IN CONSIDERATION of being allowed to participate in the Tuesday Night Finger Lakes Athletic Club (FLAC) Beach Volleyball League to be held on Tuesday nights beginning June 2024 through August 2024 sponsored by Dewey's Party House/Clam Man's Party House and Finger Lakes Athletic Club (FLAC), the undersigned for himself/herself and his/her personal representative, heirs, successors, assigns and next of kin: HEREBY releases, waives, discharges and covenants not to sue Dewey's Party House/Clam Man's Party House or FLAC, its subsidiary and affiliated companies and businesses, their insurers, and each of their respective officers, directors, agents, employees, representatives, heirs, successors, and assigns for any and all loss or damage, and any claim or demands therefore on account of injury, death, or property damage arising out of or related to participating in the Activity, whether caused by the negligence of Dewey's Party House/Clam Man's Party House, FLAC, or otherwise. HEREBY assumes full responsibility for any risk of bodily injury, death or property damage arising out of or related to the Activity whether caused by the negligence of Dewey's Party House/Clam Man's Party House, FLAC, or otherwise. HEREBY agrees to abide by all of rules, guidelines, policies or codes of behavior associated with the Activity. HEREBY grant Dewey's Party House/Clam Man's Party House and/or FLAC the right to take photographs of the undersigned in connection with the above identified subject. Additionally grant Dewey's Party House/Clam Man's Party House and/or FLAC to copyright, us and publish the same in print or electronically, and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content. HEREBY understands that Dewey's Party House/Clam Man's Party House and/or FLAC have the right to remove any person from any of its leagues for any reason. If any player is removed from the league, FLAC will not refund any money and the player will not be allowed to play for the remainder of the 2024 season.
