This period allows the Village of Crete to conduct a background check to protect the Village of Crete's legitimate interest in the health, safety, and welfare of the public, preventing fraud, the privacy of its residents, the prevention of crime, and conserving Police Department resources.     The Village of Crete does not endorse, recommend, or make representations with respect to services or products, nor as to the quality to neither the products, services, publications nor the validity of the individual's claims. Therefore, solicitation on the Village's behalf is unlawful & subject to citation & a fine up to $600.

    SECTION 4. Chapter 18 (Peddlers, Solicitors, Etc.), Article III (Solicitors), Section 18-33 (Application, Fees and Duty of Solicitors) of the Village Code is hereby amended to read as follows:

    Sec. 18-33. Application, Fees, and Duty of Solicitors.

    It shall be unlawful for any person to engage in the practice of soliciting within the corporate boundaries of the Village of Crete unless that person shall have first registered with the Village Police Department and applied for & received a solicitor's permit from said Department.

    No such permit shall be issued unless & until the applicant has provided the Village with a complete application for the permit on a form to be provided by the Department & paid the applicable permit fee.  The fee for a solicitor's permit shall be $50 per day for each solicitor. The applicant must provide a valid driver's license or state-issued photo ID for each solicitor covered by the permit, & there will be a 14-day waiting period before permits will be approved by the Department.

    After approval, solicitors must provide the Department with the time(s) & date(s) that they intend to solicit.

    The Village of Crete will conduct a background investigation on all applicants.

    No license shall be issued to any person who, within five years of the date of the application: Has made a false material statement in his or her soliciting application. Has been convicted of the commission of (i) a felony, or (ii), a misdemeanor involving dishonesty or false statements, under the laws of the state or any other state, or under the laws of the United States. Has violated any of the provisions of this chapter, any other provision of this Code applicable to the activities of a solicitor, or the ordinances of any other municipality regulating soliciting. Has had his or her license issued under this chapter revoked as provided in this article. Is required to register as a sex offender under the Illinois Sex Offender Registration Act, 730 ILCS 150/3, under the laws of any other state, or under the laws of the United States. Has been convicted of, found guilty of, or found liable for any activity constituting fraud, material misrepresentation, or disorderly conduct during the course of soliciting in the Village or any other municipality. Does not otherwise meet the requirements of this chapter.

    Peddler/solicitor permits will expire thirty (30) days from the date of issuance. Applicants may renew on a quarterly basis, expiring every ninety (90) days, provided they have had three (3) consecutive months in full compliance with the provisions of this section.

    A photo ID badge issued by the Village shall be worn on the outer layer of clothing at all times of peddling/soliciting.

    Any peddler/solicitor who has gained entrance to or who is on any premises, whether invited or not, shall immediately & peacefully depart from the premises when requested to do so by the occupant.

    It shall be the duty of every solicitor, upon going onto any premises which a residence or nonresidential building as herein defined is located, to first determine whether the notice provided for in this chapter, if any, is attached & to further be governed by the statement contained on the notice. If the notice states "NO SOLICITORS INVITED" or "NO SOLICITORS," then the solicitor shall immediately and peacefully depart from the premises.

    Sec. 18-35. Time limit on soliciting and peddling.

    It shall be unlawful and shall constitute a nuisance for any person whether licensed under this Chapter or not, to go upon any premises and ring the doorbell upon or near any door of a residence, or rap or knock upon any door, or create any sound in any other manner calculated to attract the attention of the occupant of such residence, for the purpose of securing an audience with the occupant and engage in peddling or soliciting before 9:00 a.m. or after 6:00 p.m. Monday through Saturday, & at any time on a Sunday or on a state or federal holiday
