Seller and Buyer have been advised to seek proper guidance regarding alternative possession arrangements. In the event of pre or post possession of more than 30 days, Buyer and Seller agree to execute an AAR Residential Lease Agreement no later than _____ day(s) after mutual acceptance.
Buyer agrees to accept the Premises in its present condition and waives the Inspection Period (Section 6a), Inspection Period Notice (Section 6i), and Buyer Disapproval (Section 6j). This contract is not subject to any buyer inspections or investigations into the location, physical condition or any other material matters to the buyer. Buyer has reviewed and signed the attached Home Inspection Waiver Notice.
Buyer waives lines 273-284 of section 6j of the Residential Purchase Contract. Buyer agrees that at the completion of Buyer’s Inspection Period, no repair requests, credits or price reductions will be requested by the Buyer via the Buyer’s Inspection Notice and Seller’s Response (BINSR) document. Buyer may use the BINSR to either accept or reject the Premises. In the event Buyer does not comply with this provision, the Seller may elect to immediately cancel this Contract and Buyer will forfeit their earnest money.
In the event that termites are found during the Inspection Period, Seller agrees to treat as prescribed by the company of Buyer’s choice and provide Buyer with a 1 year warranty.
Seller agrees to provide Buyer a full scope of the remodel, permits required for completed work if applicable and GC and/or Sub Contractor ROC License Number information.
Buyer's earnest money shall be non-refundable unless Buyer elects to cancel pursuant to the Due Diligence section of the Contract, the Contract is cancelled pursuant to the Risk of Loss provision or escrow fails to close due to Seller's breach of contract. Buyer acknowledges that Buyer's earnest money shall be non-refundable even if the Premises fail to appraise for the sales price or the loan contingency is unfulfilled, unless prohibited by Federal Law.
