RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

1AFTER AN OPPORTUNITY TO BARGAIN AND IN CONSIDERATION of my child being permitted to observe or participate in recreational and educational activities offered by Renewable World Foundation, Inc. ("RWF"):

1. I agree and warrant that I have determined that participation in RWF activities is reasonably safe. I further understand that my child is expected to comply with all rules and regulations. If I have any questions, or observe any unusual or unnecessary hazards to my child, I will immediately bring the hazards to the attention of the nearest employee of RWF;

2.I HEREBY RELEASE, INDEMNIFY AND SAVE AND HOLD HARMLESS RWF, its shareholders, owners, employees, officers, directors, instructors, and agents as well as the owners and lessors of premises used to conduct the activities ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITIES, DEATH, or loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASES OR OTHERWISE, to the fullest extent permitted by Wisconsin law, and if any portion of this agreement is held invalid, I agree that the balance shall, notwithstanding, continue in full legal force and effect;

3. I acknowledge, appreciate, and agree that there is a risk of injury to my child while participating in activities offered by RWF, including the potential for serious injury including, but not limited to, permanent paralysis or death;

4. I covenant and promise not to sue and release, waive and discharge from all liability:

a. the owners or lessees of the premises upon which RWF activities are conducted as well as their agents and employees, and

b. RWF, its shareholders, owners, employees, officers, directors, instructors, and agents (collectively, the "Releasees") for any and all loss or damage and any claim or demands on account of injury or illness sustained by my child, property damage to my child's possessions, or resulting in the death of my child arising out of or related to participation in RWF activities, whether or not caused by the negligence of the Releasees including, but not limited to, claims for medical expenses, pain and suffering, loss of earning capacity, and loss of society and companionship. This agreement extends to negligent rescue, negligent transportation and/or negligent medical care in the event of an emergency; and

5. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS INCLUDING THE RISK OF BODILY INJURY, ILLNESS ORDEATH, for myself and my child, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE of those persons and entities released from liability herein, and assume full responsibility for my child's participation in activities offered by RWF.

6. I also hereby assign and grant to the Renewable World Foundation, as well as their authorized representatives, the right and permission to use and publish the photographs/film/videotapes/electronic representations and/or sound recordings made of me or my child at all RWF activities, and I hereby release RWF, the activity coordinators, and all employees, volunteers, related parties, or other organizations associated with the activity from any and all liability from such use and publication. I further authorize the reproduction, sale, copyright, exhibit, broadcast, electronic storage, and/or distribution of said photographs/film/videotapes/electronic representations and/or sound recordings without limitation at the discretion of RWF, and I specifically waive any right to any compensation I may have for any of the foregoing

 

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
