Statement of Protection of Religious Freedom and Beliefs

Shamans, leaders, Members, participants and guests attest to being here of their own free will. There are no inherent obligations to participate and learn anything about sacred shamanic ceremonies.

First Amendment to the Constitution of the United States of America:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

As defined by the First Amendment to the Constitution of the United States of America, Rise and Shine Ascension Sanctuary is a religious organization (church), and is not subject to regulation which would interfere with or unduly burden our practices or beliefs.  

We understand, respect and care for the safety of all those called to learn sacred shamanic teachings through Rise and Shine Ascension Sanctuary. 

We proclaim that the use of entheogenic sacraments is one of our religious rights.  

I have read and understood Rise and Shine Ascension Sanctuary Statement of Protection of Religious Freedom and Beliefs.

Membership Agreement & Code of Conduct

As a member, including Shamans, leaders, and governing members, of the Rise and Shine Ascension Sanctuary, I agree to follow the foregoing rules and regulations at all times. I acknowledge that my use of Rise and Shine Ascension Sanctuary, and access, including ceremonies may be revoked at any time if it is found by the Shamans, leaders and governing members that I have violated these rules in any way. 

All Shamans, leaders, governing members, members and participants of the Rise and Shine Ascension Sanctuary shall read, acknowledge and sign the Foundation Declaration Statement. 

 
All Shamans, leaders, governing members, members and participants of the Rise and Shine Ascension Sanctuary shall read, acknowledge and sign the Standards and Discipline Agreement.

Furthermore, as a Shaman, leader, governing member and/or member of the Sanctuary, I agree to the following Rules of Conduct:

1. I commit to living in harmony with myself, others and the environment. I will align my thoughts, words and actions with Sacred Entheogenic and non-entheogenic Sacraments’ messages of Spiritual Empowerment, Transformation, Growth, Love, Kindness, Patience, Honesty and Respect to the best of my ability. 
   
   
2. I commit to making an effort to spend time each day in meditation, contemplation, prayer, and quiet sitting, to raise my vibrational frequency to that of Higher Consciousness so that I can be present in Life and work in harmony with the environment in a way that honors it.
   
   
3. I commit to commune with entheogenic sacraments ONLY with the intention of spiritually empowering my body, mind, and spirit. I make a commitment of service to myself and others to create peace and harmony in my relationships.
   
   
4. I commit that I will keep the ceremonies and what is shared by others sacred, not sharing it outside the circle (unless given permission by the parties involved).
   
   
5. I commit that I understand my responsibility and desire to financially sustain and support those who bless me. I am aware that Shamans and leaders are not different from me as we all dwell in the same economic system. They have lives and families that need their time, and they desire to provide for them.
   
   
6. I will be respectful and generous to the best of my ability as they support, love, and guide me on my self-illuminating journey. I wish them the kind of abundance and prosperity that I desire for myself. They also wish that for me.
   
   
7. I will align my actions with the frequency of respect, honesty, honor and justice. I will align my words with the frequency of positive and respectful feedback whenever I see an opportunity for improvement. This includes social media, interviews, and other public forums. If I have criticisms or concerns with another member, I will work it out with them directly or through Shamans and leaders within Rise and Shine Ascension Sanctuary.
   
   
8. I will use entheogenic sacraments only in sacred shamanic ceremonies. I will not share entheogenic sacraments to those who are not members of Rise and Shine Ascension Sanctuary. I understand that doing so removes my legal protection and exposes me to prosecution. No one except an authorized Rise and Shine Ascension Sanctuary Shaman Practitioner, Spiritual Leader, Rise and Shine Ascension Sanctuary authorized Cultivator, or an entheogenic sacrament Custodian can share and ask for donations.
   
   
9. I will respect myself and others emotionally, sexually, mentally, spiritually and physically.
   
   
10. I will respect all ceremonial and sacred tools in Rise and Shine Ascension Sanctuary. I will always ask permission from the Rise and Shine Ascension Sanctuary leaders or authorized representatives before removing any materials.
    
    
11. I will leave Rise and Shine Ascension Sanctuary better and cleaner than when I arrived.
    
    
12. I will not smoke or use entheogenic sacrament within 50 feet outside of Rise and Shine Ascension Sanctuary.
    
    
13. I will at all times be discreet, and respectful of others at Rise and Shine Ascension Sanctuary. I respect the sacred nature of Rise and Shine Ascension Sanctuary.
    
    
14. I will be mindful of the use of technology within Rise and Shine Ascension Sanctuary.
    
    
15. I will support the cultural, spiritual, and sacred shamanic use of entheogenic sacraments.
    
    
16. Periodically, when feasible, I will donate my time if requested or needed by Rise and Shine Ascension Sanctuary, for the betterment of the community and Rise and Shine Ascension Sanctuary.
    
    
17. I acknowledge that the Sanctuary is NOT a dispensary, and entheogenic sacraments are NOT for sale, under any circumstances.
    
    
18. I will not rely on, nor will I be able to purchase entheogenic sacraments from any representatives or members of the Sanctuary.
19. Any donations made to the Sanctuary goes towards operational costs, shamanic support, as well as costs to acquire sacraments and ceremonial tools and supplies.
    
    
20. By sharing space at any Rise and Shine Ascension Sanctuary facility or ceremony, I acknowledge and fully understand that as a participant, I will be engaging in activities that involve potential risk of serious injury, including permanent disability and death, property loss and severe social and economic losses. These risks include, but are not limited to: (a) the actions, inactions, or negligence of the organizers of the Sanctuary i.e. Rise and Shine Ascension Sanctuary and its officers, directors, employees, agents, representatives, volunteers, contractors, and/or affiliates (collectively, “Rise and Shine Ascension Sanctuary”) and/or worshipers of Rise and Shine Ascension Sanctuary; (b) conditions of the premises or equipment used; (c) rules and regulations regarding the activities; (d) temperature; (e) smoke, including but not limited to: Entheogenic Sacraments, paper, or tobacco smoke; (f) chemicals including beta-myrcene, which are known to the State of California to cause cancer, and cadmium, which are known to the State of California to cause birth defects or other reproductive harm. For more information go to www.P65 Warnings.ca.gov; (g) condition of participants; and (h) any other liability resulting from membership or attending Rise and Shine Ascension Sanctuary. I further acknowledge and fully understand that there may also be other risks that are not known or foreseeable at this time. I KNOWINGLY AND VOLUNTARILY ASSUME ALL RISK OF PROPERTY LOSS, PERSONAL INJURY, SERIOUS INJURY, OR DEATH, WHICH MAY OCCUR BY MATERIALS RECEIVED FROM AND/OR ATTENDING THE SANCTUARY, AND HEREBY FOREVER RELEASE, DISCHARGE, AND HOLD RISE AND SHINE ASCENSION SANCTUARY HARMLESS FROM ANY CLAIM ARISING FROM SUCH RISK, EVEN IF ARISING FROM THE NEGLIGENCE OF RISE AND SHINE ASCENSION SANCTUARY, OR FROM THIRD PARTIES, AND I ASSUME FULL RESPONSIBILITY AND LIABILITY FOR MY PARTICIPATION.

When the actions of members are out of alignment with the rights and spiritual well-being of other members, we shall issue a “Letter of Trust” outlining the ways all can come into alignment with Love and Understanding.

We invite all to become introspective about their words and actions and to make reparations to those that feel offended or hurt. If our guidance is ignored, and negative behaviors continue, we will issue a “Letter of Probationary Status” which indicates that they are no longer under our protection and cannot access Rise and Shine Ascension Sanctuary resources or be vouched for as a member in good standing.

A member who has left the protection for the use, possession, or transport of entheogenic sacraments will be denied entrance to Rise and Shine Ascension Sanctuary events and/or ceremonies. This letter also invites them to return to integrity and fellowship. It is our desire that all people be afforded their unalienable rights and one of those is agency – the ability to choose their path. If a person chooses a path that takes them away from the truth and peace we offer, we respect that choice.

All members, participants and guests of Rise and Shine Ascension Sanctuary confirm that they respect and honor the rights guaranteeing freedom of religion and speech.  Any person or act that violates this right or causes burden on the practice of our spiritual doctrine is subject to a monetary fine of $10,000.00 USD.

Sacraments – Personal Use Requirements and Limitations

Rise and Shine Ascension Sanctuary membership states that a member shall not obtain sacraments for personal use. Sacraments shall only be used in sacred shamanic ceremony. 

Sacraments are clearly labeled for inventory tracking purposes. Sacraments are exclusively handled by and under the guardianship of our three (3) Rise and Shine Ascension Sanctuary Shamans.  Rise and Shine Ascension Sanctuary strives to always abide by a three-lock rule for all entheogenic sacrament storage.  Sacraments are never stored in the same location as where ceremonies are conducted.

Personal Use Amounts

Members are not allowed to sell, trade, or gift entheogenic sacraments listed as controlled substances by the United States government. These are made available only through authorized and recognized shamans and leaders or designated entheogenic sacrament custodians of Rise and Shine Ascension Sanctuary. 

This is crucial because we know where those sacraments are sourced, how they were prepared and that they are free of harmful or additional elements that we do not endorse or that may be dangerous to our members.

Simply becoming a member of Rise and Shine Ascension Sanctuary does not make you a recognized entheogenic sacrament custodian, nor does it give you authorization to conduct ceremonies under Rise and Shine Ascension Sanctuary. We are happy to guide you if that is your intent. Transportation and handling of entheogenic sacraments requires a letter of authorization from the shaman or entheogenic sacrament custodian.

Dosages and limitations may be different for those who are designated as or by Shamans, Spiritual Leaders, or custodians, and have a membership card from Rise and Shine Ascension Sanctuary stating their status. Those differences are designated only by Rise and Shine Ascension Sanctuary.

Information About Other Entheogenic Sacraments:

Rise and Shine Ascension Sanctuary recognizes all entheogenic sacraments as being effective. However, Rise and Shine Ascension Sanctuary does not authorize the use or cultivation of any other entheogenic sacrament.

By signing below, applicant confirms they have read and agree to abide by all guidelines and requirements for Rise and Shine Ascension Sanctuary membership.

  

It is imperative, you must be 100% truthful and accurate in completing this form in its entirety.  Your Responses to the following questions determine whether you may safely participate in a members-only sacred ceremony.  

The ceremony with Rise and Shine Ascension Sanctuary is primarily a spiritual undertaking and although personal growth can occur, the experience should not be seen nor is it designed to be a substitute for psychotherapy, psychiatric or other medical care. This ceremony is not appropriate for persons with certain medical conditions or for persons using certain medications. If you have any doubt or concerns about whether you should participate, consult with the organizer before attending. Please answer the following questions as completely and honestly as possible.

CONTRAINDICATIONS: Please be aware that the list of contraindicated substances includes but is not limited to SSRIs, SNRIs, pain medication, cold and sinus medication, decongestants, nasal sprays, hay fever medications, diet pills, heart medication, amphetamines, MDMA, and other drugs and substances. If you have been using any drugs, medical, over the counter, or otherwise, please advise the organizer to discuss this matter further.

I hereby confirm that I have read and understood the above information and have answered all the questions completely and honestly and have not withheld any information. My general health, as far as I am aware, is good.

IMPORTANT FOR WOMEN: If you are expecting to be on your moon time during the ceremony we ask that you wait to attend until the two do not coincide. Please feel free to ask for more information about this.

ATTESTATION

I hereby confirm that I understand the importance of answering the foregoing questions truthfully and to the best of my knowledge and ability.  This understanding is reflected in my initials at the top of this document. 

 

Therefore, I hereby represent that all answers to the foregoing screening questions are 100% truthful and accurate.  I further understand that my answers to the foregoing screening questions determine my eligibility to participate in Rise and Shine Ascension Sanctuary scared ceremonies; and if I am denied participation in a Rise and Shine Ascension Sanctuary sacred ceremony due to my answers to the foregoing screening questions, that such a denial is based on Rise and Shine Ascension Sanctuary’s determination that my exclusion is for the safety and benefit of myself and other ceremonial participants.

 

I understand that this screening form is attached to and made part of the Rise and Shine Ascension Sanctuary Waiver of Liability form.

I hereby warrant and represent that I am of sound mind and body, and it is my belief I am mentally and physically fit to participate in a Rise and Shine Ascension Sanctuary sacred ceremony, notwithstanding its staff's determination as to my fitness to participate.

I the undersigned hereby seek to participate in the ceremony with Rise and Shine Ascension Sanctuary. 

I understand the Sanctuary seeks to ensure the safety of all participants. In order to assist in this regard, I agree to complete the Confidential Medical History form provided. I am assured that the information provided will remain strictly confidential and will serve only as a guide in determining the appropriateness of my participation in the meditation and in meeting my needs before, during and after the ceremony. 

I have been informed of the nature of the medicine, the needed preparation, and the rules of the ceremony. I commit myself to stay in the circle until the end of the ceremony and to respect the directives given by the organizers, helpers, and leader(s) of the ceremony.

IN CONSIDERATION OF the risk of injury that exists while participating in the Sacred Ceremony facilitated by Rise and Shine Ascension Sanctuary (hereinafter the “Activity”); and,

IN CONSIDERATION OF my desire to participate in said Activity and being given the right to participate in same;

I HEREBY, for myself, my heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively, “Releasor,” “I” or “me”), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Activity; and

I HEREBY release and forever discharge Rise and Shine Ascension Sanctuary, a California non-profit church, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns (collectively, “Releasees”), from any physical or psychological injury that I may suffer as a direct result of my participation in the aforementioned Activity.

I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK, I AM AWARE OF THE RISKS ASSOCIATED WITH PARTICIPATING IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO: PHYSCIAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH.  I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS’ NEGLIGENCE, CONDITIONS RELATED TO TRAVVEL TO AND FROM THE ACTIVITY, OR FROM CONDITIONS AT THE ACTIVITY LOCATION(S).  NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN AND UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY.

I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs.

I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees.  In the event that I should require medical care or treatment, I authorize Rise and Shine Ascension Sanctuary to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AED’s, emergency medical transport, and sharing of all medical information with medical personnel.  I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment.  I am aware and understand that I should carry my own health insurance.

I FURTHER ACKNOWLEDGE that this activity may involve a test of a person’s physical and mental limits and may carry with it the potential for death or serious injury.  I agree not to participate in the Activity unless I am medically able and I agree to abide by the decision of the Rise and Shine Ascension Sanctuary official or agent, regarding my approval to participate in the Activity.

I HEREBY ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS “WAIVER AND RELEASE” AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY.  I EXPRESSLY AGREE TO RELASE AND DISCHARGE RISE AND SHINE ASCENSION SANCTUARY AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE MIGH HAVE TO BRING A LEGAL ACTION AGAINST RISE AND SHINE ASCENSION SANCTUARY FOR PERSONAL INJURY.

I FURTHER REPRESENT that I understand the Activity includes the ingestion of natural entheogenic substances, as well as other Amazonian sacred healing plants.

I FURTHER REPRESENT that I have been provided information regarding the contraindication of natural entheogens with certain medications, including but not limited to SSRI’s.  I represent that I have read and fully understand the information that was provided to me.  I represent that I am not currently taking any of the medications listed that are contraindicated with natural entheogenic substances, such as those to be consumed as part of the Activity, as defined herein.

I FURTHER REPRESENT that I have been provided information regarding the dangers associated with consuming natural entheogenic substances while suffering from certain medical conditions, both physical and mental in nature.  I represent that I have read and fully understand the information that was provided to me.  I represent that I am not currently suffering from any of the medical conditions listed.

I FURTHER REPRESENT THAT I HAVE BEEN ABSOLUTELY TRUTHFUL AND HONEST IN DISCLOSING MY CURRENT MEDICATIONS AND PRIOR AND CURRENT MEDICAL HISTORY AND I UNDERSTAND THAT NOT BEING TRUTHFUL AND HONEST REGARDING SAID ITEMS COULD RESULT IN MY PHYSCIAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH AS A REUSULT OF MY PARTICIPATION IN THE ACTIVITY.

I FURTHER REPRESENT that I will follow instructions given by the facilitators of the Activity, will not leave the ceremony space until the conclusion of the Activity, and will not disclose the nature of the Activity or the participants in the Activity to any third parties.

I FURTHER REPRESENT that I intend to participate in the Activity with the purest of intention of heart, promoting the well-being of all participants.

To the extent that statute or case law does not prohibit releases for ordinary negligence, this release is also for such negligence on the part of Rise and Shine Ascension Sanctuary, its agents, and employees.

I agree that this Release shall be governed for all purposes by California law, without regard to any conflict of law principles.  This Release supersedes any and all previous oral or written promises or other agreements.

In the event that any damage to equipment or facilities occurs as a result of my or my family’s or my agent’s willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions or neglect or recklessness.

THIS WAIVER AND RELEASE OF LIABILITY SHALL REMAIN IN EFFECT FOR THE DURATION OF MY PARTICIPATION IN THE ACTIVITY, DURING THIS INITIAL AND ALL SUBSEQUENT EVENTS OF PARTICIPATION.

THIS AGREEMENT was entered into at arm’s length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength.  Both Participant and Rise and Shine Ascension Sanctuary agree that this agreement is clear and unambiguous as to its terms, and that no other evidence shall be used or admitted to alter or explain the terms of this agreement, but that it will be interpreted based on the language in accordance with the purposes for this it is entered into.

In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect.  If a court should find that any provision of this agreement to be invalid and unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.

I, THE UNDERSIGNED PARTICIPANT, AFFIRM THAT I AM OF THE AGE OF 18 YEARS OR OLDER, AND THAT I AM FREELY SIGNING THIS AGREEMENT, I CERTIFY THAT I HAVE READ THIS AGREEMENT, THAT I FULLY UNDERSTAND ITS CONTENT AND THAT THIS RELEASE CANNOT BE MODIFIED ORALLY.  I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND THAT I AM SIGNING IT OF MY OWN FREE WILL.
