Child Swim Waiver Child/Parent SWIM Participant Waiver & Acknowledgement Acknowledgments: Poolside Health and Safety No outdoor footwear or strollers can be taken into the pool area. Footwear can be left on the mat inside the gated door, strollers must be left outside the gated area on the grass. Please shower yourself and your child prior to entering the pool using either the indoor shower inside the building, or the outdoor shower at the pool area. Removing body lotions, perfumes etc via showering before entering the pool(s) contributes significantly to maintaining water quality. You are responsible for the safe supervision of any children you bring with you at all times. If you are bringing more than one child to the venue, you must have an adult present to supervise children not in the pool with you. Children should always be under clear and direct supervision of an adult, and never to be left unattended. Children running on wet surfaces can seriously injure themselves, therefor we have a NO RUNNING policy strictly enforced in and around our pool areas at all times. It is vital that you inform us of any medical conditions you and/or your child has prior to entering the pool, that might affect your/their ability to be in the pool. All information received is treated sensitively and confidentially. All individuals bringing their children/others children into the pool area at the YARD take full and ultimate responsibility for their own and the Childs medical and health issues, and will be deemed by the YARD to have taken all necessary advice and obtained the appropriate authority to engage in water activities. Never bring your child swimming if they have any illnesses such as ear infection, diarrhea, vomitting, chicken pox, impetigo, conjunctivitis, a bad cold or if anyone in your family (yourself or child or in your home) has had COVID 19 or have been asked to isolate. All illness symptoms must be clear for 48 hours prior to entering the pool, or 72 hours if a gastrointestinal bug has been diagnosed. Our staff may refuse entry to the pool if they reasonably believe that you or your child is not well enough to participate.DIAPERS/CHANGING BABIES For children 4 years of age and under: without exception, all babies/toddlers under 4 years of age, regardless of whether they are potty trained, must wear a double diaper system, either a reusable diaper or a disposable diaper on top. Children wearing other attire including wetsuits, warmers etc, must still wear a swim diaper of sorts. We reserve the right to refuse entry to any child who is not wearing suitable attire. We do our very best to ensure a highly sanitary and cleaned pool area and swimming pool, please help us contribute to this by ensuring your child does not defecate in the pool or in the pool surroundings. We understand accidents happen, if an accident does occur and there is feces either in the pool or on the pool deck at any time, you MUST notify a staff immediately.* A cleaning fee of $250.00 will be applied and must be paid at the time of incident, no exceptions * For children over 4 years, that are not potty trained, the rules above apply. For children over 4, who are potty trained, we recommend encouraging your child to use the washrooms prior to entry to the pool, and remind them they cannot pee in the pool. You may change your babies/children in the washrooms located inside the building. You can feel free to change your baby, on a towel or changing mat at the poolside, especially if you have another child with you. Please ensure you take used diapers with you and do not leave them at the pool, and never place them in an open garbage disposal. You can put them into the dumpster at the back of the building if you wish. EXCLUSION OF LIABILITYI am aware that swimming pools involve many risks, dangers and hazards. The risks, dangers and hazards, including but not limited to: loss of balance; variation or steepness in pool decks and floors; slips caused by wet environs, trips caused by pool equipment or other items; mechanical failure of equipment; exposure to temperature extremes; travel or transport to and from the YARD Pool area/facilities; failing to participate safely or within the limitations of one’s own abilities, negligence of other participants; and NEGLIGENCE ON THE PART OF THE YARD, INCLUDING THE FAILURE ON THE PART OF THE RISKS RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF The YARD CLASSES. I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH The YARD CLASSES, AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM. In consideration of the YARD agreeing to my/my children’s, participation in the usage of their pool and amenities and permitting my/my children’s use of their services, equipment and other facilities, I agree as follows: 1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against The YARD AND TO RELEASE The YARD from any and all liability for any loss, damage, expense or injury, including death, that I or my children may suffer or that my next of kin may suffer, as a result of my participation in The YARD DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, ON THE PART OF The YARD, AND FURTHER INCLUDING THE FAILURE ON THE PART OF The YARD TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN “SPORT” REFERRED TO ABOVE;2. TO HOLD HARMLESS AND INDEMNIFY The YARD for any and all liability for any property damage, loss or personal injury to any third party resulting from my or my childrens, participation in swimming at The YARD;3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my or my children’s death or incapacity;4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the province where your classes take place and no other jurisdiction.
