"Sell Yourself Short" Performance Piece Submission Form and Waiver
Some things people have asked about:

- This is the first season of the podcast and we plan to play the field a bit with regard to genre. Depending on interest and submissions, we’ll determine how we want to structure the season, and are appreciative of feedback.

- There isn’t a deadline per se, however there will be a pause when we hit a certain number of submissions, during which the link with briefly close to ensure we can review what we have already. The link will reopen once we’ve reviewed all (or at least most of) the submissions.

- The podcast will be distributed on a bi-weekly schedule.

- We’re planning on releasing through Apple Podcasts and looking at additional pod-catchers for distribution.

- Regarding restrictions - hate speech is a no-go. We are informing authors/playwrights about our decision to record or not record, and in instances of “concerning” material, we’d let them know our concerns. That said, we are not asking authors to edit for content.

- Any edits come from a proofreading standpoint and/or if we are questioning the playwright’s ownership of / permission to use another’s material (such as having a character perform a section of a Tennessee Williams play).

- Restrictions on length - it is short-form performance (the length of the show is intended to be a (very) rough 30 minutes - (25-40). That includes the interview, so submitted pieces should ideally fall somewhere in the range of 15-25 minutes.

- The waiver is primarily to prevent the podcast’s being legally challenged for using the authors’ materials. It’s to acknowledge and verify the author is the owner of the rights, and to grant “Sell Yourself Short” permission to use and record the material.

- Video is mentioned. This is only for promotional purposes, such as video recording an audio recording session - not to do a video production of the pieces.

- There are no fees or royalties.

Dear Author,

We are honored that you are considering submitting your written work to be featured on Sell Yourself Short, a podcast produced by Curtain and Mic Productions. Before you submit your work, we kindly ask you to carefully read and understand the following waiver agreement. By submitting your written piece, you acknowledge and agree to the terms outlined below.

1. Ownership and Rights:

   a) You confirm that you are the sole author and owner of the submitted work, and you hold all necessary rights, licenses, and permissions to grant the below rights and comply with this waiver agreement.

   b) You retain full ownership of your worky. However, by submitting it for consideration, you grant Curtain and Mic Productions a non-exclusive, royalty-free, worldwide license to broadcast, distribute, reproduce, adapt, and publicly perform your written work in any media now known or later developed for the purposes of the Sell Yourself Short podcast and any related promotional material.

2. Editing and Adaptation:

   a) Curtain and Mic Productions may, if necessary, make minor edits to your work for reasons such as improving readability, grammar, or audio adaptability. However, we will not make any substantial alterations without your prior written consent. For purposes of this agreement, digital correspondence is considered “written.”

b) If edits are made, a record of the your consent to edits will be retained by Curtain and Mic Productions.

c) You acknowledge that your work may be read aloud by (a) voice performer(s) to provide the best possible listening experience for the audience.

3. Interview Requirement:

   a) If your work is selected for inclusion on the podcast, you agree to participate in an interview segment conducted by the podcast host(s) and/or (a) representative(s) of Curtain & Mic Productions. This interview will primarily focus on discussing your work, inspiration, creative process, and other relevant aspects related to the submitted piece.

   b) The interview will take place at a mutually convenient time agreed upon by both parties. Curtain & Mic Productions will make reasonable efforts to accommodate your schedule.

   c) You understand that the interview may be recorded and subsequently edited to be included in the podcast episode featuring your short story.

   d) You understand that the interview portion of each episode is integral to the format of the podcast, and that failure to participate will, in all likelihood, result in your piece’s not being featured on the series.

4. Self-Promotion:

   a) Curtain & Mic Productions request that selected authors actively promote the podcast and the episode featuring your piece.

   b) This promotion includes, but is not limited to, sharing the podcast episode on your social media profiles, personal website, or any other platform where you engage with your audience.

   c) You understand that promoting the podcast episode aligns with the goal of creating broader awareness for the Sell Yourself Short podcast, showcasing your work, and supporting the podcasting community.

5. Grant of Rights:

   a) By participating in the interview and engaging in self-promotion, you grant Curtain & Mic Productions the non-exclusive right and permission to use your name, likeness, voice, and any provided promotional materials (e.g., author bio, profile picture) for the purposes of marketing, advertising, and promoting the "Sell Yourself Short" podcast, including related podcast episodes, social media campaigns, or other promotional initiatives.

   b) This grant of rights extends to all media formats now known or later developed, including but not limited to audio, video, print, and digital platforms.

6. Optional Consent:

   a) You understand that while participation in promotion is highly encouraged, it is not mandatory. However, declining to promote the podcast episode featuring your piece may impact the visibility and reach of your work within the "Sell Yourself Short" podcast community.

7. Release and Indemnification:

   a) You release Curtain & Mic Productions, its representatives, hosts, employees, and any affiliated parties from any claims, demands, liabilities, or expenses arising out of or in connection with the use of your piece, including, but not limited to, any claims for defamation, copyright infringement, or violation of privacy rights.

   b) You agree to indemnify and hold harmless Curtain & Mic Productions and its representatives from any third-party claims, damages, or liabilities resulting from the submission, distribution, or use of your short story.

8. Confidentiality:

   a) Curtain & Mic Productions will take reasonable measures to protect the confidentiality of your submission. However, please note that by submitting your short story, Curtain & Mic Productions does not assume any responsibility or liability for any unauthorized use, disclosure, or access to your submission by third parties or unauthorized personnel.

9. Acknowledgment of Voluntary Participation:

   a) By submitting your short story, you acknowledge and confirm that your participation is voluntary and that you are not entitled to any financial compensation or other benefits beyond those explicitly mentioned in this agreement.

By submitting this form you indicate your understanding and acceptance of the terms outlined above. By doing so, you confirm that you have read and agreed to this waiver and that you have the authority to grant the rights and permissions set forth herein.
