RENTER (or hereinafter called “Renter”.)

The vehicle owner hereby agrees to rent a car

INSURANCE

The Renter will have full coverage insurance for the duration of the rental agreement with policy coverage listed below. Proof of insurance must be provided prior to receiving vehicle.

$5,000 Medical Payments each person

$500 Comprehensive / Collision Deductible

DEPOSIT

The Renter understands that their deposit will be used in the event of loss of and/ or damage to the vehicle during the term of this agreement, for any additional fees/ charges associated as outlined in this rental agreement or for any fees associated with a breach of this contract.

VEHICLE RETURN

We are very flexible about vehicle return. But once we have made a return appointment, we need to stick to it. There will be 15-minute grace period with your scheduled return time, after which you will be charged a late fee. Late fees are billed against your deposit at the rate of $45 per 15 minutes.

BOOKING CANCELLATION FEES

We offer a 48-hour grace period after you make your reservation to make changes to or cancel your reservation, after which there will be a cancellation fee of 50% of the total rental cost if your change is outside of 7 days of your rental date.

If you cancel or reschedule inside 7 calendar days of your rental (or are a no-show at the time of rental), you will be charged a cancellation fee of 100% of the total rental cost.

MILEAGE/FUEL/MVR FEES/TIRES

The mileage allowed in your rental is reflected in the rental pricing table. All additional mileage charges are billed out of your security deposit.

Vehicles not returned with a full tank of gas will be charged $6.00 per gallon used to
refuel the vehicle to full plus a $75 surcharge for fueling. However, when you do gas up, all vehicles must be refueled with Premium grade (93+ octane) gasoline. There is a $350 fee for filling up with a lesser grade. And yes, we will check.

We reserve the right to refuse rental based off of any unacceptable conditions found on the renter’s MVR.

If the tires loose more than 2/32 of their tread during any rental duration less than a
month, the renter will be charged a $350 excess tire abuse fee. If the vehicle is smoked in during the time of rental, the renter will be charged a $250 cleaning fee. If the car is not returned without a clean interior (as presented upon consummation of rental agreement), there will be a $150 cleaning fee assessed plus the cost of any damages to the interior.

TICKETS

The renter is responsible for all parking, traffic, speeding or other tickets or violations
issued while the vehicle is being rented and must pay for any fees, penalties, towing
charges, or impound costs. In the event a ticket is charged after the rental period is
over (ie. Video camera surveillance, airplane patrol), we will charge the full amount of the assessed ticket plus a $75 processing fee to the credit card we have on-file.

Your rental reservation will not be confirmed until the Rental Agreement is fully executed and your initial invoice, including security deposit, is paid in-full. Your valid driver’s license AND proof of insurance must be emailed to support@SelectCarCleveland.com.

ADDITIONAL CONDITIONS

The Renter agrees (a) that the vehicle will not be driven by any other person than the renter. (b) The vehicle shall not be used for; any illegal purposes; in any illegal or reckless manner. (c) The renter shall not remove any accessory from the car. (d) Not to use the vehicle for any race or competition. (e) The renter will not take the car out of its respected state; (f) not to operate the vehicle in a negligent manner. (g) The vehicle shall not be driven by any one impaired by the use of narcotics, alcohol intoxicants, or drugs used with or without prescription. (h) Not to carry passengers, property or materials in excess of the rated weight carrying capacity of the vehicle. (i) The renter shall fully indemnify the Owner and m6 Marketing, LLC for any and all loss or damage to the vehicle, during the term of this Agreement whether caused by collision, fire, flood, vandalism, theft or any other cause, except that which shall be determined to be caused by a fault or defect of the vehicle or equipment. (j) The Renter allows m6 Marketing, LLC and Owner without limitation to collect on the renters behalf any insurance company authorized payments of any amount owed by Renter under this Agreement, (k) The Renter shall defend indemnify and hold Owner and m6 Marketing, LLC harmless from all losses, liabilities, damages injuries claims demands cost attorney fees and other expenses incurred by Owner in any manner from this rental transaction. (l) Indemnify the Owner and m6 Marketing, LLC from claims of or liabilities to third parties. The renter shall have final responsibility to Owner for all such losses. All fines, costs and attorney fees for legal violations, parking tolls, towing and storage fee’s incurred by the renter during the duration of this contract will be paid upon demand. Renter agrees that the Owner or m6 Marketing, LLC may provide Renters information to applicable authorities and/or third parties to process payment and/or transfer any such liability. m6 Marketing, LLC may charge a $350 per incident for processing payment for any of the fines, costs and/or attorney fees set forth above. The renter shall not transfer or assign this agreement and/ or lease. The renter agrees to return the vehicle in the same condition that he/she has received the vehicle in. (m) The renter will be responsible for “loss of use” of the vehicle for the duration of the repairs to the vehicle.

Renter hereby assigns to Owner and m6 Marketing, LLC Limited Power of Attorney: (A) To present insurance claims of any type to Renters insurance carrier and/or credit card company if: (1) Vehicle is damaged, lost or stolen during the Rental Period and if Renter fails to pay for any damages: (2) Any liability claims against Owner arises in connection with this rental transaction and Renter fails to defend indemnify and hold Owner and m6 Marketing, LLC harmless.

INDEMNIFICATION

m6 Marketing, LLC will not be responsible for any losses included but not limited to liabilities, damages injuries, claims, demands, attorney fees, and other expenses incurred by the renter or owner in any manner from this rental transaction, use of website or from the use of Vehicle by any person(s).

VEHICLE

The Owner represents that to the best of his knowledge and belief that said vehicle is in sound and safe condition and free of any known faults or defects that would affect its safe operation under normal use. The Renter is not responsible for mechanical breakdown that arises from the vehicle that is not caused deliberately and/or through reckless operation. If the vehicle breaks down, the renter will be responsible for delivering the vehicle back to the owner. The renter will be subject to a full refund if the vehicle was deemed unsafe from the pick-up of rental as long as m6 Marketing, LLC was notified about it at time of pick up.

I have read and agree to the Terms and Conditions. I authorize m6 Marketing, LLC to process charges on my credit card(s) and/or debit card(s) for advance deposits, holds and any incremental authorization/deposits and charges incurred as well as payments nrefused by a third party to whom billing was directed. I certify that the information that I have provided to m6 Marketing, LLC is truthful. I Certify that the driver’s license presented is currently valid and is not suspended, expired, revoked or cancelled. I certify that I possess/will possess the insurance requirements listed in this Booking Agreement.

The renter shall not transfer or assign this agreement and/or lease.
