirm that I have the physical ability to safely walk up approximately three flights of stairs. I understand and agree that if any provision of this Release and Waiver of Liability is determined to be wholly or partially illegal, invalid, contrary to public policy, or unenforceable, the legality, validity, and enforceability of the remaining terms or provisions shall not be affected thereby, and said illegal, unenforceable, or invalid term or provision shall be first amended to give it/them the greatest effect allowed by law and to reflect the parties' intent. If this modification is not possible under applicable law, such term shall be deemed not to be a part of this Release and Waiver of Liability and the remainder of this Release and Waiver of Liability shall not be affected by such invalidity or unenforceability but shall remain in full force and effect.
