Tomorrow's Generation Terms of Business Agreement with Clients
Client: This term refers to the individual, family, or business entity that engages the services of an agency to find a candidate for employment. The client is the party seeking to hire.
Agency (Tomorrow’s Generation): An intermediary service, in this context, "Tomorrow’s Generation" is the organisation that specialises in connecting clients with potential candidates or employees. The agency facilitates the hiring process but is not the direct employer of the candidate.
Candidate/Employee: This refers to the individual being considered for a position or role by the client. The candidate, upon successful placement, becomes the employee of the client, not of the agency.
Fee Payment Obligations
Upon offering a position to a candidate and acceptance by said candidate, the Client is obligated to fulfil the payment of the agreed fee to Tomorrow's Generation. The fee is detailed to the Client by email, before the Client agrees to use the Agency. This will consist of an commitment fee before Tomorrow’s Generation will conduct any search. A final matching fee, this payment is due upon acceptance, within 48 hours, rather than the commencement of employment. For roles located overseas, payment must be completed within ten days of invoicing or prior to the employee's departure from the UK, whichever is sooner. Fee prices are viewable on our website.
Notification Requirements
The Client must promptly inform Tomorrow's Generation immediately when an offer of employment is accepted. Tomorrow’s Generation requests all offers to be communicated via the Agency to allow the agency to negotiate on behalf of the client.
Re-engagement Clause
If a Client re-engages an employee within a 24-month period following the termination of the initial employment, a new fee will be levied, requiring immediate notification to Tomorrow's Generation of such re-engagement.
Cancellation Policy
Should the Client cancel the engagement prior to the employee's start date, compensation equivalent to one week's salary is payable to the employee, alongside reimbursement of all incurred expenses by Tomorrow's Generation, which will be communicated to the Client by email. The matching fee is still due for payment, since Tomorrow's Generation completed it's service in full.
Refund and Replacement Policy
Tomorrow's Generation offers a replacement service instead of refunds. If an employee leaves or fails to start within the first 4 weeks of engagement, a replacement will be provided, provided that UK Employment laws have been adhered to and the client has not extended the candidate's service beyond their notice period. Notice must be served to the in-situ candidate before the agency will source a replacement.
The matching fee is non-refundable and non-transferable, emphasising our commitment to finding the right match for your needs.
Termination Notification
Employment termination requiring a replacement must be reported in writing within three days. Refunds are void if full payment was not paid by the payment date, or if the Client opts against seeking a replacement.
Travel Expenses
Clients are responsible for reimbursing interview travel expenses for potential employees.
Employment Details
Clients must provide employees with written details concerning salary, duties, and time off before engagement. Tomorrow’s Generation can assist with this, should the client request it.
Confidentiality
All candidate information provided by Tomorrow's Generation is confidential. Unauthorised sharing incurs a fee equivalent to the full introduction fee.
Liability and Due Diligence
While Tomorrow's Generation strives to verify candidate suitability, ultimate responsibility lies with the Client to ensure candidate compatibility, with no liability on the Agency for losses or damages arising from placements.
Travel and Work Permit Arrangements
Clients are responsible for arranging and funding employee travel and obtaining necessary work permits, with no refunds for permit-related issues.
