  • Police Commissioner Jesus Yanez Must Resign.

    There are too many unanswered questions swirling around the conduct of Police Commissioner Yanez, with regard to a series of events involving the SFPD,  to allow him to remain an active Commissioner on our Police Commission. 

    The details reported in the two links below raise serious concerns that rise to the level of conduct unbefitting of a Commissioner.

    The Charter and the Municipal Code do not explicitly set forth a “code of conduct” for commissioners, but under the Charter, “conduct that “falls below the standard of decency, good faith and right action implicitly required of all public officers is official misconduct which may result in removal from office.”  

    Additionally, Commissioner Yanez’s 700 form, which is a tool used by public officials to disclose their financial interests and other potential conflicts of interest, fails to disclose that his wife, Ilona Yanez, is an SF Public Defender in two seemingly intentional ways: (1) he lists an incorrect address for his wife’s employment and (2) he refers to her as a “city employee” instead of a public defender.  While public defenders may be considered city employees generally, a public defender specifically can be considered a major conflict of interest with the business that may appear before him as a Police Commissioner.  

    Jesus Yanez must either resign or be asked to give up his seat on the Police Commission per the Charter’s standard of misconduct.
