Please read the following information:
All projects will need a deposit of 40% NON-refundable fee one week prior to the event. This is due to paying dancers for their rehearsal and scheduling time.
The Client hereby agrees that all payment must be issued to Elemental Studios, in the total amount of $[TotalBalance] for the Services.
If any invoice is not paid when due, interest will be added to and payable on all overdue amounts at $20 per day, or the maximum percentage allowed under applicable laws, whichever is less. Client shall pay all costs of collection, including without limitation.
CANCELLATION POLICY. Cancellation of this Contract by Client which is received in writing more than 72 hours prior to the event date, will result in a refund of 60% any monies paid. Cancellation of Services received less than 72 hours prior to Client’s event obligates Client to make full remaining payment of the total fees agreed upon. If cancellation is initiated by Elemental Studios all monies paid to Elemental Studios from Client shall be fully refunded including retainer fee. Any refund shall be paid out at month’s end. The following terms and conditions shall apply to any cancellation made by either party:
Elemental Studios reserves the right to cancel the performance IF 90 minutes is passed AFTER call time and the dancers have NOT gone on yet. In addition, the right to cancel the performance due to delay of the performance for a sufficient time to correct problems, if, in its sole discretion, the performance area is inadequate or dangerous, if weather conditions make performance dangerous or damaging to equipment and Client has not provided adequate shelter, or if Client has otherwise failed to meet the terms of this Contract. If cancellation or delay of performance by performer is due to Client’s failure to meet the terms of this Contract, including failure to provide adequate protection from weather conditions, then payment of the Performance Fee in full will still be due.
If a performer is unable to meet the terms of this contract due to unforeseen problems, Elemental Studios will make every attempt to replace said performer with a similar act of equal talent. If cancellation is due to performer’s failure to meet the terms of this Contract, then the Performance Fee will not be due, and Bad B!sh Club.CO will refund the Booking Fee to Customer. If cancellation is due to performer’s failure to meet the terms of this Contract for unforeseeable reasons beyond the performer’s control, then refund of the Booking Fee will be the Customer’s sole remedy, and performer will not be liable for any direct, indirect, consequential or incidental damages.
MEDIA. The Client hereby grants full permission to Elemental Studios to use without further notification, authorization or compensation any photographs, videotapes, motion pictures, recordings, or other record of the Services in any and all media, whether now known or hereafter to become known, worldwide and in perpetuity, and Client represents and warrants that no further permission is required for Bad B!sh Club.CO to use the Services as provided herein.
HOLD HARMLESS AGREEMENT. Client hereby releases and holds harmless Elemental Studios, and their respective parents, subsidiaries, affiliates, from and against any and all claims, causes of action, or demands relating to or arising out of Elemental Studios, and further agree to indemnify Elemental Studios for any claims, damages or causes of action relating to or arising out of the Services. Client understands all risk of injury relating to or arising out of the Service.
