RULES FOR USING THE JETSKI IN THE DESIGNATED AREA

•THE USE OF THE LIFE JACKET IS MANDATORY.

•THE CUSTOMER WILL FOLLOW THE IDENTIFIED TOUR GUIDE TO THE STARTING POINT, WHERE HE CAN THENRUN WITHOUT OVERFLOWING THE DESIGNATED AREA MARKED WITH 4 BLUE BUOYS UNTIL THE GUIDENOTIFIES THEM BY MEANS OF A HAND SIGNAL INDICATING THAT THE TIME IS OVER ONLY THEN THEY MUSTFOLLOW HIM TO THE SHORE.

•THE MINIMUM DISTANCE TO NAVIGATE CLOSE TO SHORE WILL BE OF 100 FEET FROM THE DEMARCATED AREAFOR SWIMMERS, VIOLATING THIS RULE ENTAILS A FINE OF $100.00 DOLLARS AND CANCELLATION OF THE TRIP.

•NOT GOING BACK TO THE SHORE, THIS ALONE WILL RESULT IN A FINE OF $100 DOLLARS AND CANCELLATIONOF THE TRIP.

•THE CLIENT AGREES TO RESPECT THE RULES OF USE AND TO SIGN THE RENTAL AGREEMENT

GENERAL TERMS AND CONDITIONS OF THE CONTRACT

1.- The client claims to be over 18 years old.

2.- In case of non-compliance with the rules, the parties will submit to the competent courts.

3.- The client rents the jetski in perfect condition and conservation to the lessor, promising to return it in the same state.

4.- The client is responsible for damage to the vehicle, If the personal motor boat is flipped or sunk under any circumstance the client

will have a fine starting from $300-$10,000 and the trip will be canceled without any refund..

5.- The client is bound to the present general conditions from this very moment, having to attend, even after the return of the leased

jetski , to all the claims made by the lessee for causes derived from the lease and compliance with the provisions of this contract.

6.- The Lessor agrees to explain to the lessee before going to sea, the complete operation of the Jetski .

7.- Rent is prohibited for those who are under the influence of LEGAL AND ILEGAL drugs and alcohol.

8.- Our policy is No Refund, all rent, sell and reservation are finals. But in the case of booking the Jet Ski you can cancel with a

minimum of seven (7) working days so that neither party is affected. If you request a refund in less than 7 days this will be denied.

9.- If the lessee does not obey the order to follow the guide to the shore and delivers the jet ski up to 5 minutes late the renter must pay

the full 30 minutes $80 fee.

10.- A photo ID of the person renting and using the water motor vehicle will be required, this will be delivered after the end of the

ride.

11.-The lessee recognizes and relieves HydroVenture, New Adventure Water Sport Rental, and all its work team from all

responsibility.

13.- The lessee must arrive 30 minutes before the time estipulase to receive a orientation in case they don't show up the trip is going to

be cancel and no refund will be allowed.

$300 DOLLARS HOLD ITS REQUIRED IN ORDER TO PARTICIPATE! WE  WILL CHARGE A DEPOSIT OF $300.00 DOLLARS WHICH WILL BE RETURNED AT THE END OF THE TOUR.

To avoid capzise (Flip Over the Jetski) it is important that if you are going to fall, let yourself go and do not hold on to the handle bar of the Jetski. This will help to avoid getting hit with it.

 If you let go from the jet ski this will turn off and if you need help to climb back the patrol will assist you.

MANAGEMENT OF THE WATERCRAFT (JETSKI)

• Always climbs up the back of the jet ski.

• The key must be attached to the life vest at all times, this will make the jetski turn off automatically in case of an

emergency (fall into the water).

• The right hand trigger is the throttle.

• Keep arms and legs inside the vehicle at all times.

• Do not be near the jet ski or get off it while it is on.

• You will not be able to make sharps turns, run in excess of 30 mph, or perform maneuvers that endanger your life or

that of other participants. Violating this rule will lead to being removed from the activity.

• The watercraft will have a whistle, a flare and a fire extinguisher.

CONDITION AND RELEASE

• BY THIS MEANS I (CLIENT) IN FULL WELL-BEING OF MY MENTAL FACULTIES ASSUME AND REMOVE ALL LIABILITY FROM NEW ADVENTURE WATER SPORT RENTAL, HYDROVENTURE PRESIDENT AND OFFICIALS FOR ANY ACCIDENT THAT OCCURS TO ME WHILE USING ANY OF YOUR AQUATIC MOTOR VEHICLES OR IN THE WATER.

• I (CLIENT) AUTHORIZE NEW ADVENTURE WATER SPORT RENTAL , HYDROVENTURE TO USE OUR PICTURE AND VIDEO TAKEN BY THEM OR BY OURSELF FOR ANY KIND OF PROMO PHYSICAL OR DIGITAL.

• I (CLIENT) CERTIFY THAT I HAVE BEEN INSTRUCTED WITH THE NECESSARY RULES TO SAFELY OPERATE THE WATER MOTOR VEHICLE.AT ALL TIMES I WILL OBEY THE GUIDE AND FOLLOW ITS INSTRUCTIONS TO LEAVE FOR THE ASSIGNED AREA TO RUN AND FOLLOW IT BACK TO SHORE.

• I (CLIENT) ASSUME RESPONSIBILITY AND AUTHORIZE TO DEBIT MY CREDIT CARD THE AMOUNT THAT THE COMPANY EXPERT UNDERSTAND BASED IN THEIR EXPERIENCE IF THE RENTED JETSKI FLIPS OVER, GET SUNK OR GET ANY KIND OF DAMAGE. I SWEAR I WILL PAY TO NEW ADVENTURE WATER SPORT RENTAL THE STARTING SUM OF $300 - $10,000 FOR FLIPPING THE JETSKI AND/OR CAUSE DAMAGES TO THE BODY.

WE ALL AGREE WITH THE AGREEMENTS DISCUSSED IN THIS CONTRACT

PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK

In consideration of the services of New Adventure Water Sports Rental Inc. DBA Hydroventure, their agents, owners, officers, volunteers, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "NAWS"), I hereby agree to release, indemnify, and discharge NAWS, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows: 1.I acknowledge that my participation in jet ski tours and personal watercraft activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: slips and falls; accidental drowning; boat or watercraft may capsize and cause entrapment; collision with objects or other watercraft; rapidly changing adverse weather and water conditions; changing water flow, tides, shallow water, currents, wave action and ships' wakes; watercraft is slippery when wet and accidents can occur getting in or out; exposure to the elements of the outdoors and natural surroundings which could cause cold water shock, hypothermia, hyperthermia (heat related illnesses), heat exhaustion, sunburn, or dehydration; exposure to potentially dangerous wild animals, insect bites, and hazardous plant life; aggressive and/or poisonous marine life; passengers can be jolted, jarred, bounced, thrown about and otherwise shaken during rides; passengers can be thrown off the machine resulting in strains, sprains, broken bones and musculoskeletal injuries including head, neck, and back injuries; cuts, abrasions, and bruises; the negligence of participants, or other persons who may be present; transmissible pathogen or disease; equipment failure or operator error; flipping over the machine; accidents or illness can occur in remote places without medical facilities; my own physical condition, and the physical exertion associated with this activity. 2.I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. Additionally, I agree to wear a U.S. Coast Guard approved personal flotation device (life jacket) and wetsuit bottom (or clothing that provides equivalent protection) while participating in this activity. 3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless NAWS from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of NAWS's equipment orfacilities, including any such claims which allege negligent acts or omissions of NAWS. 4.Should NAWS or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. 5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have. 6. In the event that I file a lawsuit against NAWS, I agree to do SO solely in the commonwealth of Puerto Rico, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, may be found by a court of law to have waived my right to maintain a lawsuit against NAWS on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at NAWS. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.

PARENT'S OR GUARDIAN'S ADDITIONAL INDEMNIFICATION

(Must be completed for participants under the age of 18)

PROTECTIVE WETSUIT REFUSAL AGREEMENT

I, for myself and/or on behalf of my child or legal ward, have been fully warned and advised by New Adventure Water Sport Rental LLC, (hereinafter collectively referred to as "NAWS"), that we should purchase and/or wear a properly fitted wetsuit bottoms or clothing that provides equivalent protection while riding or being around WaveRunners and Jet Skis in order to protect against injuries caused by water forced into body cavities as a result of falling into the water or being near the jet thrust nozzle. Injuries include water forced into the rectum or vagina causing severe internal injuries or death. I understand that by not wearing wetsuit bottoms or equivalent clothing, I will be going against manufacturers' requirements and putting myself at risk for injuries. I realize that I am subject to injury from this activity and that no form of preplanning can remove all of the danger to which we are exposing ourselves. Against the advice of NAWS, the guide/instructor, numerous court cases and NAWS's insurance company, we are refusing this critical safety precaution.

I/we the undersigned have read the foregoing statement carefully before signing and do understand its warnings and assumption of risks.

• EL USO DEL CHALECO SALVAVIDAS ES OBLIGATORIO
• EL CLIENTE SEGUIRÁ AL GUÍA TURÍSTICO IDENTIFICADO HASTA EL PUNTO DE PARTIDA, DONDE PUEDE CORRER SIN DESBORDAR EL ÁREA DESIGNADA MARCADA CON TRES BOYAS AZULES HASTA QUE EL GUÍA LES NOTIFIQUE POR MEDIO DE UNA SEÑAL DE MANO QUE INDICA QUE EL TIEMPO HA TERMINADO Y QUE DEBEN SEGUIRLO HASTA LA ORILLA.
• NAVEGAR A UNA DISTANCIA MÍNIMA DE 150 PIES DEL ÁREA DEMARCADA PARA LOS NADADORES, VIOLANDO ESTA REGLA IMPLICA UNA TARIFA DE 200 DÓLARES.
• NO VUELVAS SOLO A LA ORILLA, ESTO RESULTARÁ EN UNA MULTA DE 200 DÓLARES.
• NO HAGAS ACROBACIAS NI CORRAS SIN IMPRUDENCIAS. EL CLIENTE ACEPTA RESPETAR LAS REGLAS DE USO Y FIRMAR EL

TÉRMINOS Y CONDICIONES GENERALES DEL CONTRATO

• El CLIENTE debe llegar 30 minutos antes de la hora estipulada para recibir una orientación en caso de que no se presente, el viaje se cancelará y no se permitirá ningún reembolso.
• El CLIENTE afirma ser mayor de 18 años.
• En caso de incumplimiento de las normas, las partes se someterán a los tribunales competentes.
• El CLIENTE nos autoriza a utilizar las fotos y vídeos tomados en el Tour con fines promocionales en las redes sociales.
• La navegación fuera del circuito destinada al alquiler está prohibida. Se requiere una distancia mínima de 100 metros de otra moto acuática.
• El CLIENTE alquila la moto de agua en perfectas condiciones y conservación a New Adventure Water Sport Rental y promete devolverla en el mismo estado.
• El CLIENTE es responsable de los daños a la moto de agua del nuevo alquiler de deportes acuáticos de aventura, otras embarcaciones de la compañía o personales que viajan en la zona.
• Las averías o daños de cualquier tipo debido a la negligencia del cliente no están incluidos en el precio de la tarifa.
• Si la embarcación (jetski) se voltea o se hunde, se le multará entre 300 y 10.000 dólares y se cancelará el viaje.
•  El CLIENTE está obligado a las condiciones generales actuales a partirde este mismo momento, teniendo que atender, incluso después de ladevolución del Jetski arrendado, a todas las reclamaciones presentadaspor el arrendatario por causas derivadas del arrendamiento y elcumplimiento de las disposiciones de este contrato.
• New Adventure Water Sport Rental acepta explicar al CLIENTE, antesde ir al mar, el funcionamiento completo del barco.
• El alquiler está prohibido para aquellos que están bajo la influencia dedrogas y alcohol LEGALES E ILEGALES.
• Si el CLIENTE no obedece la orden de seguir a la guía a la orilla yentrega la moto de agua con hasta 5 minutos de retraso, el arrendadordebe pagar una carrera completa de 30 minutos.
• Se requerirá una identificación con foto de la persona que alquila y usala moto de agua, esta se entregará después del final del viaje.
• El CLIENTE reconoce y libera a HydroVenture, New Adventure WaterSport Rental y a todo su equipo de trabajo de toda responsabilidad.
• Nuestra política es de no reembolso, todos los alquileres, ventas yreservas son definitivos.
• En el caso de reservar el Jet Ski, puede cancelar con un mínimo desiete (7) días hábiles para que ninguna de las partes se vea afectada.
• Si solicita un reembolso en menos de 7 días, se le negará

MANEJO DE LA MOTORA ACUÁTICA (JETSKI)

• Sube desde la parte trasera de la moto de agua.
• La llave debe estar unida al chaleco salvavidas o a la mano en todomomento, esto hará que la embarcación se apague automáticamente en caso de emergencia (caída al agua).
• El gatillo de la mano derecha es el acelerador.
• Mantenga los brazos y las piernas dentro del vehículo en todo
• No te acerques a la moto de agua de otros ni te bajes mientras está encendido.
• No podrás hacer giros bruscos, correr a más de 30 mph o realizar maniobras que pongan en peligro tu vida o la de otros participantes. Violar esta regla dará lugar a ser eliminado de la actividad sin reembolso.
• La embarcación tendrá un silbato, una llamarada y un extintor de incendios para emergencias en el almacenamiento frontal de la moto de agua.

ACUERDO DE PARTICIPANTE, LIBERACION Y ASUNCIÓN DE RIESGO

En consideración a los servicios de New Adventure Water Sports Rental Inc. DBA Hydroventure, sus agentes, propietarios, voluntarios, empleados, y todas las demás personas o entidades que actúen en cualquier capacidad bajo su nombre (en lo sucesivo, colectivamente referido como a "NAWS"), por este medio acepto liberar, indemnizar y despedir a NAWS, en mi nombre, mis hijos, mis padres, mis herederos, cesionarios, representante personal y patrimonio de la siguiente manera: 1.Reconozco que mi participación en actividades de jet ski y tours en motos acuáticas implica riesgos conocidos e imprevistos que podrían resultar en lesiones físicas o emocionales, parálisis, muerte o daños a mí mismo, a la propiedad y a terceros. Entiendo que tales riesgos simplemente no pueden eliminarse sin arriesgar las cualidades esenciales de la actividad. Estos riesgos incluyen, pero por ningún motivo están limitados a: corrientes marinas y condiciones de marea; peligro acuático; ahogamiento accidental; resbalones y caídas; ser volteado en el equipo; colisión con objetos u otras embarcaciones marítimas; olas, vientos fuertes, y condiciones climáticas extremas que cambian rápidamente; exposición a los elementos del aire libre que podría exponerme a agua fría, hipotermia, hipertermia (lesiones relacionadas con calor), agotamiento, quemaduras solares, y deshidratación; exposición a animales salvajes potencialmente peligrosos, picaduras de insectos y vida vegetal peligrosa; vida marina agresiva y/o venenosa; los pasajeros pueden ser arrojados de la maquina resultando en lesiones musculoesqueléticas, incluyendo lesiones en la cabeza, cuello y espalda; la negligencia de otros participantes u otras personas que pueden estar presentes; patógeno o enfermedad transmisible; falla del equipo; o error del operador; mi propia condición física y el esfuerzo físico asociado con esta actividad. 2. Acepto y prometo expresamente aceptar y asumir todos los riesgos existentes en esta actividad. Mi participación en esta actividad es puramente voluntaria, y elijo participar a pesar de los riesgos. Además, acepto usar un chaleco salvavidas y traje neopreno (o ropa que brinda protección equivalente) mientras participo en esta actividad. 3.Por la presente libero voluntariamente, descargo para siempre y acepto indemnizar y eximir de responsabilidad a NAWS de cualquier y todos los reclamos, demandas o causas de acción, que de alguna manera estén relacionadas con mi participación en esta actividad o mi uso del equipo o instalaciones de NAWS, incluyendo cualquier reclamo que alegue actos u omisiones negligentes de NAWS. 4. En caso de que NAWS, o cualquier persona que actúe en su nombre deba incurrir en honorarios y costos de abogados para hacer cumplir este acuerdo, acepto indemnizarlos y mantenerlos indemnes de todos esos honorarios y costos. 5.Certifico que tengo un seguro adecuado para cubrir cualquier lesión o daño que pueda causar o sufrir mientas participo, o de lo contrario acepto asumir los costos de dicha lesión o daño. Además, certifico que estoy dispuesto a asumir el riesgo de cualquier condición médica o física que pueda tener. 6.En el caso de que presente una demanda contra NAWS, acepto hacerlo únicamente en Puerto Rico, y además acepto que la ley sustantiva de ese estado se aplicará en esa acción sin tener en cuenta las reglas de conflicto de ese estado. Estoy de acuerdo en que, si se determina que alguna parte de este acuerdo es inaplicable, el documento restante permanecerá en pleno vigor y efecto. Al firmar este documento, reconozco que, si alguien se lastima o se daña la propiedad durante mi participación en esta actividad, un tribunal de justicia puede declarar que he renunciado mi derecho a mantener una demanda contra NAWS sobre la base de cualquier reclamo que les he publicado aquí. También acepto que este documento es válido para visitas posteriores y participación en NAWS. He tenido suficiente oportunidad de leer este documento completo. Lo he leído y entendido, y acepto estar sujeto a sus términos.

INDEMNIZACIÓN ADICIONAL DE PADRES O GUARDIANES

(Es necesario llenar para participantes menores de 18 años Teniendo en cuenta que NAWS permite que (escriba el nombre del menor) de los menores o menor impreso) participe en sus actividades y utilice sus equipos e instalaciones, acepto indemnizar y eximirde responsabilidad a NAWS de todas y cada una de las reclamaciones presentadas por o en nombre del menor, y que estén de alguna manera relacionadas con dichos usos o la participación del menor. ACUERDO DE RECHAZO DE TRAJE PROTECTIVO

New Adventure Water Sports Rental Inc. DBA Hydroventure (en lo sucesivo referido como a "NAWS"), me ha advertido y aconsejado completamente que debo comprar y / o usar una parte inferior de traje neopreno protectivo o equipo que proporcione protección al estar alrededor de WaveRunners y Jet Skis contra las lesiones causadas por la intrusión de agua forzada en las cavidades corporales como resultado de caer al agua o estar cerca de la boquilla. Las lesiones incluyen agua forzada hacia el recto o vagina causando lesiones internas graves. Entiendo que alno usar traje neopreno protectivo o equipo protectivo equivalente, estaré en contra de las recomendaciones de los fabricantes y me pondré en riesgo de lesiones. Entiendo que estoy sujeto a lesiones por esta actividad y que ninguna forma de planificación previa puede eliminar todo el peligro al que nos estamos exponiendo. Contra el consejo de NAWS, el guía / instructor, números casos judiciales y la compañía de seguros de NAWS, estamos rechazando esta prevención critica de seguridad.

Yo / nosotros, los abajo firmantes, hemos leído atentamente la declaración anterior antes de firmar y entiendo sus advertencias y riesgos.
