This is an Agreement between Fergus Canada and the Client (Pet Owner). Services, charges, days and times to be agreed by both parties and set out in writing.
The utmost of care will be given in watching your pet(s). Fergus Canada will undertake the agreed-on services, and the Pet Owner undertakes to provide all necessary information to assist in this performance. Fergus Canada will provide the services agreed in a reliable, caring and trustworthy manner. In consideration of these services, the Client waives any and all claims against Fergus Canada.
Fergus Canada undertakes to notify the Pet Owner of any occurrence pertaining to the dog which may be relevant to the care and well-being of the dog.
SERVICES Private dog nanny; home boarding, solo walks, on-walk training, after walk paw cleaning, photo/video updates, feeding, meal prep, administering oral or topical medications, in-home drop-in visits, canine enrichment activities, and backyard excrement cleaning.
TRAINING You agree to have your dog on leash for walks, and off leash within fenced areas at your own risk. You agree for Fergus Canada to use training corrections and techniques when applicable.
REQUIREMENTS All pets under the care of Fergus Canada are to be current on vaccinations. The Pet Owner will provide suitable harnesses, collars and leads as approved by Fergus Canada as well as coats or boots if required.
As a courtesy to Fergus Canada and to ensure Fergus Canada is able to professionally provide services to your pet(s) without inconvenience, the service address (e.g. your home) should be kept in clean and orderly condition during the service dates. The client must provide all items necessary for pets to be adequately cared for in the client's absence. (I.e., food, medication, bedding, etc.) Should pets require any additional supplies whilst in the care of Fergus Canada, these will be purchased and charged to the Client.
SOCIAL MEDIA The client gives consent for their pet’s image to be used in photo or video format on Fergus Canada social media pages or promotional material.
DUTIES/SERVICES Fergus Canada shall not be obliged to perform any other duties except those specified and agreed upon, per this agreement.
KEYS Fergus Canada warrants to keep safe and confidential all keys, remote control entry devices, access codes and personal information of the Pet Owner and to return to the same Pet Owner at the end of the contract period or immediately upon demand.
PAYMENT The client is responsible for settling past invoices for services 2 days prior to the commencement of the assignment. Failure to do so will incur a $5 a day penalty. All payments can be acknowledged and receipted if required.

DAMAGES Fergus Canada accepts no liability for any breach of security or loss of or damage to the Pet Owner's property if any other person has access to the property during the term of this agreement. Fergus Canada shall not be liable for any mishap of whatsoever nature which may befall a dog or caused by a dog who has unsupervised access to the outdoors.
It is understood that anyone with access to the home will be notified of Fergus Canada presence and vice versa. Fergus Canada reserves the right to refuse entry to any visitors or pre-authorized visitors informed about by the Pet Owner. Fergus Canada will not be held responsible for any damages incurred to your home or pet(s) by visitors or pre – authorized visitors. The Client agrees to notify Fergus Canada of any concerns within 24 hours of client’s return home. Fergus Canada cannot be held responsible for any mishaps, claims, and/or expenses attributed to a destructive or unpredictable behavior of the Client’s pet(s) that cause damage to the Client’s home/property and/or a neighbor’s home/property. (i.e., biting, furniture damage, accidental death, etc Nor can Fergus Canada be held liable for injury, disappearance, death, or fines of pet(s) with access to the outdoors.
LOSS OR INJURY The Pet Owner shall be liable for all medical expenses and damages resulting from an injury to the Private Dog Nanny, any animals or any person caused by the dog as well as damage to any property. Fergus Canada are not liable for death or injury to any dog in the event of a motor vehicle accident. Fergus Canada are not liable for loss or injury to any dog.
DISPUTES Before taking any court action, a party must use best efforts to resolve any dispute under, or in connection with the Agreement through good faith negotiation. Each party must, to the extent possible, continue to perform its obligations under the Agreement even if there is a dispute.
GENERAL PROVISION Fergus Canada are not liable to the Client for any failure to perform its obligations under the Agreement to the extent caused by Force Majeure, provided that the affected party a) immediately notifies the other party and provides full information about the Force Majeure; b) uses best endeavors to overcome the Force Majeure; and c) continues to perform its obligations as far as practicable.
SEVERABILITY Any illegality, unenforceability or invalidity of a provision of the Agreement does not affect the legality, enforceability or validity of the remaining provisions of the Agreement.
EMERGENCIES If the Client, or the other contact person cannot be reached, the Client agrees to accept any decision Fergus Canada makes in regards to the pet’s care or Clients property. The client is responsible for any veterinary bills, no matter how they are incurred, whilst pets are in the care of Fergus Canada. The Client agrees to reimburse Fergus Canada for any additional fees for tending to emergency or veterinary care as well as any expenses incurred for the same. The Client also agrees to reimburse for additional time accrued at the rate of $16.55 per hour in the case of such an emergency.
I have read the above terms and conditions. I know, understand, and agree to all terms stated above. By signing below, I am accepting this document as a contractual agreement.
