Burningtree Country Club
1-Year Agreement
As an applicant for a membership at Burningtree Country Club, and after having reviewed the membership information provided, I hereby agree to the following terms and conditions in this Agreement.
Membership Initiation Fee
For Full Membership, Regular (Age 40+), Junior (Age 30-39) and Junior (Age 18-29), a non-refundable fee ("the membership Initiation Fee") is required. If required, the total membership Initiation Fee for the designated membership is shown in the application as well as at the bottom of this page. Burningtree Country Club is owned by Andy Villarreal (the Owner). The Membership Initiation Fee is non-refundable.
Assumptions of Liability
Applicant understands and agrees that Applicant is assuming no liabilities whatsoever about the membership other than the payment of the sum set out above, any applicable membership dues and charges incurred by Applicant, Applicant's family and Applicant's guest in the use of the Cub and that such membership does not confer upon Applicant any ownership interest or rights of any nature of the Club property or assets, as further provided in the Membership Plan. Applicant understands that any use of the facilities at the Club by Applicant, Applicant's family or Applicant's guest is done at their own risk, and the Club, the Owner, and his employees and agents are not liable for personal injury, theft, or loss of personal property, as further provided in the Membership Plan.
Payment of Membership Account
Payment of account is due by the 10th of each month. Applicant agrees to pay the account when due. Applicant agrees that the Club may assess a late charge for past-due accounts as provided in the Membership Plan, as amended from time to time. Payments on delinquent accounts apply first to reduce the charges and accrued dues, next to food and beverages charges, then to any other charges. Applicant further agrees to have a payment pulled from your checking account by a ACH payment or by your current credit card account. If payment is not made by the 10th of each month, you give Burningtree Country Club permission to put the payment on the reserved credit card you leave on file. There will also be a 3% charge if put on the credit card (due to credit card company, not Burningtree Country Club). Applicant agrees to pay all reasonable attorneys fees, investigator fees, and costs in the event this account is turned over for collection. Applicant further agrees to keep a credit card on file that may be charged the amounts noted in accordance with the Agreement above and any additional outstanding club usage or charges.
Resignation/Transferability/Refunds
Subject to the payment in full of the Membership Initiation Fee, as applicable, Applicant may resign from the Burningtree Country Club by giving written notice to the Club. The effective date of the resignation will be thirty (30) days after the date the Club receives Applicant's written notice. All charges for which Applicant is liable are due upon the effective date of resignation. Transfers may be made soley through the Club, subject to the terms, conditions and restrictions set forth in the Membership Plan.
It is understood and agreed that there shall be only one (1) Member per membership (the Primary Member); membership shall not be issued in joint names. About any claim or dispute about the ownership of the membership, the Club shall rely on this Agreement to confirm ownership of the membership in the name of Applicant, who shall be the Primary Member. Notwithstanding the foregoing, in the event of a personal divorce, this membership is not divisible and shall be allocated by agreement of all claimants, or in the absence of an agreement, this by court order. Such allocations are subject to the sole approval of the Club. The successor to the membership shall execute all necessary papers and pay all transfer fees required by the Club.
Membership Plan/Rules and Regulations
Applicant hereby acknowledges that Applicant has received, has read, understand and agrees to the Membership Plan and the Rules and Regulations of Burningtree Country Club (the Rules and Regulations) applicable to this membership, which are incorporated herein by reference. Applicant hereby agrees that Applicant's use of the Club and privileges under the membership are subject to the terms, conditions, and restrictions set forth therein. Applicant agrees to conform to and abide by the Membership Plan and Rules and Regulations as each may be amended from time to time. The Club reserves the right in its sole and absolute discretion, to terminate membership with the Club, to discontinue operation of any or all of the Club facilities, to sell or otherwise dispose of the Club facilities in any manner subject to the terms and conditions of the Membership Plan, and to make any changes to management and/or personnel of the Club as appointed by the Owner. Applicant hereby acknowledges and agrees that the Applicant is acquiring the membership for the sole purpose of obtaining recreational use of the Club facilities, and not as an investment or for economic gain or profit. If resignation occurs before paying the 12-month dues, the applicant agrees to pay Burningtree Country Club for the full 1 year of the contract in addition to any outstanding club charges.
