  • I/WE THE CUSTOMER ACKNOWLEDGES AS FOLLOWS:
    10. COMMERCIAL CREDIT TRADING TERMS AND CONDITIONS: To having received the Commercial
    Credit Trading Terms which were attached to this application.


    1. PERSONAL GUARANTEE AND INDEMNITY: That if the customer is a Company, then the directors
    will execute the Personal Guarantee and Indemnity on the reverse of this Application.

     

    2. DUTY OF DISCLOSURE: The Customer warrants not to be in receipt of any information, notice of
    court proceedings that may lead to Bankruptcy, Appointment of an Administrator, Controller or
    Managing Controller, Receiver or Receiver Manager or Liquidator, and that the Customer does not
    intend to enter into any scheme of arrangement with creditors either formally through a court, or
    otherwise. Further, the Customer warrants that none of its directors have been a director of a
    company placed in liquidation or administration, or has been declared bankrupt or entered into an
    arrangement, under the Bankruptcy Act 1966 (as amended).


    3. PRIVACY ACT: You authorise the Supplier to obtain from reporting agency details of your personal
    and commercial credit information if required by the Supplier for the purpose of assessing this credit
    application.
    THIS IS TO CERTIFY: that I/We have read, understand and accept the Commercial Credit Trading Terms
    and Conditions, and further acknowledge that I/We understand and accept paragraphs 1-3 above,
    and that I/We are authorised to make this application on behalf of the Customer, and without undue
    or unfair tactic, append my/our signature here unto:

    4. Definitions

    4.1. "Lighting Options" means Alpha Performance Innovation Pty Ltd T/A Lighting Options Lighting Australia

    4.2. "Price" means the Price payable for the goods as agreed between Lighting Options and the customer in accordance with clause 2 below.

    5. Price and Payment

    5.1. At Lighting Options's sole discretion the Price shall be either Lighting Options's quoted price (subject to clause 2.2) which will be valid for the period stated in the quotation or otherwise for a period of thirty (30) days.

    5.2. Lighting Options reserves the right to change the Price without notice if unavoidable

    5.3. Payment terms are thirty (30) days from date of invoice issued.

    5.4. Payment may be made by cheque, EFT or credit card (Visa & Mastercard, no processing fee if paid within 7 days of date of invoice. After 7 days Visa & Mastercard will incur a 1.2% processing fee. Amex payments will attract a 1.5% surcharge).

    5.5. Unless otherwise stated the Price does not inclue GST

    5.6. Failure to pay within terms may attract additional collection costs.

    Warranty replacements deemed applicable by the seller are provided at no charge. Credits may not be deducted for warranty claims.
