This is a legally binding contract between Gretchen Robinette Photography hereafter called “Photographer” and “Client” named above. This agreement is for the sole purpose of booking and reserving the date above for Client’s Headshot Photography Session.
Cancellation: Upon signing this contract, Photographer will reserve the time agreed upon and will not make another reservation for this date. If the shoot is cancelled or postponed by the Client less than 7 days prior to the session, the nonrefundable retainer will not be returned, it being the agreed loss suffered by Photographer.
Limit of Liability: Client agrees that Photographer can only capture the photo session that happens; weather, location, schedule complications, time restraints and subject’s ability to cooperate, are all factors in the quality of the photographs. Photographer is not responsible if key individuals fail to appear or cooperate during the photography session or for missed images due to details not revealed to Photographer.
If Photographer is too ill or becomes injured and cannot supply the portrait services specified above, Photographer will make every effort to reschedule the shoot. If for any reason this is not possible, liability is limited to a refund of any payments received. In the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond Photographer’s control, liability is limited to the return of fees paid for the service. Client and their associates shall indemnify and hold harmless Gretchen Robinette Photography and her assistants from any and all claims for damages arising out of the performance of any of the services provided by the agreement.
Day of Session: Client agrees they will be dressed and ready in their first outfit, and arrive on time to the chosen location. If Client is late, time will be reduced from the session or charged under extra time herein at the discretion of Photographer. Friends and family are welcome, so long as they do not interrupt Photographer and the photography taking place.
Deliverables: A full gallery of image proofs will be delivered within 7 days following the session date. Images will be provided on a private online gallery for Client’s viewing, and downloadable for 25 days. After the files are delivered, it is Client’s sole responsibility to protect and retain their images. It is highly recommended that they be saved on an external drive. Photographer will not be responsible for storing Client images.
Delivered photo gallery proofs will receive the standard editing and retouching at the same quality and style as Photographers known work. Photographer will not edit for object removal, body reshaping, nor other physical appearance issues other than minor blemishes. Client session includes ___ high res, retouched images of their choice. If additional images require retouching adjustments, a retouching fee will be charged based on the work needed to display images at their best quality. Images will not be delivered until the photography session is paid in full.
Copyrights: Photographer retains ownership and copyrights to all images. Photographer reserves the right to utilize the images for promotional marketing, and portfolio display. Client may not alter or edit images in a way that does not represent Photographers style and work. Client agrees to provide written photo credit to Gretchen Robinette Photography for all images posted online.
For either party to add to, waive, or alter part of this agreement, it must be done so in writing, signed by both parties. The undersigned have read and understood the above contract and agree to the terms and conditions in their entirety.
