I, hereby grant permission to W.I.S.E. Partnership and its affiliates to use photographs and/or videos of my minor child (named above) taken during the Children's Business Fair and Juneteenth event on Saturday, June 22, 2024 (or alternate rain date) at Gordon Park in Detroit, Michigan. I understand that these photographs and/or videos may be used for promotional purposes, including but not limited to social media, websites, newsletters, and other marketing materials.
I acknowledge that no one will receive any compensation for the use of these photographs and/or videos. I also understand that W.I.S.E. Partnership and its affiliates will make reasonable efforts to ensure that my likeness is used in a respectful and appropriate manner.
By signing this release, I waive any right to inspect or approve the finished product and release W.I.S.E. Partnership and its affiliates from any liability arising from the use of the photographs and/or videos.
I hereby acknowledge and agree to the following terms and conditions in consideration for my participation in the Adopt-a-Park programming and events taking place during the summer of 2024:
· Assumption of Risk: I understand that participation in park programming and events involves inherent risks, including but not limited to physical injury, property damage, and exposure to environmental hazards. I voluntarily assume all such risks associated with my participation (and/or the above named child).
· Release of Liability: I hereby release, waive, discharge, and covenant not to sue W.I.S.E. Partnership, its officers, directors, employees, agents, City of Detroit, and volunteers from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me (and or the above named child) or to any property belonging to me (and or the above named child), whether caused by the negligence of the releasees or otherwise.
· Indemnification: I agree to indemnify and hold harmless W.I.S.E. Partnership from any loss, liability, damage, or costs, including attorney fees, arising out of or related to my participation (and/or the above named child) in park programming and events.
· Medical Treatment: In the event of an emergency, I authorize W.I.S.E. Partnership and its representatives to seek and consent to emergency medical treatment for me (and or the above named child) if deemed necessary. I understand that I am solely responsible for any medical expenses incurred because of such treatment.
· Photographic Release: I grant W.I.S.E. Partnership the irrevocable and unrestricted right to use and publish photographs or videos of me (and or the above named child) taken during park programming and events for promotional, educational, or other purposes without compensation.
· Compliance with Rules and Regulations: I agree to abide by all rules, regulations, and instructions provided by W.I.S.E. Partnership and its representatives during park programming and events. I will not sell or distribute illegal or controlled substances, nor consume any on the premises.
· Governing Law: This waiver shall be governed by and construed in accordance with the laws of Michigan, and any dispute arising under or in connection with this waiver shall be resolved exclusively in the courts of Michigan.
I have read this waiver and fully understand its contents. I voluntarily agree to its terms and conditions, and I acknowledge that I am signing this waiver freely and without duress. My signature below confirms my agreement to all terms and conditions.
