This Agreement is entered into on the date of, Today's Date*, between Gather LLC (“Gather”), and {name12} (“Customer”), concerning the cremated remains of {lovedOnes} (the “Decedent”).

WHEREAS Gather provides unique glass designed products to be filled with cremated remains as a memorial to the Decedent (the “Memorial”); and

WHEREAS, Customer desires to have Gather infuse the remains of Decedent into the glass art offered by Gather and identified as {myproducts}" />the glass product* (the “Glass Product”); and

WHEREAS, Gather agrees to fill/infuse the Glass Product selected by Customer with the remains of Decedent subject to certain terms and conditions required by Gather.

NOW THEREFORE, for good and valuable consideration Customer agrees as follows:
- Customer shall deliver to Gather a portion of Decedent’s remains (the “Remains”) in a container delivered to Customer by Gather (the “Container”).
- Customers shall ship the Remains to Gather via “Priority Mail Express” as provided by the United States Postal Service. Any Remains not used in the production process of creating the Memorial by Gather in the process of preparing the Glass Product will be thoughtfully spread in nature at our nearby farm or sea coast.
- Customer assumes all risk of loss in the event the Remains are lost in the mail and/or in the production process of the Memorial.
- Customer warrants and represents that it has the authority to arrange and direct the disposition of the Remains.
- Customer hereby authorizes Gather to deliver the Memorial to Customer via the United States Post Office.
- Customer agrees to indemnify and hold Gather harmless against and from any and all liens, damages, losses, liabilities, obligations, settlement payments, penalties, assessments, citations, directives, claims, litigation, demands, defenses, judgments, suits, proceedings, costs, disbursements or expenses of any kind or of any nature whatsoever which may at any time be imposed upon, incurred by or asserted or awarded against Gather arising directly or indirectly from any action relating to Gather’s creation and/or mailing of the Memorial.
