C. Riding Horses PARTICIPANT UNDERSTANDS THAT: No horse is completely safe and all horses have the potential of posing serious threat, injury or death while riding. At any time, no matter the training or past experiences, and without any warning or obvious reason the horse may buck, spook, bolt, rear, jump, kick, run, bite, fall, stumble, make unpredictable movements, stop suddenly, step on person's feet, run into other riders or people, or throw the rider off. At any given time without reason, equipment such as the saddle, bridle, breast collar, back cinch, front cinch, or saddle pad could become loose or break, resulting in the rider to fall off, be thrown, caught, or drug, and inflict property damage, personal injury or death. SWARTZ PERFORMANCE HORSES is not responsible for total or partial acts, occurrences, or elements that may cause a horse to act in any such manner or a piece of equipment to fail as stated above.
PARTICIPANT UNDERSTANDS THAT: When the participant mounts the horse, willingly, and takes the reins, the participant is primarily in control of the horse and SWARTZ PERFORMANCE HORSES, is not responsible for any actions or inactions of the participant. At this point the participants safety will rely on the ability to stay balanced atop the horse and take instruction provided by appointed instructor.
E. Protective Equipment, Headgear and Attire Requirement
PARTICIPANT UNDERSTANDS THAT: As a requirement to ride any horse, participant is required by SWARTZ PERFORMANCE HORSES to comply with the required riding protective equipment, headgear and attire. At all times when handling, riding or being engaged in any equine activity, the participant agrees to wear jeans or long pants covering entire leg, closed toe shoes with a heel, such as boots, and participants under the age of 18 who will be riding, will be required to wear a riding helmet. The riding helmet should be properly fitted and fastened to head when mounting, riding, and dismounting any horse. Upon failure to comply with the required protective equipment, headgear and attire, the participant will not be allowed to continue with any equine activity until required protective equipment, headgear and attire is provided. If continued failure to comply with the required protective equipment, headgear and attire continues, SWARTZ PERFORMANCE HORSES reserves the right to remove the participant from the premise and not be allowed back or continue in any associated equine activities.
