PARENTS AND GUARDIANS ACKNOWLEDGEMENT OF RISKS, DANGERS AND OBLIGATIONS TO JUNIORS
I/WE ACKNOWLEDGE that moto-cross racing is a dangerous sport and that by allowing my child/or the child in my care to enter the venue and participate as a junior participant/competitor I/WE understand and accept that my child/or the child in my care understands that:
a) he/she could suffer personal injury (both physical and/or mental) or death, or loss and/or destruction of their bike(s) and/or equipment
b) other participants/competitors may ride dangerously or with lack of skill
c) hazardous track or event conditions can occur without warning or predicability
d) the Organisers and any agents or representatives of those in charge of practise sessions or race meets may need to make decisions about the safety of a course or an event with little or no warning
e) in the event of injury to my child/or the child in my care that LJMC Inc has limited on-site treatment facilities for dealing with injuries or provision of ambulance services to hospital may be limited or delayed
f) my child/or the child in my care will compete safely and within the rules of competition so as not to expose other competitors, officials or spectators to the risk of injury or death
g) my child/or the child in my care will comply with all decisions of the Organisers during practise or competition
h) the LJMC Inc, the Organisers and the land owner take no responsibility for the loss or damage to a competitor’s personal property including money or other valuable items
i) my child/or the child in my care is not in the influence of intoxicating liquor or drugs during competition
j) my child/or the child in my care is medically fit to participate in this event(s).
INDEMNITY GIVEN BY PARENTS AND GUARDIANS OF JUNIOR COMPETITORS
IN CONSIDERATION of the acceptance of my child/or the child in my care as a participant in any event organised by LJMC Inc and the Organisers from January 1, 2024– February 28, 2025 I/WE AGREE TO INDEMNIFY the LJMC Inc, the Organisers and the Land owner/s on behalf of my child/or the child in my care and acknowledge that:
a) I/WE consent to my child/or the child in my care participating in practise sessions or race meets
b) I/WE understand and accept that my child/or the child in my care is aware of the rules, risks and dangers associated with participating in moto-cross and to the best of our knowledge they understand and consent to those risks
c) I/WE understand and accept that my child/or the child in my care accepts the venue with all or any defects hidden or exposed
d) I/WE declare that I/WE have read and understood the LJMC Inc Rules and any Supplementary Regulations that may be issued for the day and explained them to my child/or the child in my care
e) on behalf of my child/or the child in my care I/WE release and indemnify the LJMC Inc, the Organisers and the landowner/s against any actions or claims or liability for any damage, loss or injury my child/or the child in my care may suffer arising in any way out of the event(s)
In the Australian Consumer Law, several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier of these services (LJMC Inc, named on this form) is required to ensure that the recreational services it supplies are rendered with due care and skill; and are reasonably fit for any purpose which you, either expressly or by implication, make known to them; and might reasonably be expected to achieve any result you have made known to the supplier.
If you sign this form, you agree to waive all legal rights against LJMC Inc under the Australian Consumer Law, and any other applicable legislation that may apply in the event that your child or the child in your care is injured or killed because the services provided which may not have been in accordance with these guarantees, which are excluded, restricted or modified in the way set out in this form.
NOTE: The change to any rights, as set out in this Form, will not apply in event of death or serious injury due to gross negligence on the Organiser’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission.
If you do not understand this form, or do not agree to be bound by the provisions of this Agreement, you should not sign it and thereafter should forthwith leave the Venue.
